closed captioning by closed captioning services,inc >>> good morning i'm eric thomas in for kristen sze. >>> and i'm cheryl jennings. investigation are are trying to find the cause of a fire that killed a woman and her two dogs this morning. katie marzullo is there with more. >> reporter: this is a fairly unusual scene for a house fire. if you look behind us, there's very little flame damage to the outside of this house. it was about 7:00 this morning that the 911 call came in. crews arrived within minutes and found spoke pouring out. they went in, not see flames but used thermal imaging to make their way through the smoke that is when they found the woman in a bedroom, again no flames, just smoke. she did not have a pulse. they tried to resuscitate her on scene she was taken to the hospital and pronounced dead. two dogs also found inside they also died in the fire. the chief tells me that maybe preliminarily that the fire started in the kitchen. they do not know the cause, but they do know what was not the cause. >> there was no christmas tree, no christmas decorations. the obvious ans

i'm eric thomas. >>> and i'm kristen sze. san jose police investigating a fatal shooting involving an officer overnight. amy hollyfield is live with what we know so far. >> reporter: san jose police worked quickly on this in the dark of the night they came out conducted a quick investigation, processed their scene this is where they told us it happened but they are no longer here. they aren't returning any of our calls. it did happen at 11:28 they put out a quick press release saying seaview and bermuda in east san jose the they attempted to contact adult man and he displayed threatening behavior. at least one police officer fired in self-defense and killed the man. officers in their press release did not say why they were trying to contact the man. >> if he was armed? and if so, with what? they did say he died. we asked a resident about what happened and he told us he didn't hear a thing. he didn't hear any gunshots or police officers. he didn't see anyone out here. this all isn't adding up at this point this is important. w

. >>> good morning i'm katie marzullo in for eric thomas. >>> and i'm kristen sze, nice to have you. occupy protesters are trying to reopen justin herman plaza this morning. a day after police tore down the two month encampment, the sometimes tense standoff continues. terry mcsweeney is there live. >> reporter: right now things are calm. a lot of police cars, but not a show of force as we saw last night. if you are looking behind me you can see some are still camping out down here not in the area where the tents were set up over on the fringe where there about tents they are just sleeping. we came down market street a short time ago in front of the federal reserve building we noticed two or three dozen protesters sleeping in front of the building. no tents there, but it looked like this encampment used to look. last night there was action down here. protesters wanted to set up a tent, symbolic, just one, in justin herman plaza they've been trying to do that all night. last night, a few hours ago, as they tried to do it, police said you can't have the tent there. protesters picked up

. >>> i'm eric thomas. doctors and family members in oakland have an agonizing life or death decision to make today and a medical test could be the dieding factor. the test will determine whether a ---year-old boy wounded in a shootout should be tan off live support. -- be taken off life support. >> reporter: this family faces a tough decision on whether or not they should take their one-year-old toddler off life support. a second test on the little boy later on this morning, that should determine if there is any brain activity at all. one-year-old hiram lawrence, jr. underwent a test already in which doctors say they concluded the boy is in fact brain dead. the family says they want a second test to make sure, before they make a final decision. this little boy was shot in the head in west oakland on november 28th. police say the boy and his father left a liquor store walked to a nearby parking lot, seven others were injured. police have five people in custody. they also have concerns that if and when this

i'm eric thomas. >>> and i'm kristen sze. a handful of occupy protesters are out at the port of oakland right now after they imagined to shutdown an overnight shift of port workers. amy hollyfield is live with the latest. >> reporter: they are very proud out here at what they've done. you can see behind me the group is starting to break up. some have decided to stay and celebrate. the group took a vote and decided everyone can do their own thing. if they needed to get rest and let the longshoremen come back at 7:00 this morning, that would be fine. they want to respect that the longshoremen need to make a living. they are very proud of the crowds they had, especially last night. there were so many people that the 7 p.m. shift was cancelled for safety reasons. between 100 and 200 longshoremen stayed home and truckers had to park and wait that created some frustration among some work hers who say they will lose money but not because they -- they couldn't work yesterday. protesters say they are making a statement for people like

. >>> good wednesday morning. 4 been 31 a.m., i'm eric thomas. >> and i'm kristen sze. the spotlight on sacramento focus on uc police and officials for the way they've handled occupy protests on campus. new development in the case of the oakland police officer who shot an occupied protester with a bean bag last month. katie marzullo is live with the latest. >> reporter: the occupy fallout is falling on two fronts. an oakland police officer and his supervisor have been removed from street duty over this incident which happened in the general strike in early november. in that video, you see an officer fire a bean bag, campbell was hit the leg. using bean bags in crowd control situations is allowed under police policy. policy says the officer can only act under the direction of a supervisor and the victim should be taken to the hospital that did not happen. internal affairs is investigating. campbell told the chronicle no one 23r9 police department has contacted him. -- officials students and police oversight experts will testify at a joint hearing in sacramento about nonv

. >> i'm eric thomas. cheryl jennings and kristen sze are off today. terry mcsweeney is live outside the federal courthouse that's the center of gravity today. >> reporter: just about an hour ago barry bonds ended the federal courthouse he's on the 19th floor in the judge's courtroom awaiting sentencing. take a look at the homerun king coming into court today, looked very relaxed. i asked him how he was feeling. he took a moment to say good morning to the throng of reporters. unlike the many times he entered for his trial this time he comes to court a convicted felon for obstructing justice for evasive answers. prosecutors want him to spend 15 months in prison within sentencing guidelines. defense attorneys want just probation. the federal probation officials want house arrest and community service. they may hold the day. i asked the man who wrote the book on barry bonds and steroid accusations, about the sentencing. >> i mean i think obviously it has been a long time coming. bonds testified more than eight years ago now. it has been quite a saga to ge

. >>> i'm eric thomas. first class mail could soon be a thing of the past. services reduced under a budget cutting plan the postal service is set to release today. katie marzullo is live with more on the story. this will be accompanied by job losses as well? >> reporter: oh yeah. it is bad. when the country springs for the postal service going to take a major step back. a lot of this is going to happen this coming march. at that time, they are looking to cut three billion dollars. that includes several different things. one, reducing the number of processing plants almost in half. closing 250 out of 500. first class mail is going to slow down. currently it is delivered between one and three days that will slow between two and three days which means, no next day mail, no chance of a letter arriving the next day. 3700 post offices are going to close. we have a map we have. a couple in northern california could be on that list, eureka, reading, pet marks burlingame, stockton and modesto. with those closures 100,000 -- employees would be laid off that would save
