i'm also coming as a citizen of san francisco who is an ellis act eviction ~ in the middle of an ellisct eviction. i'd like to thank you all for your leadership. i'd like to thank supervisor jane kim and everybody else that signed onto the mid-market work supervisor chiu is doing to help augment their budgets, many very lifesaving nonprofits are in the area and they need the support and really appreciate t. there needs to be more support as you can see the city needs more services every day. as a member of the growing group of residents in the middle of ellis act evictions, i will say that i'll keep my comments brief today, but i'm hoping that you can hear from somebody that was with us last time we were here who was afraid that she was going to be ellis acted and she has been. she was in the mission, very active in her community, helps to run the mission community garden and, so, they've added 8 more families to the rolls of those who are involved in ellis act eviction. so, i'm hoping that you'll be able to hear from her today. this resolution i know is coming up this afternoon. i thi

the ellis act has been used by new owners who purchase the building of evoking the ellis act for their own reasons. we have seen trends where they are buying the rental units and then changing them. we also know that speculators who have used the ellis act to evict tenants and those most vulnerable of our city. given the fact that we do not have time to wait for ellis act evictions to take place before establishing more local control that we need do everything we can to stem the tie of speculative evictions. this calls for our may and -- mayor and board of supervisors to restrict ellis act evictions to restrain the ellis act evictions and disrupting our efforts to grow according to our general plan and our neighborhood plans. so colleagues, we ask for your support with this resolution to support changes within our state legislature to return more local control to our local municipalities to stop speculative ellis act evictions. second item i have is to request a hearing in early next year in chapter 14b of the administrative code t local business enterprise. this is timing for several

it would replace an ellis act emergency program. you approved it on november 21st, this would give priority for housing projects to those individuals who received an ellis act eviction. the board did incorporate the recommendations of this commission which was to include a requirement for a hearing at the board 3 years after mremgsz of this ordinance so the board could hear about demographic income levels of beneficiariesary in this preference. in addition the preference to disabled units for 5 years rather than the other general preference for those who are not disabled but live there for at least 10 years. with that amendment, this ordinance was passed. the last item at the full board were interim controls for certain building permits of this area of market street and south of market. this resolution would require for the 12-month period, that certain buildings that have commercial uses would be required to do a 15-day posting requirement describing the nature of the work that was expected and noticing the public that we believe t

the legislation also works to disincentive eyes or discourage no fault evictions ~ including ellis act evictions by disallowing mergers for 10 years after a no fault eviction for evictions that have occurred after currently october 24, 2013, but i hear that tate might change to today. the other piece of legislation deals with alterations for nonconforming housing units. these are legally existing units that are nonconforming because of code swollening laws. currently because the alterations of these units are prohibited but their removal is aloud, the current code incentivizes [speaker not understood] ~ with conforming units to create larger less affordable unit and taking housing stock off the market. this allows for alterations these nonconforming units so that the city can continue to ensure levels of affordable rent control housing stock. the ordinance includes safeguards to ensure that allowing alteration to these units won't have unintended could betionvctiontionv questionctiontionves that will reduce affordability or encourage displacement of tenants. this ordinance like the res

we know by every ellis act eviction are 2-3 by outs that are not being reported. the way these by outs report that in many cases you have landlords that intimidate people to agreeing to a buy out. most of the time agreeing to being paid a sum that is not going to enable them to stay in san francisco. the problem with the law today is that in the face of this harassment, the only recourse that is presentlily available to tenants is that they can go and file an action in california superior court. as ted of the san francisco tenants union indicated in order to file in superior court things to have get so bad that you as a tenant have to convince an attorney that you are actually suffering damages including perhaps medical damages, but for most tenants the ability to file something in court, san francisco superior court is not an option available to them. litigation is so costly and so expensive that it's really prohibitive. what this legislation does is it creates an intermediary cost of action at the rent force that if there is any harassment that the matter can be

we know the ellis act there are tenants being played by buy out that are not reported. you i've heard in talking about those buy outs i've heard from the constituents that their has been a significant increase in harassment faced by tenants. we've heard any stories of landlords calling tenants at work and the tenant is getting in trouble with their employer. beef harder allocations of landlords locking tenants out of their pavements and performing loud construction projects for the purpose of harassing the tenant not for the purpose of doing the work. we have heard from a number of tenants that keep getting calls from the landlord to, you know, intimidated them and push them to accept a buy out and we've seen examples and heard from individuals where the landowners have called and offered to buy them out so the tenant is a vacant the unit. we've seen the hear me out is increasing and we're seeing that reported drishlg directly from organization the tenant unions and other the main recourse the tenant can file a civil litigation matter in california supreme court and we
