i'm elizabeth cook. a judge was supposed to decide today if prosecutors in alameda could move forward with their case. after attorneys for the three officers charged in gonzalez's case asked for it to be dismissed but instead they decided to postpone that decision. the gonzalez family, their supporters, along with police reform advocates all rallied outside the alameda county courthouse ahead of today's hearing. defense attorneys say prosecutors missed a deadline to file charges after new da pamela price reversed the decision by her predecessor not to pursue charges but the officer's attorneys say she missed the three year statute of limitations. the judge will now decide if the case can move forward at a new hearing on october 11th. 26 year old mario gonzalez was unarmed when several alameda police officers pinned him to the ground while responding to calls of a man acting oddly near a park. body camera video shows gonzalez being laid on his stomach, hands cuffed behind his back for several minutes. at

good afternoon, i'm elizabeth cook. we are following some developing news out of oakland. the city's police department may be under federal supervision for longer than expected. i'm talking live with mayor xiang tao coming up. but first, much of the bay area is still dealing with a heat advisory today. taking a live look outside the hottest parts of the bay area have been sweltering in the triple digits for days now, and it may be a bit longer before things finally cool down. let's get to first alert meteorologist zoe mintz with more on that. zoe. >jessica>yes. today is the peak of the heat wave, though, so day three out of three, as i like to say. but tomorrow it is still going to be hot. that's why the heat advisory was extended, but it's not going to be as hot as we're feeling today with triple digit high temperatures all across the bay area. tomorrow will be in the upper 90s across our inland locations as we're going to see a lot of fog continuing to stream through our coastal communities. the fog is the sign of changing times as the heat is not going to last much long
