can you talk about the lawsuit and what ellen pao alleged? brad: you would be surprised how much sympathy and support that has been. i think people identify the fact that she found herself a woman in a man's world, the fact that she alleges that there was this forms of subconscious bias that she had to deal with, not being invited to parties, being asked to sit on the periphery of meetings. whether or not you believe that she should have won her case people identified with this. the numbers of diversity in silicon valley are really bad. a lot of sympathy and some fear. that companies of the venture capital firms are going to be held accountable for their gender diversity workforce, the way they treat women and minorities. overall, a lot of interest and some sympathy and identification with alan. alix: not just in silicon valley, here as well. there is -- it is ethical to prove motivation, especially when it comes to sexual discrimination. >> yes, although i have to point out that the kleiner defense team did an amazing job. they have some bad

ellen pao is a partner at one of the most well-known venture capital firms in the country, kleiner perkins, that is the company behind some of the biggest names in tech like amazon and google. pao is suing kleiner perkins for sex discrimination. the jury reading the verdict in the courtroom in san francisco right this very minute. there are no cameras in the courtroom, but we have a producer inside who will be able to tell us the verdict on the four counts as soon as we can report them from the courtroom. with us now two legal experts fox news legal analyst lis wiehl and mark conkel. jury deliberating 2 1/2 days. short period of time to me. what does that mean? >> usually good for the plaintiff. also in california, you don't have to have the unanimous decision, 9 out of 12 for the plaintiff or the defendant. so it's much easier than a criminal case. david: . gerri: mark to you, she originally sued for 16 million dollars, but the judge said no no no kleiner perkins may have to cough up far far more what are the numbers? >> 16 million in damages and 144 in punitive damages. so it's a really

now back to our special coverage of the ellen pao trial. it could have a dramatic impact on silicon valley's culture. cory johnson is outside the courthouse in san francisco. cory: this is a case everyone in silicon valley is watching. it is a case that may affect businesses all over the country. the jury is deliberating now behind me in the courthouse. it's look at the case and talk about what was resented. i'm joined by two experts. you have been following this case and listening to what they have to say on the stand. what do you make of it? >> it is a tough case. usually when you have a case litigated like this, it is a tough case. the fact that there is so much at stake on either side --ellen pao is risking her reputation and her career. kleiner perkins is risking the trials and tribulations that come with the pr and obviously the money. the fact they are going to the mat and doing it on trial shows it is not a clear-cut situation. cory: what do you make of what has been presented thus far? which direction do you think the jury might be

they did not feel that ellen pao was the right person to represent those. she was an employee who had issues getting along with people, and in a unfortunate turn of a phrase she didn't have the genetic makeup to begin the analysis of investment capital, and the pao team said that it was a moment of clairity, but te company said that it was simply shorthand for this woman was not cut out for this role. >> and clearly the jury did not see it from her eyes. i want to bring in dan from this point, because dan, over at "fortune" you have written about kleiner perkins, and you have reported before she filed the char charges that ellen pao would be fired from kleiner perkins, and now how is this going to be affecting the firm -- >> well, i reported that she would be leaving and not fired. but the reputation has been extraordinarily damaged in this, and candidly, it was surprising that they could not reach a settlement, and in the retrospect, it would have worked out better for both sides, ellen would have gotten some money, and kleiner would have not take zone muc

ellen pao is suing kleiner perkins for gender discrimination.he claims the firm refused to promote her when she worked there because she is a woman. kleiner perkins contends powell did not have the right skills to move up the ladder. the case is happening at a time when the tech industry is facing more scrutiny for its lack of diversity. liz gaines, a reporter for recode, has been in the courtroom all week and joins us now. hi, liz. >> hi. >>. >> this seems like a tantalizing novelful sex point, and power. what are the revelation that's came out in court this week? >> yeah, we've just been waiting for the drugs and rock and roll to come out. no, the biggest revelation was for people who have been following the case was a new witness, and that was trey vasolo, a former kleiner perkins partner who testified she was also harassed by a former partner as well named ajit nasre who is the same person that ellen pao says pressured her into having an affair. and another thing that's really been at issue and i think will continue to be an issue in this mo

charge and it is looking like it is not clear cut case, but so far, it is not going in the way of ellen pao. >> and that is right unfortunately for miss pao, and she has lost on three of the claims. the jury has reach ed a verdict on three of the claims, and no discrimination and promotion or termination due to the gender, and no retaliation regarding the failure to promote, and jury apparently found that kleiner perkins took reasonable steps to prevent gender discrimination against her, but the jury has pumped, and not reached a verdict on the fourth claim which is retaliation regarding the termination after she filed the complaint, and did other things that were protected activi activity. >> and this is the wheelhouse, and you have done these cases before as a civil lawyer, and gender discrimination, and how difficult was this one for the jur jury? >> i think it is a difficult case, because they have to find the reasonable evidence, and with respect to three counts they have not found it. and in this case, miss pao was extremely courageous to coming forward and she has brought attention t

they wanted readback from a 60-day performance plan they put ellen pao on. also wanted readback from a senior partner who testified here. and he said something very important for the jury that pao didn't have the right, quote, genetic makeup to be a venture capitalist and asked for readback from john door, the head of kleiner perkins. just about 15 minutes ago, we received word they're going to read the verdict that this jury has been deliberating for 2 1/2 days. it's made up of 6 men and 6 women, kind of a cross-section of artists, there's an artist on the jury, a prison nurse, a b.a.r.t. station manager, a female mid-level executive. so it's a cross-section of san francisco, if you will, and they have reached a verdict. they have to come up with -- they have to find four specific counts. two counts of discrimination, and two counts of retaliation by kleiner perkins against ms. pao. that i have to show in the seven page jury verdict form that kleiner perkins discriminated against pao based on her gender and have to show that cleiner perkines oo or agree on

ellen pao is in the house. crowd of onlookers in the house as well in a case that really has had silicon valley transfixed. pao got here just a short time ago. we can look at video of her from an earlier court appearance. she is a woman of many accomplishments, three ivy league degrees, joined kleiner perkins the preeminent silicon valley firm as a junior partner but complains she was not allowed to advance or progress the way her male colleagues were and this case, which has been going on for the better part of the last month or so, is likely to go to the jury today and this jury of six men, six women, has multiple questions to consider. did kleiner perkins discriminate against ellen pao, keep her out of meetings and gatherings and getaways and retaliate against her when she ended a consensual affair with a senior partner and filed this lawsuit in 2012. was the discrimination at the firm allowed to continue, not just against ellen pao but allegedly against other female associates and junior partners. what about

that is the amount that ellen pao wants her former employer kleiner perkins here in menlo park to pay in order to send a message to the venture capital industry. pao was clear and confident when she was under direct examination. but under cross-examination we are seeing a different ellen pao with a lot of i don't know and i don't remember. and observers say that has hurt her credibility with the jury. now, the defense has been hammering away trying to portray her as unqualified, argumentative and a resentful employee whose recollection of the events is riddled with inconsistencies. pao on the other hand has told stories of harassment and says she was ostracized after ending and a fair with a senior exec. she says she is suing the company for sexual discrimination and retaliation and the judge handed pao an important victory yesterday ruling that her personal money problems do not matter to the trial. the defense wanted to use pao's rocky financial situation to prove that was a motive behind the lawsuit. that information could have harmed pao's credibility within the financial industry

ellen pao must have seemed particularly aggrieved. jurors do not agree with the women plaintiffs, john. >> so in spite of this verdict is there expected to be any sort of change in hiring practices in silicon valley? >> well, john, you can well imagine that the hr departments in silicon valley tech companies and of course venture capital firms are rethinking their hiring policies and how they promote employees and to have that discussion with employees about gender discrimination. here is what one specialist in employment law had to say. >> every individual case can only do so much and the pace of progress has been very slow in this world. but whether it's the public works of a book like "lean in" which got a lot of attention in silicon valley or a kind of case like this with a large price tag associated with it, it's going to cause companies to take a hard he look. >> reporter: and i think it's really important to point out that regardless, there is gender imbalance in the numbers. on the engineering side 20% of engineers are women i

there has been suggestions that ellen pao herself would not settle.they were forced to go to trial. even so, but kleiner had 17 witnesses and went in and systematically dismantled key points in her testimony. including the fact that, you know, women were left out of the events, they had two very high-profile witnesses that said that just was not the case. the defense has done a good job of pulling apart pao's testimony. what will you will see tomorrow is both sides will sum up their strongest points. ellen's will talk about trey basalo who was sexually harassed at work. they are going to talk about other instances where she was left out of meetings are people -- where people did not appropriate to her complaints of discrimination in the workplace. about the fact that they did not have a policy around harassment that was readily available. that they could not find it when in investigator asked for it. these are the things they will hammer on. that it will go to the defense and kleiner's lawyers will say this is not true and they will reiterate statemen

the demise of a rising star the story today in ellen pao's sexual discrimination trial. she took the stand for a second day of testimony in her case against one of silicon valley's biggest capital venture firms. but today the testimony was pointed, and at times excruciating. nbc bay area's mark matthews is joining the trial and joins us from outside the courthouse in san francisco. mark? >> reporter: in the beginning, ellen pao was courted as a star at steiner perkins, but today we did hear about the fall as she described her confrontations with a senior partner. ellen pao began her second day of testimony talking about the company's investigation of her complaints of sexual harassment and discrimination and how fellow junior partner ajit nasrai had pressured her into a sexual relationship then retaliated against her when she broke it off. he was promoted to general partner at kleiner perkins, while pao was passed over. and how women at kleiner perkins were excluded from some gatherings including a dinner at al gore's apartment or subjected to locker room conversation ab

that is what the ellen pao case is about.hether she was treated differently than the male partners. cory: i want to get to the specifics of the case. i think that is why this resonates. here we are, two white dudes but that is kind of a common scene in silicon valley, where men far outnumber women, where white dudes and asian men outnumber women as well in the workplace. guest: when the case was filed it was before "lean in" and before tech company started releasing their dismal statistics showing less than 30% of their workforce was female. it is a world in which it is called out when you make calls. everything is very sensitive to all the things mentioned in the case. like where she sat at the table and whether she was told she had to take notes, even though she should have been at the same level as the men. that is really the thing people look at here and think, i have seen myself in that. i have talked to a lot of women in tech and i do not know what happened to ellen pao, but i do know that looks a little bit like me. co
