all of this puts trump lure evan corcoran in a very unique position. yes, he's trump lawyer, but he also might be a witness or party to a crime. he could be willingly or unwittingly a pawn in president trump's alleged obstruction of justice. that is something known as the crime fraud exception, and that can break attorney giant privilege. last month, special counsel jack smith as to the d. c. district court judge for approval to do just that, to force corcoran to cooperate with the investigation. abc news reported that the special counsel for them presented evidence that trump, quote, deliberately miss had his own attorneys, and evidence that appears to show that trump committed the crime. on friday, a federal judge agreed with the special counsel, and ordered evan corcoran to comply with the grand jury subpoena for the testimony, and also ordered him to hand over a number of records related to what the judge reportedly referred to as trump alleged criminal team. those documents would be handwritten notes, invoices, and transcriptions of personal audio

what do we expect to come out of evan corcoran's grand jury opinion appearance in d. c. this morning? >> we are hearing another person who probably holds an answer to the questions that peter strzok was referencing a couple of minutes ago, which is what exactly did trump say? we must remember evan corcoran did appear before the grand jury before and basically did not answer any of those questions. there is the attorney client privilege and the prosecutors have a way of getting around that i think some of the answers to those questions might come out from his testimony but here's what evan corcoran might be able to answer because we have to remember and the special counsel jack smith probe into the possible mishandling of classified documents down in his mar-a-lago estate, it was evan corcoran who sends that letter last june to the department of justice that basically said we have conducted a full review. here are the documents that are pursuant to your pc subpoena, and that was accompanying three dozen or so documents. it turned out those were not all the documents. the

evan corcoran wrote and drafted a certification that settled documents had been returned. who gave the information to evan corcoran that all the documents had been returned? presumably, that's his client, donald trump. what errol howell is reporting is that that is not protected by the attorney client privilege. if a client is using a lawyer to commit a crime, whether the lawyer is in on it or not, the lawyer doesn't have to be complicit, of course, if they, are it's more serious. there is no attorney client privilege. the court ordered that he has to go into the grand jury and testify to the question of where did you get the information that you put in that certification. if his testimony is that came from donald trump, that's going to put donald trump, really, in the hot seat because that's clearly a false statement. she also, the judge, also turned over the notes that mr. corcoran took of the conversation about that certification. presumably, whoever gave him that information, he recorded that. those notes could be a powerful cooperation for the government. the governme
