erin mclaughlin. thanks so much keep us posted from philadelphia. let's talk more about the amtrak investigation, joining me now, mary ski a of ao a cnn transportation specialist and a former inspector general of the national transportation department and richard viehl is a former train accident investigator for an insurance company and cnn analyst phillip holloway with me in atlanta. good to see all of you. this investigation is looking into the possibility that the train had been struck by some sort of projectile. so richard, you've worked on crash reconstructions, what is the possible link between something hitting a windshield and the train accelerating as rapidly as it did? >> well the correlation is the fact that he was accelerating he would have had his throttle wide open trying to get up to track speed. had there been some sort of an event like something hitting his windshield and he would not know exactly what hit his windshield all he knows is he's traveling along and boom something large hits. he doesn't know whether it's a gunshot, somet

joining me now, cnn's erin mclaughlin. erin can you tell me about this eighth individual? >> reporter: hi brooke. some grim news here in philadelphia. we now have learned the identity of the eighth victim. he's been identified by his family as 45-year-old bob gildersleeve. now, his family had been sick with worry. they reported him missing following the crash. his wife had said she dropped him off at the train station in baltimore. that was the last time she saw him. now this grim news that his body has been discovered. the family his wife releasing the following statement saying he has been my best friend for 29 years, and we just celebrated our 18th wedding anniversary and mother's day on sunday. he is a remarkable dad to our daughter ryan and son marc. the statement goes on to describe him as funny, sarcastic, the kind of individual who lights up any room with his presence. now, we understand that his body was found in the wreckage this morning around 8:00 a.m. cadaver dogs have been called to the first car, which had been badly mangled. it was in that wreckage that the

let's go to philadelphia, to erin mclaughlin. let's begin with that lawsuit.can you tell me about it? >> reporter: hi brooke. that's right. cnn spoke to the attorney filing a mass-action lawsuit on behalf of four injured passengers. it's the first passenger lawsuit we've seen. it alleges the following points. it alleges excessive speed of the train as well as lack of available preventive technology on the tracks. it was filed this morning against amtrak and it's seeking compensations for lost wages, medical bills, as well as pain and suffering. now, on friday the first amtrak employee filed a lawsuit, seeking damages of $150,000. it's worth noting that currently federal law caps damages from a single train crash to $200 million. some lawmakers today are looking to change that as well brooke. >> all right. we have to talk about -- i know we have the picture, guys if we can put it up of the windshield of this train and the shatter mark here. what is the ntsb what are investigators revealing could have happened? >> reporter: yeah, we're still waiting to hear from

erin mclaughlin near the crash site in philadelphia. erin, what more are you learning? >> reporter: hi, kate, it appears as though they are trying to clear the crash area, lay new track in an apparent attempt to get very silgts northeast corridor back up and running again. not clear from authorities when that will happen. you can see there they brought in cranes. yesterday this vantage point two cars and train today. we can only see one this morning. they rotated one of the cars upright onto the tracks. they are checking signals as well as the track itself. not only are they trying to clear this area, there's that active investigation going on, they are also searching for the the missing. authorities have not given the exact number accounted for. we know a 45-year-old robert gild gildersleeve, a father of two teenager boys, his wife said she dropped him off at a train station in baltimore, a ticket for amtrak 188, they have never seen him again. authorities say the search here continues for the missing. they expanded it. they say it's possible passengers thrown from the

. >> erin mclaughlin is in philadelphia for us this morning. the fbi on the scene investigating the situation. any sense of what they're finding yet? >> reporter: we're hoping to hear more of the fbi's analysis expected to happen today. we know they are taking a very close look at a fist-sized circular mark located on the left-hand side of that windshield. investigators say it might be possible to be the result of some sort of projectile that struck the train prior to the crash. however, today there are new doubts about information that came from the train's assistant conductor. she told investigators she thought she heard the train's engineer, 32-year-old brandon bostian tell a radio dispatcher that amtrak 188 had been hit by some sort of projectile prior to the train crashing. ntsb now says that they went through all radio transmissions from trains in the area that night and heard of no such thing. nevertheless, investigators say this is a lead they want to pursue. >> i understand that three of the people killed in this crash are now being la

erin mclaughlin thank you so much. obviously hearing the train whistle, not everything shut down behind you. thank you so much in philadelphia. let's stay on this engineer brandon bostian. we're hearing more from his friends and acquaintances, who have been speaking out since this deadly crash. earlier today, cnn heard from bostian's best friend james wier. he and bostian had previously discussed the difficulty of this particular route, the northeast corridor. just two hours after the crash, wier spoke to bostian in the hospital. >> he did not remember much. he couldn't remember much. he said he had some staples and some stitches and he was sore. he was in some pain. he was not at all sure of himself at that point. just as far as what was going on i think he was still in shock. you could tell he was in shock. he did tell me it was a challenging route. he told me that it's hard to stay on schedule all the time because he wants to make sure he takes the time to perform all of the safety requirements each and every trip.

erin mclaughlin joins us from philadelphia. the fbi is now involved in this investigation. to what degree are they making any discoveries? >> reporter: hi frederica. well tomorrow we expect fbi forensic vote take a look at the train's windshield to assess whether or not it was, in fact hit by some sort of projectile. meanwhile, we have spoken it a philadelphia native who showed us just how easy it was for someone to access the tracks. the mystery of amtrak 188 continues. at the center of the investigation, a fist-sized marking on the windshield and the possible that shortly before it derailed the train was hit by an unknown object. last week the assistant conductor of the doomed amtrak train told investigators that she heard engineer brandon bostian say into a radio transmission that the train had been struck by something. >> at this point, we really want to chase this lead down. >> reporter: transportation officials are also investigating reports that minutes before the crash, other trains in the area were also hit by projectiles. the windshield of a septa commuter train w

erin mclaughlin reporting live from philadelphia. thank you so much. >>> in the meantime an amtrak employee is the first person to file suit against amtrak. bruce phillips is a dispatcher for the train service. he was seated at the back of the train when it crashed. he suffered head injuries and now accuses amtrak of negligence. last hour i spoke to his attorneys. >> he and others were ejected from the seat and literally they were like rag dolls made out of ping-pong material being thrown about the car. they hit the ceiling, luggage racks, the seats. when it finally came to a stop there was just panic and just a horrible things that everybody saw in that train including our client. >> all right. let's talk more about this with transportation accident attorney david cook. i'm also joined by john a former board member of the ntsb. thanks to both of you for joining me this morning. i appreciate it. >> thanks for having me. >> thanks for being here. john i want to start with you. brandon bostian will now talk to ntsb investigators. what

erin mclaughlin is following the investigation live from philadelphia. morning, erin? >> well in addition to the windshield you were just describing there, investigators are pointing to another piece of key evidence that suggests some sort of projectile may have hit amtrak 188 prior to the crash. they say that yesterday, they interviewed an assistant conductor who says moments before the crack she overheard a radio transmission that took place between the amtrak dispatcher and the engineer of a septa train, a separate train that was nearby. that engineer according to the dispatcher that his windshield had been hit by some sort of projectile. she said following that she heard from brandon bostian, the amtrak 188 engineer and he said that his train had also been hit. now authorities say they are following up. they plan on interviewing the septa engineer as well. meanwhile, deepening the mystery, we're hearing from passengers of a third train that was in the area around the same time. an amtrak acela train. we heard from one passenger who said he was sitting

erin mclaughlin thank you so much in philadelphia.ou can imagine, so many people hop on the train each and every day or weekly. right now train service along the east coast has been seriously impacted by that train derailment. all amtrak service, in fact between new york and philadelphia has been suspended. brian stelter is in new york at penn station. i see a number of people at the big board behind you. how much has this affected people you're talking to? >> if you look behind me brooke it's more delayed and canceled than it is on time. the trains that are running are only running to about trenton. those are only local trains. there's really no service between new york and philadelphia. it's like a big hole has been cut in the middle of the northeast corridor. the most important train line in the united states, and amtrak just a couple minutes ago said it's going to be this way for a while. they've not been able to figure out thursday's schedule yet, but it looks likely that schedules will remain interrupted. this investigation will

erin mclaughlin is live for news philadelphia following the investigation. so erin wlarks more do we know about the damage to the windshield? >> investigators say they're very interested in a circular pattern, a fist-sized circular pattern markings located on the lower left-hand side of the windshield. they think it may be the result of some sort of projectile that hit the train prior to the crash. and are so interested they've asked the fbi's forensic team to come in and analyze those markings further. in addition to that they interviewed yesterday, the assistant conductor who was on board that train, she says that shortly before the crash, she heard radio transmission between the amtrak dispatcher and a, an engineer that was on board a separate septa train, that was in the region. that septa engineer she says she believes told the amtrak dispatcher that a projectile hit his windshield. now she said that following that she heard from her engineer brandon bastion. this is something that authorities are following up on. they're interviewing the septa engineer

erin mclaughlin is live following the investigation here. erin, what have you learned this morning?> reporter: hi, christi. well, investigatorsing trying to solve the mystery of why amtrak 188 crashed. they're now looking at the possibility that the train may have been struck by some sort of project style. yesterday in a press conference, a member of the ntsb pointed to two key new pieces of evidence. information from the assistant conductor of amtrak 188. she says that prior to the crash, she heard a radio transmission between the amtrak dispatcher and the engineer of a nearby septa train. the engineer of the nearby septa train reporting that his windshield had been struck by a projectile. she said she then heard from the amtrak 188 engineer, brandon bostian, telling the dispatcher that amtrak 188 had been struck by a projectile as well. we also know that they're looking at the windshield of amtrak 188, a small circular marking in the lower left-hand corner. they called in the fbi to help with that forensic analysis. ntsb saying calling in the fbi for its forensics expertise is not

joining me now, i have cnn's erin mclaughlin. the mayor, i know of philadelphia he held a press conference a while ago. what exactly did he say about this engineer? >> reporter: he seemed to contradict the attorney as to the level of cooperation, that brandon bostian was participating with authorities. the attorney for brandon bostian says he answered hours of questioning from police that he handed over blood samples. he also handed over his cell phone. that contradicts what the mayor michael nutter just said hours ago in a press conference. nutter said that yes, he did have a concussion and, yes, he was having memory problems but that he didn't want to answer police questions. take a listen. >> the engineer was injured. again, i want to remind you the engineer of course was in the first train car, the engine component. that car, we believe, actually tumbled over and over and over numerous times, and the engineer survived. he was taken out of the vehicle, went to a hospital received treatment, was interviewed by the police depart

cnn's erin mclaughlin is in cleveland with the details. >> reporter: john and christine, cleveland's said this takes police reform to another level. the court-ordered consent deck agree was announced tuesday. it calls for the police department to review its officers to make sure they use terms properly over a five-year period. >> the community, when they figure wow, this is the top level of government. this is the most universal, the most powerful unit of government. when they're actually stepping in and getting involved probably we're going to see our needs get met a lot quicker than when he might going through local politics or even in the states. >> reporter: new orleans, seattle and cincinnati all have similar agreements. the cleveland decree was the result of the department of justice investigation that concluded in december. it found for the department to have a pattern of using excessive force. one of the examples cited in that report the 2012 fatal shooting of two unarmed people following a car chase. over the weekend, the officer officer charged in that was acquitted trigger

. >> erin mclaughlin reporting live. thank you. >>> the northeast corridor is the busiest passenger rail line in the country. normally carries 750,000 passengers. it costs economy $100 million a day. as it shows there was a long list of cancellations again. people are relying on buses and planes to get them between new york and washington. it's disrupting businesses who rely on this service. let's talk more about that with brian steltser. good morning. >> they really rely on this train corridor. the most popular way to get back and forth from new york and washington. frequent travelers play a game whether it's better to fly or take the train. it's usually better to take the train. they are having to resort to other options all this week. there's no answers when train service will be restored. you see a map and it's as if there's a giant hole cut in the middle of the artery in philadelphia. like you mentioned, people can be taking a plane, can be driving p the fact am track said little about when it will be restored incre

first, let's get the latest on the investigation from our erin mclaughlin. what's the latest that you're picking up? >> reporter: hi, kate. investigators are saying they do not know the reasons for that train acceleration. the ntsb says they now believe that just over a minute prior to the crash that the train sped up at a time when it should have been slowing down just as it began to enter that curve. that's when they say they believe the train engineer hit the emergency brakes but by then it was simply too late. seconds later the train crashed and now that's based on detailed analysis of footage captured by that camera that was installed at the front of that train. of course, what that footage does not tell investigators is why? why was the train going that fast. that's why investigators want to speak to the 32-year-old engineer, brandon bostian. they'll speak to him in the next couple days. his lawyer saying that he simply at this point does not remember what happened due to a concussion that he sustained at the time of the crash. the lawyer says it is po

erin mclaughlin is "outfront" in philadelphia.been trying to find out more about these missing passengers. what have you been able to figure out? >> reporter: authorities say they are still searching for the missing. while they haven't given an exact figure we know of at least one passenger still unaccounted for. that according to his friends and colleagues. 45-year-old robert gildersleeve was dropped off at a train station in baltimore by his wife. he has two teenaged sons. he was set to catch amtrak 188 and was never seen again. now, we do know that at least seven people died in this tragedy. authorities have yet to release their identities. they say they are working to try and notify all next of kin first. and it's unclear if gildersleeve is one of them. his family saying they certainly hope he's not among the dead. >> erin what i'm trying to understand i think a lot of the people watching you buy a ticket for a train under your name, it's scanned when you get on board, how is it they don't know who was on the train, they don't

erin mclaughlin is there. how close are official there is to clearing the scene? >> reporter: they're simply not at that point yet. the search very much ongoing. the area expanded last night, they brought out sniffer dogs and expanded it in the early hours of this morning, still looking for anyone who could potentially they say have been thrown from the train. and that's because all 243 people that they believe may have been on board have yet to be accounted for. there could be several other reasons for that. there could be that some people simply walked away from the crash site. it also could be that some people who were supposed to have been on the train, who had tickets for the train didn't actually board the train. but looking at that wreckage it does seem absolutely incredible that anyone could have walked away. i spoke to one passenger, jeff cutler who described for me the moment of impact. >> there's this split second where to me it felt like the car was lifting off the ground. it was lifting off the rail. we were going through a curve. and whatever speed i

erin mclaughlin is following the story for us. what can you tell us?y. the fbi has been brought in to help. jacoby jacoby's death marks the first homicide the small colorado town has seen in some eight years and now that the shootings are linked people say they are scared. two random shootings, authorities now say are linked and fears in colorado there's a sniper on the loose. >> be vigilant. be aware of surroundings. see what's going on. >> reporter: the warping came friday as police revealed there's new evidence connecting the fatal shooting of 48-year-old john jacoby to the shooting of 20-year-old corey romero. police won't say how they are linked but appear the victims appear arbitrary. >> is there any indication the victims knew each other? >> no indication of that at all. >> reporter: jacoby was shot while riding his bike and a month earlier and five miles away romero was shot while driving. >> 911. what is the access of your emergency? >> i'm on the highway right now and somebody just hit me and i'm bleeding from my neck and i'm scared. >> repor

cnn's erin mclaughlin has the latest for us from philadelphia. what are we learning erin? >> reporter: hi alisyn. well at the heart of this mystery is why the train accelerated. so the focus very much is on 32-year-old engineer brandon bostian. a source with knowledge of the investigation say the possibilities range from human error to something more intentional. let me take you through some of the ntsb's latest findings. yesterday the fbi looked at that circular marking on the windshield and concluded it was not from a bullet. bostian also did not tell the dispatch the train was hit by an object prior to the crash. and so far there's no indication of mechanical failure. but authorities say they are not ruling that out. now, today we are learning that a conductor on the train filing suit against amtrak yesterday, the first four passengers filing suit as well. but there is a cap, a federal cap on compensation for all victims and any claims of $200 million. and legal experts say that's simply not enough to cover the damages in this case. and now lawmakers are trying to incre

erin mclaughlin has the details. >> reporter: poppy, we're just hearing from the federal railroad administrationnstructing amtrak to take a number of steps to improve safety along that very busy northeast corridor. it says that the following will be formalized with an emergency order in the coming days including ordering amtrak to install technology to control speeds along that northeast corridor including automatic train control, which detects when a train is above the speed limit and automatically applies train brakes. they want it in the area of the crash immediately. they also are ordering amtrak to assess risk at all curves along the northeast corridor and they also want increased speed limit signage. amtrak must increase they say, its wayside signage alerting engineers of maximum authorized speeds throughout the northeast corridor. it's described these as initial steps. we are still waiting to hear from amtrak. poppy. >> erin thank you very much. and at the same time one of the engineers interviewed by the ntsb yesterday says that the locomotive engineer aboard this train reported his wind

cnn's erin mclaughlin live with more from edinburg. >> reporter: people here waking up to an absolute political earthquake. keep in mind that the scottish national party is the very same party that was pushing for that referendum back in september, pushing for a breakup of the united kingdom and for scottish independence. now, they failed there, but they're absolutely victorious in this election going from just 6 seats in parliament overnight to an unprecedented and absolutely staggering 56 seats. the most this party has ever had 11 seats, many saying that scotland now sending a very firm message to the establishment that it wants to see change in this country. perfect example of that the story of 20-year-old mary black, the snp candidate who managed to unseat douglas alexander, one of the most seasoned labor politicians in all of the land. now the question becomes what sort of influence will the snp have over this government and what sort of concessions prime minister david cameron is willing to make to avert what many are talking about here as a second referendum. chris. >> all righ
