a bomb threat to judge arthur engoron's homer. his actual, real home, because it's not hard to find peoples addresses on the 21st century. a threat that delayed the trial this morning because they had to do sweeps and add extra layers of security because someone had called a bomb threat to the judges home. we don't know all the particulars. we don't know who did it. but it appears to be the latest example of mob style intimidation by pro trump maga loyalists that has become disturbingly common. just a part of day-to-day life in the trump era. oh, bomb threat. yeah. delay a little bit. remember, when this trial began last fall, judge engoron had to slap a gag order on trump after the former president baselessly smeared a court officer on social media, saying she was a political operative, including a photo of her in the post. she and the judge were subsequently flooded with threats. not just threats, antisemitic slurs. and harassing voice mail. she reportedly got 30 threatening calls a day on herself phone, her personal cell phone.

since judge engoron already issued a finding of fraud against trump before the trial started, what'spending decision? >> i think there is the question of the damages that will be assessed here, whether donald trump will have to pay $370 million that laetitia james is requesting. whether he and his sons will continue to be able to do business in new york state. and at, bottom it's really the reputation, the brand as it were. donald trump has made his name saying that he was a business genius. that real estate mogul here in new york, and it turns, out that at least this court of law believes it was done on a fraudulent basis. that perhaps could have some consequences. certainly, some reputational damage down the road. i think that's why we're seeing all of this activity on social media. insisting that, in fact, the brand is sound. that all of this is an over exaggerated persecution from liberals. >> i learned something interesting in the e. jean carroll case. and that is the 83. 3 million dollar judgment. he's gotta put that into some kind of bond. he needs to take a bond out on that.

and so, i don't suspect that engoron is going to go that far.lly expect and anticipate that the financial penalties that he levies are going to be very, very heavy. >> i mean, catherine, the associated press analysis, it points out that if trump gets that penalty, it would be the only instance where a business loses without a showing of obvious victims and major losses. charles doesn't think that judge is gonna go that far. what say you? >> i agree, and the attorney general, the new york state attorney general is requesting that donald trump and his sons the prohibited from ever doing business in new york again. and of course, they're asking for that 300 and $70 million discouragement, to pay back the unjust benefits. and also, remember, there is an appellate court that will be looking at this. so, if the judge does do the death penalty, the appellate court would be looking at that and will know about the other cases beforehand. but we will see. the judge said that it would be this week, probably wednesday. so, we will see if that will happen. h

every day judge engoron is thinking about the appeal in this case. as we've seen all these other cases play out, this case will be appealed. he wants to make a pristine record for review. closing arguments are not evidence. however, he's making very specific rulings here with the knowledge that those rulings are going to be reviewed on appeal and that the record is going to be -- >> the fact checking of the record is important. >> it absolutely is. speaking of fact checks, the presence or absence of a jury makes all the difference in the world. when we have a jury in criminal cases, and they all will be jury trials, judges and courts have to be more careful about policing what's said. trump's lawyer led off the presentation by saying it's a political vendetta. there may be truth in that, but it's not a proper argument in court. if it's the judge deciding, as here, the judge can filter it out. irrelevant. not considering it. when you have 12 civilians, 12 new yorkers sitting there, the judge will have to be more careful. there are consequences as a la
