that was the lack of a blood test done on eddie ray routh after he was taken into custody. if you're watching this closely, they've been saying eddie ray routh was in a voluntary drug-induced psychosis that caused him to kill chris kyle and chad littlefield. that does not rise to insanity. if he was under the influence of drugs, why didn't they take a blood test? >> that's a key point. because the prosecutors, as you said, have continued to maintain that he smoked marijuana in a marijuana-induced psychosis. did his defense attorney seem to score points with the jury about questioning the fact that this test hadn't taken place, no drug test was done? >> reporter: i think that's the million dollar question in this situation. they fully acknowledge that the morning of the killings that he had smoked some marijuana drank some vodka and whiskey. by the time the murder took place, any effects would have worn off by then. that's the question, the jury doesn't have a firm answer to. the prosecutors hammered away for the last two weeks that he was a heavy drug user alcohol abuse and

who had testified about these boxes with drug paraphernalia that was found inside the home of eddie ray routhapping into the theme that prosecutors have been pushing, that it was recreational drug abuse for eddie ray routh that led him to commit these murders more so than these mental health issues. but in part of that testimony on friday, the detective held up various glass pipes in a vial containing a clear unknown liquid. part of that testimony included that detective saying a lot of this paraphernalia was consistent with meth use. then we learned today that those vials that had that clear liquid was actually not anything that eddie ray routh owned, that it was put in place there at the crime lab when the forensic chemists were doing their testings, those vials were put in by the lab technician and brought in and shown to the jury. this really set off the defense team. they asked for a mistrial, they asked for the texas ranger to be charged with perjury. the judge in the case denied both of those motions. but the prosecution basically had to turn around to this jury today and explain that
