"outfront" today, america's new path to war. so the united states is lowering the threshold for american military involvement in a possible war with north korea. in the face of mounting threats from the young untested dictator of the country, the u.s. is getting ready to fight back. now while the nearly 30,000 american troops in south korea are already obligated to defend that country in the vent of an all out war, under the new plan, the troops could fight in direct response just to provications from north korea. it could be a significant difference from the way things are right now. pentagon correspondent chris lawrence is "outfront" tonight. chris, what is this new agreement mean for american troops and the threshold where they would be in conflict? >> reporter: erin, it basically puts it down on paper in forma

i'm erin burnett. out front, message in a bomber. the pentagon announcing to day it's going to be flying nuclear capable b-52 bombers over south korea. it is part of a joint military exercise intended to send a signal to north korea's leader. now north korea appears to be send something very strong messages of its own as recently as today. we have a new video that we found posted to a semiofficial government website in north korea. it's basically a portrayal of a violent attack on the u.s. capital and a gun sight that zeros in on the white house. now, i want to emphasize that we can't verify the authenticity of the video. i can tell you this, it is the second one that we foupd that depicts a north korean attack on u.s. soil. the other which was posted to the same website last month showed a nuclear strike on new york city set to the song "we are the world." "outfront" tonight, we want to start with breaking news. the navy seal who died today in arizona during a parachute training exercise was a member of the elite seal team six. this, of course, the very same unit that killed osama bin laden in pakistan back in may of 2011. we should tell you a second seal was injured in that same accident. he remains in stable condition tonight. want to take you straight to the pentagon to our correspondent there chris lawrence. chris, what can you tell us about what they were doing about the seal and the accident? >> a navy official told me that the seal was killed in a free fall parachute accident. so unlike some of the films or movies that you've seen where the military people are hooked up to a line inside the plane, this type of training involves them actually jumping out of the plane, falling for some time and then pulling the rip cord to release the canopy. that is the type of training they were doing. it's something that all seals are proficient

i'm erin burnett. cold feet on gay marriage. could the supreme court be having second thoughts of taking up the lightning rod issue? today protesters and gay rights supporters swarming the steps of the supreme court and inside the justices were listening to the arguments. bullet point by bullet point. for and against. california's ban on same-sex marriage. that's the so-called proposition 8. the justices have the power to make gay marriage the law of the land. currently, it's actually only the law in nine states and washington, d.c. if you go straight from that to all 50, well, that's a really big edict from the high court and some justices sounded wary of issuing such a broad ruling. >> on a question like that, of such fundamental importance, why should it not be left for the people? either acting through initiatives and referendums or through their elected public officials? >> well, others like justice kennedy questioned why they were hearing the case in the first place which is a pretty interesting thing. >>. >> i just wonder

"outfront" tonight we have breaking news with major developments in the search for the gunman who killed colorado's prison chief. at this hour investigators from colorado are headed to wise county, texas. it's about 45 miles from ft. worth. they're going there to see whether a man who led police today on a high speed car chase is the same person who killed tom clemens on tuesday night. the chase ended with the suspect crashed into a semi, left his car and opened fire on police, injuring a deputy. we have a reporter in wise county, texas, to night. ed, why do police think this suspect might be related to tom clemens' horrific murder? >> reporter: well, the car that the suspect in this particular case was driving was a black boxy cadillac. what's interesting is this car had two different colorado license plates as well. so obviously that raised suspicion. but what is not clear is whether or not that the initial deputies that approaches this car about 35 miles to the northwest of where w

i'm erin burnett. out front tonight, justice at last. man suspected of involvement with the september 11th terrorist attack on american diplomatic compound in benghazi is being held in libya. let me go through the basics of what we know about him. his name is faraj al shibli. he is a national from libya. he right now is the only known suspect in custody in connection with the attack in benghazi. it's been six months since chris stevens and three other americans were killed after militants linked to al qaeda stormed the consulate in libya. president obama has vowed to bring the killers to justice but so far no one has been charged. out front tonight, susan candiotti who broke the story. we want to begin with her. what more do we know about al shibli? >> we've been trying to gather as much information as we can. two sources are telling me and cnn terror analyst that, in fact, al shibli, 46 years old, in custody, in libya. we don't know the exact location. and that one of our sources is telling us that he was just back from a trip to pakist

"outfront" tonight, tough talk from north korea. today, north korean officials scrapped the armistice, that has created nearly 60 years of peace, uneasy peace, but peace with south korea. this after the u.n. security council unanimously passed tougher sanctions thursday against pyongyang. the reason for those sanctions, north korea's third nuclear test. north korea also threatened in an editorial, in its state-run newspaper that, quote, as the armistice agreement has been nullified, no one can expect what will happen next. so is this just your run of the mil saber rattling, or does north korea's new, young leader have something to prove and have the will to prove it? president obama's national security adviser, tom donlin, says the u.s. isn't taking a chance. >> the united states will not accept north korea's nuclear state, nor will we stand by, while it seeks to develop a nuclear armed missile that can target the united states. >> reporter: earlier, i spoke with president obama's first national security adviser, general jim jones.

"outfront" tonight, we have breaking news. there is an urgent military meeting at the supreme command in pyongyang and ordered rockets to be on stand by for firing at american targets including the american mainland and military bases in the pacific and south korea. this is according to north korean state media which also quotes kim saying, "the time has come to settle accounts with the united states. if the u.s. makes a reckless provication." this latest move is in retaliation to the united states flying two b-2 bombers over korea today. it was a training exercise and a forceful signal to north korea. the stealth bombers are capable of carrying nuclear loads and conventional ones. they flew more than 6500 miles from missouri to south korea. just for the exercise. according to the u.s. forces in korea, the mission "demonstrates the united states' ability to conduct long range precision strikes quickly and at will." our jim clansy is in seoul, south korea. what can you tell us about kim's threats against the united states? >> r
