i'm jessica dean in new york alongside erica hill this afternoon and topping our hour. a new concerning cdc report about bird flu here in the u.s. the virus appears to have mutated in an infected patient from louisiana, and that could possibly increase the chances of human to human transmission. that hospitalized patient is the first severe human case of bird flu in the country. cdc officials say the person likely became infected after having contact with sick or dead birds in a backyard flock. now, the cdc is also emphasizing there is no evidence here of human to human transmission. and they do say that the public risk of infection remains low. cnn medical correspondent meg tirrell is following this and has more details for us. so, meg, what does happen at this point? >> well hopefully nothing. you know what we've heard from the cdc about this? is that the good news is it appears the virus mutated in the patient while they were in the hospital past the time they were potentially infectious to other people. they haven't been shown to have spread the virus to any other p

i'm erica hill, along with danny freeman in new york. the suspect, who allegedly set a sleeping woman on fire on the new york subway. discharged from a hospital and has been arraigned. >> police say the man accused in the horrific burning death is a 33 year old undocumented immigrant from guatemala, knowing he was likely homeless and has been living in the u.s. illegally for years. cnn's gloria pazmino joins us now from new york. gloria, you have some new reporting on the suspect. please tell us what you're learning. >> yeah. danny. erica, we were just in the last few minutes, finally getting some confirmation that the suspect in this case has been arraigned. he was just presented in front of a judge in brooklyn criminal court. sebastian zapeta-calil 33 years old, accused of setting fire to a woman who was sleeping inside of a subway car on sunday. now he is facing three charges. i'm looking at the complaint. right now, he's facing murder in the first and second degree, as well as arson. now, this is been a little bit of a delay since su

i'm erica hill alongside jessica dean here in new york. so nice to be with you. investigators working now to determine what caused that deadly plane crash in kazakhstan. in the first, for the first time, we're actually hearing from one of the 29 people who were on board that plane and survived. you're looking at video of a survivor praying during the flight. he tells reuters. he heard a loud bang. then the plane started to behave, unnaturally. he didn't think he would survive, and his account could bolster one of the leading theories about what went wrong. >> azerbaijan airlines saying the plane experienced, quote, physical and technical external interference before it went down. a u.s. official previously said russian air defenses may have mistakenly targeted that plane. 38 people died in the crash. investigators have in the meantime, recovered the plane's second black box. cnn's nadia bashir is joining us now with more on this. so, nadia, the question now is how long before we know what's on the data recorders? and also what else are we hearing from that surviv

erica. >> it's really very difficult video to watch. new york's governor has now called for 14 workers there at the marcy correctional facility to be fired. new york's attorney general, letitia james, has opened an investigation into robert brooks death to try and find out what happened here. what led up to this? her office has reviewed the body cam videos, calling what she saw shocking. now we again want to caution viewers the video is terribly disturbing. we're going to show some of it to you now. the body cam video shows what happened on actually on december 9th. that's when robert brooks was transferred to the marcy correctional facility there in utica, new york. it's a medium security state prison. he was transferred from another facility and was taken into the examination room that you see there, carried into the examination room. he is restrained. he appears to be handcuffed behind his back. and then as he's there in the room, he's just randomly beaten by correctional officers over the course of several minutes. once he's there in the room

i'm erica hill, along with my colleague danny freeman in new york. nice to have you with us on this christmas eve. and we begin this hour with what could have been christmas eve chaos at airports across the country. american airlines says it was a technical issue which forced it to briefly ground all of its flights this morning. and of course, one of the busiest travel days of the year. >> now, the temporary shutdown sparking major concerns and delays for passengers desperately hoping to reach their destinations in time. cnn aviation correspondent pete muntean joins us now with more. pete, what can you tell us about what caused this grounding and really how it impacted travel? >> this morning we have new information on that. and american airlines says it's all hands on deck right now to get things back to normal. we now know that this was caused by an outage of a computer system. that is key to getting flights on their way and pushed back from the gate. american has about 3900 tuesday flights scheduled. the good news for the half million people trave

york. gloria, what more are you learning? >> yeah. danny. erica, we're getting more details because just a short while ago, the suspect in this case was actually arraigned. he appeared in front of a judge in brooklyn criminal court. and it was there that we got an opportunity to learn some of the details that were reported by the detective that initially investigated this incident. it happened early on sunday morning, and as we've been reporting, there was a man who now stands accused of murder in the first degree who approached a woman who was asleep inside of a subway car. he pulled a lighter out of his jacket pocket and lit her on fire. that woman died. now the suspect was in court. just a few, um, a few hours ago, and we got some additional detail, including what you mentioned at the beginning, that at one point they have video evidence showing that the suspect actually was fanning the flames by using a t shirt to fan the flames as the woman was becoming engulfed in fire. we've also learned that the victim's cause of death has been determined
