. >> i am eric thomas. marin county going to have trouble forcing the ban on smart meters the supervisors passed last week and that comes from the county sheriff. live in san rafael to explain why he's saying these things. >> eric, sheriff is telling the independent journal he's not going to force the ban. he doesn't think the moratorium is enforceable. the smart meters make a lot of the residents nervous because they're worried about the amount of radio frequency admitted by the meters. pg&e insists that they are safe. the controversy is intense in marin county. there's video on youtube.com showing two women being arrested as they try to prevent the meters from being installed. last week the marin county board of supervisors voted on a moratorium on the installation of smart meters. here's a sample of the feedback they received before the vote. >> what the health effects are really going to be. >> to come on my property and arbitrarily install a dangerous device without my permission. >> the sheriff in mar

i'm eric thomas.hat's kristen sze it police are investigating a fatal shooting that occurred last night. the victim was found near 16th and center streets just before 10:00. emergency crews administered cpr but the victim died at the scene. police went door to door hoping to locate witnesses. no suspect and no motive. that comes on the heels of tuesday night's shooting that left six injured, including an innocent bystander. this happened on 89th avenue. people in homes were watching tv or doing homework when bullets pierced their walls. two were found at the scene. the other victims were driven to the hospital. they suspect the shooting was gang-related. no arrests have been made. >> people who donated $400,000 are angry that the victims haven't received any money four months later. last night two council members heard the concerns and tuesday the full city council will meet and decide how to district that money. amy reports. >> it was clear to the officials underestimated how many people care about t

i'm eric thomas. >> i'm kristen. our top story a long wait finally over for survivor's of san bruno explosion and fire. handing out hundreds of thousands in donations made to the survivors' fund. >> victims can come here to city hall at 8 a.m. when it opens to get their check. there's no need to rushing. the money is here. it's decided who's going to get what. it's here at their convenience. here's how it's going to break down. the city has $395,000 to hand out. of the 38 homeowners whose homes were totally destroyed, they will get $6,000. 17 homeowners had what's considered moderate damage and they'll get $4,000. and 45 homeowners had minor damage and they'll each receive $1,000. now, the vice-mayor explained at a meeting a couple weeks ago why the city waited four months to hand the money out. >> we really weren't aware of any definitive need. we were under the ashum hon at least pg&e and red cross and the other agencies were filling some of these needs. >> when they found out at a public hearing that the victims h

i'm eric thomas. >> i'm kristen sze. topping out news, it appears we know who will be the next police chief in the bay area's biggest city. that decision is creating some big questions in two bay area cities. jenelle wang joins us live to explain. >> it looks like san jose's acting police chief chris moore is in and oakland's police chief is out. chief anthony batts wanted the job but now that it appears he didn't get it, his future is in question. he said he had concerns about the support and resources in oakland. the city has cut the police force significantly because of budget issues and crime still seems to be out of hand. oakland's mayor though says she has faced that batts will stay but others question if his heart is still in oakland. they have not confirmed chris moore is the guy but will say they have picked the right person for the job. >> i know that i am bringing forward the best candidate for the city of san jose. >> this is a very broad, diverse community. the chief has to have the capacity to not just get
