abc 7 news reporter elissa harrington is live and the mayor just wrapped up a news conference. what did he say? >> reporter: well, the mayor says he's disappointed and outraged and defends the steps that the city is taking to discipline these officers. >> i think most people feel like that -- that, you know, it's -- that business has been taken care of. i mean, what else can you do, you know? you're not going to take people out and shoot them or something. >> reporter: these recommendations don't include any criminal charges, but the city does want at least one officer fired. the internal affairs investigation reviewed more than 10,000 text messages plus sound messages, social media pages and interviews with the young woman at the center of the investigation, jasmine abuslin who used to go by the name of celeste gaup. the city of richmond is looking to discipline nine police officers including one term nation, one demotion, two suspensions and five letters of reprimand. >> something like this is a breach of public trust and we have some rebuilding to do. >> reporter: city manag

abc 7 news reporter elissa harrington was at a federal appeals court this morning where attorneys made their case to the judges. >> the cell phone industry faced off against the city of berkeley and the ninth circuit court of appeals in san francisco tuesday morning. at issue the right to know ordinance. it requires cell phone companies in berkeley to warn customers about safety risks from the effects of radiation exposure. it the warrants putting phone in a pocket or directly against the skin for long periods of time and may exceed fcc guidelines. attorney theodore olson representing the ctia, the wireless association, argues the wording is misleading and intended to impact consumer behavior. >> the message that berkeley is conveying, it's an opinion. it is a message. it takes a point of view, and it suggests to you if you don't be careful you have an unsafe product. >> reporter: he says the fcc has found cell phones are safe, but lester lessig, the attorney for berkeley, says they have a right to let people know ways to prevent reaching high levels of exposure. >> cities like berkele
