eamon javers joins us live from washington with the latest >> good morning.ariffs are now just over five hours old the president made the announcement yesterday through his commerce secretary, wilbur ross, who is the person who put out the details here on those steel and aluminum tariffs going into effect on some of the united states closest allies citing national security concerns, that's canada, mexico and the european union the president did not address this publicly. the white house did release a statement on paper from the president explaining his decision here's what they said. he said the united states has been taken advantage of for many decades on trade those days are over. earlier today this message was conveyed to justin trudeau, the united states will agree to a fair deal or there will be no deal at all. speaker of the house paul ryan, the president's fellow republican issuing this statement disagreeing with the decision by the administration saying i disagree with this decision instead of addressing the real problems in the international trade of

eamon javers is in washington today. >> reporter: clarification from the state department on iranianrs. this has been important to the markets this week. let me walk you through exactly what they're saying. earlier in the week, a high-level state department official had suggested as part of the overall push by the united states to take iranian oil out of the global oil market there might not be any waivers issued by the united states to allies to allow them to import iranian oil. earlier this week, i would be hesitant to say zero waivers ever i think the previous position would be no, we're not granting waivers. that statement provoked a lot of head scratching in the market. a lot of oil market experts suggested that taking all iranian oil out of the global market could cause prices to spike here at home ahead of the mid term elections they assumed that was something that they would not want to do this, from a state department officer official just now saying we are prepared to work with countries that are reducing their imports on a case-by-case basis. we are serious about their eff

trump planning to make his mark on the supreme court with a second pick in less than 18 months eamon javers has more on that big news eamon? >> anthony kennedy, so often the swing vote on the supreme court, may now swing the supreme court fundamentally for decades with his retirement opening up an opportunity for president trump to nominate his second justice to the supreme court this justice was appointed by ronald reagan in the 1980s. a conservative, but also voted with the liberal wing at times he had the label of swing voter, which kennedy himself didn't appreciate he saw himself consistent over the years on the constitution. this is an opportunity for president trump. he was talking last night about how long he thinks his court with influence jurisprudence in the country. >> we have a pick coming up. we have to pick one. we have to pick somebody who will be there for 40 years, 45 years. >> over the next couple of months it will be an enormous fight in washington, d.c mitch mcconnell saying he hopes to have a vote on the president's nominee by the fall. presumably before the midterm ele

eamon javers joins us with more. eamon? a lot of us by surprise we were at the supreme court this morning for the janice versus afscme ruling which was that blow to unions. the decision from the supreme court siding with mark janice, the plaintiff in that case who said he didn't want to pay union dues as a municipal employee even though afscme was allowed to collect them from non-union members who were employees there. the supreme courts now saying that ultimate public employee unions will not have the ability to collect dues from non-union members. that is seen as a blow to unions across the country meanwhile after that announcement came out, the supreme court gave some indication there might be some news we stood by for news they said it's just retirement of staffers. no justices retiring today that's the news we got then hours later anthony kennedy did announce as a justice he would be retiring from the supreme court. it's a huge political opportunity now for president donald trump the president will have the opportunity

back to eamon javers >> the municipal employees unior not those unions can collect mandatory dues evens who are not members of that union mark janus is an illinois state employee, not a member of ask me, objected to the idea that ask me was collecting dues from his paycheck on a weekly and monthly basis. so he brought the case to court. the court here deciding ultimately that mark janus is right and the previous supreme court precedent will be overturned now that precedent had allowed those municipal employee unions to collect those -- what are called agency shop agreement fees here's what the court is saying here we conclude that public sector agency shop agreements violate the first amendment and abo abood errein concluding otherwise. it is reversed and the case is remanded for fther proceedin consistent with this opinion so that means a 1977 supreme court case that allowed those public sector ns to llect those dues from nonunion members en overturned by the supreme court. this is a loss for unions and a big win for people like mark janus who decided they didn't want to participate i

eamon javers outside the court again. >> it's written by chief justice roberts and looks like they'reothy carpenter, the petitioner who is working in this case against the united states government. this was a case where carpenter was involved in analleged robbery. the united states government prosecutors were able to get cell phone records based on going to the cell phone company. and the question is whether that violates the forth amendment to do it without the warrant. it appears in going through this case very quickly that the government here, the supreme court here, is siding with carpenter here they're saying we decline to grant the state unrestricted access in light of the deeply revealing nature of that its depth, breadth and inescapab inescapable. the fact it's gathered by a third party does not make it any less deserving of fourth amendment protection it was a search under that amendment. they're reversing a judgment of the court of appeals here and remanding the case, carl a win here for the fourth amendment. purists who say that cell phone data should be protected by the fo

eamon javers joins us. >> 18 state attorneys general filed a lawsuit against trump administration's policyf separating families of certain illegally immigrants at the border the 18 states attorney generals says even though the president reversed himself on that executive order last week and issued a new executive order, ultimately, they say, that nothing to take care of mandatory reyun p aunification e families the bill said there's so many loopholes it's essentially meaningless. a 18 states, a roster of blue state for the most part, participating in this, washington, massachusetts, california, delaware, iowa, illinois, maryland, minnesota, new jersey, and on and on, but you get the sense here that some of the big attorneys general would like permanent legal resolution to the situation which is really on hold right now. it's up to a federal judge to rule on blornt the 2-- whether o the holding period will be elimina eliminated, but the president said he will do his utmost to ensure families kept together during that period of time >> iranonic it comes out on the day of the travel ban. same

and eamon javers joins us with the details. >> reporter: a new indictment here from the special counsel'se this is a superseding indictment, and what that means is that the special counsel is adding either new allegations, new charges, or new defendants to a preceding indictment that had already taken place. we know that paul manafort had been indicted previously this is a 32-page document that's been filed by the special counsel's office in the courts we're going to go through it and bring you some of the additional charges, but one of the ones that i wanted to highlight for you is count six here, obstruction of justice the special counsel's office is saying that defendants paul manafort and constantine knowingly and intentionally attempted to corruptly persuade another person with attempt to influence, delay, and prevent the testimony of any person in an official proceeding and that's been one of the questions we've seen this week is did paul manafort reach out to potential witnesses in this case, communicating with them by encrypted device cnbc.com reported this week that the special c

eamon javers joins us from washington with the details on this latest move >> the president announced this yesterday. he made the decision with his advisers yesterday, he put out an e-mail last night with the president's statement. the president explained about the previous round of tariffs and the chinese retaliation. he said he didn't like that. he said therefore today i directed the united states trade representative to identify 2$200 billion worth of chinese goods for additional tariffs at a rate of 10% after the legal process is complete these tariff also go into effect if the chinese don't change their practices and to forward with their new tartarif. if china increases its tariffs yet again, we will meet that action by pursuing additional tariffs on another 2$200 billion of goods the president is thinking and his advisers are thinking that they had no choice after the latest round of chinese retaliation to go forward with these tariffs. they also feel it's not that big of a deal for the u.s. economy they have cited in the past the $19 trillion size of the u.s. economy versus th
