has to do with the race for mayor in november. the same conflict and appearance of conflict does not apply to dufty because his vote and engagement does not have the same impact. it seems it has a greater impact, to me. there is a real vote. it does not seem like a lesser impact. >> there are different ethical standards for lawyers -- lawyers. those rules will trump personal views he may have. it is adherence to those rules. we cannot ask him. he is not here. >> but the memo from august 25, it does not cite a different standard or code of ethics. it -- seems to cite a conflict of interest. would this apply to the board of supervisors? >> i would assume that this is a conflict of interest rule. it does not apply to the board of supervisors, -- or members thereof. >> i think what is cited in the memo is the conflict of interest involving monetary gain. this would apply to -- member of -- members of the board of supervisors. i can quote it for you if you i can quote it for you if you want.

supervisor daly: perhaps it has to do with what supervisor dufty said in terms of wanting to allow a round of voting to see where the votes are after having expressed support for multiple candidates. if you look at the voting with supervisor dufty voting against his preferred candidate, no other candidate received more than 4 votes. i would recommend giving supervisor dufty another round before we reopen nominations as a think the intent of giving everybody the opportunity to vote before locking in the first nomination makes the most sense in terms of going forward. i don't know how many rounds before everybody had enough opportunities to vote for the return candidates. i voted for three. people have different strategies, but at some point, i would assume that supervisor dufty or maxwell will cast an aye vote. supervisor campos: i also want to join supervisor daly in asking that we vote in another round. i think that is consistent with the statements made and we have an opportunity to make a decision right now. my hope is that we can come together and make a decision that makes sense

supervisor dufty: i just wanted to reiterate that based on no doubt of the way he has conducted himself, mr. johns is going to do a great job. i feel very strongly that richard would be an excellent commissioner in this role and be a dynamic historian, providing a law of personal talent to the work in the preservation commission. i do recognize the presence of the action of other nominees and i respect that it appears at this point that that is what might happen in terms of this nomination continuing. supervisor campos: great. yes, just wanted to fill -- the clerk has given me a note to make it clear that the agenda items one through six contain the same clerical error. they should read historic preservation commission, not historical preservation commission. wanted to make tax address. -- i wanted to make that address. i see the point that has been raised and the point raised by supervisor duftymar. that said, even though my reading of the language is that though there may be different -- differences of opinion, i do think that this individual meets the qualifications as written. and i
