talking to police. lisa washington joins us with more. good morning. >> reporter: this is pretty shocking. there is video evidence that the prosecution wants to use from that alleged new year's eveident. of course, the assistant district attorney in this case wants to use this video but she will have to do so under the exceptions of the hearsay rule. sheriff mirkarimi is charged with three misdemeanor accounts including domestic violence, child endangerment and dissuading a witness. that's after prosecutors say he assaulted his wife in front of their 2-year-old son and kept her isolated inside their house so she wouldn't call police. mirkarimi's wife eliana lopez has not been cooperating with the authorities and she insists that her husband didn't abuse her. a neighbor took the video that the prosecution wants to use as evidence. the d.a. says it's a candid glimpse of the victim suffering. mirkarimi's attorney told the "san francisco chronicle," we will be objecting to the admission of the out of court statement including the video. and, of course, sheriff mirkarimi's trial is scheduled to begin on february 24. he has vowed that he will be fighting those charges. >> lisa, no one
