durbin: but i want to make one other point as well. whenever i talk about wall street banks and the credit card companies and the costs associated with debit card fees charged to american consumers and retailers, the first thing that i hear is, oh, there he goes again, just defending wal-mart. well, there's no question about it, wal-mart is the largest retailer in america when it comes to the use of credit and debit cards. i'm certain that they have a larger volume of sales from that than any other. but let's do some comparison here for a moment. according to forbes.com, in 2010, wal-mart, the largest retailer in america, had had $17 billion in profits -- i ask unanimous consent for two additional minutes. the presiding officer: without objection. mr. durbin: for $17 billion in profits and a 4% profit margin. that sounds like a lot, and it is, but not compared to the big banks. j.p. morgan chase, one of the largest issuers of debit cards, had $17.4 billion in profits -- that's more than wal-mart, incidentally -- and their profit margin

durbin: be happy to. mr. nelson: is it true that in the proposal from the chairman in the house of representatives, that he would take the medicaid program, which genuinely is -- gel rally is a -- generally a split for health care for the poor and the disabled, that his proposal is that he would give this as a block grant to the states for the governors and state legislatures to decide how they were going to distribute it? mr. durbin: yes, i'd say to the senator from florida, that's my understanding. but it also includes a 28% reduction in the amount of money that the federal government's going to pay into this. so in your state, and mine too, a lot of elderly people live in nursing homes an depend on medicare. without medicare and medicaid, they couldn't stay there. if you cut by 28% the reimbursement under medicaid, i wonder what's going to happen to those people. mr. nelson: and would the senator believe that the experience of the state of florida, when they have tried to put all medicaid into insurance co

i think i vote senator durbin in this book saying frankly they own the place. and they owned it before the crisis, and they owned it after the crisis. and so -- if you think about it -- you remember it was a long time ago that the media were paying attention to the writing of the rules of the financial regulation bill. it was many, many months ago. those rules are very, very broadly written. they need to be defined as to what actual practices are allowed and what practices aren't allowed. because particularly in financial business, you can do what you want by changing a few of the accounting practices and doing what you were doing. you could change the name and move one guy into a different division and the whole problem is taken care of. there's about -- i think 1200 different rules. i kept pulling the number out of the air. the actual number is in the book. there's 1200 different rules that have to be written on the basis of the legislation. those rules are all being written by the lobbyist today. there's nobody else there. the press has moved on. and the sta

i want to go back to the question that senator durbin was pursuing. should federal laws be enhanced to provide more effective tools for federal enforcement? if so, in what areas? >> and feel like we have an ample number of tools right now. we're using them in a very robust fashion. the biggest challenge is always to make sure you have the budget to carry out the laws. i really appreciated the leadership of the president and the senate and the house in enabling us to get additional resources in the fiscal year 2010 budget. with those additional resources, that was the line just issuance of resources in our division's history. we're able to expand the work in this and other critical areas so that we could, again, do the work. we see this headwind of intolerance rearing its ugly head in a zoning context. we had a case in the suburb of chicago. the education setting, that is one of the two or three of the comments that i get when i do not reach. it is about bullying in schools. if you are in a learning environment where you cannot learn for whatever reaso

durbin was here in the house, shoeman was here, harry reid was here. they saw what happened the last time around there was a government shut down. and they saw how it was blamed on republicans and how craftily you said bill clinton used it to his advantage. frankly they've been, you know, in some ways angling for that, at least preparing for the fact if there is a government shut down, this is something that will show the republicans to be in their view who they really are. out there on the extreme. but you know, for a lot of the rank and file, these new fire brand conservatives in the house, they were not here. they don't want a government shut down but they don't have that fear that you can almost hear when you talk to john boehner about it. >> >> charlie: also the cuts are cardinal principle for them in terms of whatever bonds they have for their constituents and the fact they believe this is the idea that they wrote to power on. >> this is the very principle that got them elected, that brought that republican majority. and you know, gerry mentioned

durbin can filibuster. we did not freeze at the higher level. we brought it to where republicans wanted it. the president wanted to add $40 billion to where we were. we went $40 billion below that. that was not a compromise. the president lost. the democrats lost the direction they wanted to go in. the republicans compromised. they did not get as much as they wanted, but it moved in their direction. that is what you are looking for. if taxes are going up, republicans are losing. if taxes are going down, democrats are losing. spending is going up, republicans are losing. there is real conflict there. this is why the president and senate chickened out in his last fight. in 2012, 23 democrats are up for reelection. half of them are in red states. conrad is leaving from north dakota. in virginia, the democrat, webb, is not running again. it is likely to go republican as a red state. in florida, nelson. it is a moderate state with a left-wing voting record. republicans will likely pick up the 23 democrats up for reelection. half of them are vulnerabl
