supervisor elsbernd: the situation as they retired years ago. they show to retire, and lo and behold, they had no idea when they left city service -- they are not going to get that when fall -- windfall? >> this is true. this is particularly in the area of the pending coverage. supervisor elsbernd: the changes we need to adopt today. >> by way of disclosure. i have already mentioned the so- called best thing retirement, which i think is the most significant. -- vesting retirement. they had 50,100 thousand control points, and we believed those would go up. not to exceed 3.5% a year, but to accord with the cost of living. it has roughly tracked what has happened with wages. these are affected distinctions that now exist. we also reject is so it -- i am trying to find some that are not corrections'. we deleted some language that we determined was not necessary, regarding medicare and retiree health-care. we believe that was an option to deal with those in light of health care reform. the proposed bargaining units would only become members of the re

supervisor elsbernd: use me as an example. next year, i will be a city employee, i will have worked for the city for 12 years, and i will be 36. >> he has not achieved age 50 or 60, therefore you do have the option to have what we call a vested retirement. it is really an annuity. they calculate the employee contribution. the city had made the contribution in some cases through collective bargaining for part-time, as i think in your case. that is doubled, and that becomes an annuity you can take out the bank that is an unusually rich benefit. supervisor elsbernd: does anybody else have that in a public agency? >> nobody else that we know of in a public agency. there are legitimate concerns as far as people who may not have an opportunity to get a career benefit through no fault of their run. we initially put in a deferred service retirement. it would allow you to start drawing at age 60. that would not achieve the economies we had hoped for, so we had agreed with our labor partners to an amendment that would be a half match. i

supervisor elsbernd: thank you. >> good afternoon, supervisors. i'm here on behalf of the executive benefits. i would like to talk about the changes made in the board. prior to the election, the makeup of the board was four appointed and reelected, but the vote was always the same. you needed a supermajority. they always maintained the balance. they always had to have a person on the other side. the vote is a totally taken over by the city, which to me is very dangerous. there are things that of happen in the for the past few years, especially with the insurance companies. as you know, the insurance companies said the raids. unfortunately, some insurance companies donate a ton of money to other city programs. we have an incident where there is an interference from the mayor's office to our director who was trying to negotiate rates down from one of the insurance companies, and he was asked to keep the insurance company in, because of, in short, -- ia am sure, because of the benefits. i do not think there will be che

supervisor elsbernd: i thought u.s. your standard question which is appropriate -- why this commission? why this one? >> i have not applied, have served before on the advisory committee for several years. i served on that committee for the same reason applying to this one. i really believe it is important to be involved in issues that affect people city-wide. i feel for districting is a very important issue that will have the impact in years to come and one that i think is very important to be able to have a clear voice on. as someone from an immigrant family and as someone who grew up working class and as someone who is now a city employee and living in san francisco, i feel all those issues are ones we need to look at what we look redistricting in terms of looking out for all of those populations as well. i do not have plans to run for any future office. i have no plans on running in the future. supervisor kim: you mentioned that he lived in the mission and a sunset which are two very different parts of the city. can

i do want to agree with most of what supervisor elsbernd said. i do think it is important a eighth to have development on the west side. -- important to have development on the west side. but the question remains -- are the tenant protection sufficient? i would respectfully submit that they are not. supervisor avalos: i want to thank supervisor elsbernd for his work on this over the years, and the developers as well as the tenants for their hard work on this project. i have similar concerns about the guarantees tenants are receiving in this development agreement. i don't feel that i can support this development agreement, even -- i just feel a difference between what supervisor campos has talked about, between trinity plaza and parkmerced, is significant. trinity plaza was owned by one person. parkmerced is owned by many people. any one person who is part of that ownership who wants to back out could perhaps limit an agreement that could protect tenants. i also want to add another amendment to the legislation, if colleagues are willing to conside

supervisor elsbernd. supervisor elsbernd: i have been relatively quiet on this. it is likely to move out of committee, so i wanted to share my thoughts. i think what happened tuesday afternoon is exactly what this charter amendment is necessary. three ballot measures were placed on the ballot at the very last minute, but four members of the board of supervisors. and i think in the last 48 hours, we have seen that those ballot measures were written rather hastily. there is all kinds of unintended consequences. this charter amendment fixes that problem. it frankly gives a bit of a lifeline to those four supervisors into a major, if they ever do something like this again. so i think what has happened in the last week is perfect evidence for the necessity of this charter amendment, and i would like to congratulate supervisor wiener with moving forward with this good government reform. supervisor kim: thank you. at this time, i would like to open it up for public comment. >> sue hester. i did not speak at the last meeting because i wanted to read the language. i think

supervisor elsbernd: ok. supervisor kim: any other questions? one of the things i see in your background in working on demographics and numbers, could you talk about that? >> i was involved specifically in the redistricting process, not intimately in san francisco, but in berkeley, 10 years ago. i moved to san francisco and was part of the political community in berkeley when we went through the redistricting process back then. it was a painstaking process where the map was drawn and the council approved the map and then folks who were not happy got a referendum and got it removed. we had to go back from scratch. i very carefully study does and making sure the various communities were being heard and considered fairly. as far as san francisco, i'm also on the board of the tenderloin north of market committee benefit association. that brings all stakeholders of business owners and residents and that is going to involve studying the demographics of that micra community to make sure that goes fairly. supervisor kim: principles or values you would p

supervisor elsbernd: a couple things. i want to respond to supervisor avalos, but first to supervisor campos. thank you for the intellectual honesty in saying you would have opposed the trinity project. that surprised me. i apologize for my reaction. i hope you will continue to vote against any projects that approve below-market units. the legal argument you are making to argue this legal agreement is invalid is the same one you should be making to all other projects, based on the city attorney's opinion. it was the exact same costa- hawkins question. not only is it comparable to trinity. it is comparable to any other project anywhere in san francisco that includes bmr units. you were sent to an -- you are saying to any tenant in those units that it is legally questionable. i hope you continue forward with any other project that includes one bmr unit or thousands. it is the same law. to supervisor avalos, i assume you know the value of the rent control subsidies already offered is $160 million. i am betting you do not kno
