erika hill joins us with more. >> what we do know is that letter gave, of course, the governor's attorneyence. the articles of impeachment won't be done, prior to that. but once they're ready, it could be a pretty quick process. we know a majority of the assembly members have told cnn that they would vote to impeach, and then from there, of course, it would move onto the senate. >> and what more do you know about the evidence the governor's team may submit? >> so, the reaction to this letter stating that they were nearing completion, in terms of the impeachment investigation and inviting the governor's attorneys to submit more evidence. they said they would cooperate but there were a couple of clues in there. we do know that from the governor's rebuttal, essentially, one of the events they take issue with is the one that involved allegations from executive assistant number one, who said the governor had cupped her breast on one occasion. they say that that was basically incomplete. and that also, an attorney for the executive chamber, we know, has taken issue with the way the retaliation

cnn's erika hill joins us now with more.ow about the governor's waning support in the state legislature? >> it is certainly waning, as you pointed out. they share a number of assembly numbers who have said to cnn that they would, in fact, vote to impeach. 80 of the 150 members. both, democrats and republicans. he also mentioned jay jacobs. that was a really important one that came out earlier today. anderson, he is the chair of the new york state democratic party and he said in a statement that it was tough for him. he, in that statement, said that he had called the governor and he intimated that he, too, had earn urged the governor to resign. but it basically sounded like that fell on deaf ears and that's why he put out this statement calling on the governor to resign. in fact, he said specifically he's lost his ability to govern, both, practically and morally. we know there is a lot of this happening, publicly. um, it's our understanding that there is urging privately, as well. but as of tonight, the governor, standing str

of andrew cuomo's closest aides resigned overnight and the governor's attorney told my colleague erika hill that she has worked nonstop for the last two years and that takes a toll. but melissa is all over the state attorney general report. do you think she's jumping a sinking ship or what do you think of this? >> i think she's looking out for her best interests and, you know, it's very telling that in her brief note announcing her resignation she does not mention andrew cuomo. she doesn't mention the person who hired her, elevated her, gave her all of that power and worked side by side with her literally for years. that is telling. that's not an accident. it's not like she was too busy on a sunday night to put in a word of thanks to him. and what it strongly suggests, don, she sees her own personal and perhaps legal interests as diverging of that from the governor and diverging from that of the administration. i read this as a sign that she sees the storm clouds gathering, she sees that the governor wants to fight, wants to fight with somebody, and she also seeing that the state assembly a

i was asked about it yesterday on cnn by erika hill. what what commisso alleged, new year's eve she was at the mansion and claims the governor wanted to take a selfie. what the governor told the attorney general's office is no, he actually remembers this and he said ms. commisso asked me if she could take a selfie with me. and what miss commisso is now saying is that when she took the selfie, that the governor put his hand on her butt and rubbed it for at least five seconds. that's what she testified to. and that she was so nervous that it became blurry, the pictures. and she had to delete them. and so they moved and sat on a couch and then took this selfie instead. i'm not going to say any more than that for me as a lawyer, former prosecutor and former defense lawyer i often use pictures as exhibits at trial. the governor did not violate brittany commisso, he did not rub her rear end before this photo. she asked for a selfie with him. i think that this picture demonstrates a comfort level and someone who wanted a selfie with the govern

let's get some more from erika hill. impeach snd. >> the short answer is pretty quickly. a letter was sent today to governor cuomo's attorneyi s noting the impeachment investigations are nearing completion and inviting the governor's attorneys to submit any additional evidence that they would like. now, we know that the deadline for submitting that additional evidence is next friday, august 13th, 5:00 p.m. so articles obviously won't be introduced before that. i can tell you that we earned earlier this week from an assembly speaker who said that everything that developed on tuesday in that ag's report meant they were going to move expeditiously to conclude this investigation as soon as possible. now, both the governor's attorney and his director of communications responding to that letter said this morning, they both side they would cooperate. we're grateful for the opportunity, essentially, to contribute more information. i should point out his attorney took the opportunity to criticize the ag's report accusing the inve
