national security reporter zach cohen, also cnn legal analyst and former federal prosecutor elliott williamstake us through the reporting. what else do we know about this agreement? >> this was a surprise by powell, and every indication was that she was preparing to go see trial. she was not -- to go to trial. she was not into the plea deal or what was offered before. in the last 24 hours prosecutors and her defense attorneys got together to hash out the terms of something they could both live with. for powell it means pleading guilty to misdemeanors. she was facing a felony, a major felony that called for prison. now she's pleading to much less serious charges. one of the cool things, unique things, is there's cameras in the courtroom. we've been surprised hearing today -- >> cool for us. >> everyone gets to see it. let's look at when the judge walked through the terms today. >> do you understand that the recommendation being made to the court as to this accusation on counts one through six that you be sentenced to 12 months of probation to run consecutive one another? >> i do. >> do you un

and i want to talk to a couple legal experts about all this, elliott williams and also joey jackson.oey, i'll start with you up in new york. it wasn't just a social media post from the former president. he also in one of his long rants standing in front of the cameras at that courthouse on monday talked about this unsub unsubstantiated allegation about the judge's clerk. let's listen. >> i hope my lawyers go in and i hope that they fight him very hard. because this guy is getting away with murder. and his clerk should not be allowed to be in his ear on every single question. you take a look at what is happening with her. she hates trump more than he does. >> again, there is no evidence to pack up back up what he is d the judge clearly upset so he imposed the gag order. >> yeah, it is problematic for the following reason. what you say obviously has consequences and what you say when you are the former president of the united states running for president and have a following like that has consequences as well. and so we're talking about threats and danger to the public, potentially, by

williams. i want to start with you, elliott, something that alina habba said in the opening statement, with letitiaes in the room, she went after the a.g., saying she was going to get trump. described him as an illegitimate president. the judge, though, essentially tossing that aside. why? >> for the most part, the attorneys can say what they want in court here because there's no jury in the room. often rules in court are made for the protection of not putting evidence in front of a jury. ful she makes bad arguments to the judge, the only audience she is going to lose is the judge right there because he's the one ultimately making the ruling or decision here. so, i think he's a big boy and can take some of the attacks coming in. it really would be a different calculus if there's a jury in the room, because arguments like that risk painting the trial. >> and then criticizing the judge saying he's a rogue judge. very unique strategy to get into court late, because you're outside criticizing the person that's going to decide, right? >> like "dodge ball" don't move, cotton. we'll see how it works out f
