now, state assemblyman evan low from the south bay and san francisco senator scott wiener have co-written assembly constitutional amendment five, which californians will vote on in november. the amendment removes the provisions opposing same sex marriage from the constitution once and for all. it's sort of seen as quote unquote, zombie language, but the fact of the matter is, given where the direction of the united states supreme court is, that provides the impetus and the sense of urgency to say that we need to preempt this. the amendment has already cleared the necessary legislative hurdles and has the backing of governor gavin newsom, who worries that shifting national political tides could undo marriage equality. >> look what's happening. all these red states to voting rights, civil rights, lgbtq rights. look what's happened to women's rights. not just access to abortion, but the debate we're having today about access to contraception. this is real. >> married couples in san francisco say the battle for equality is a constant struggle, and say they will support the measure in the fall

silicon valley's assembly member, evan lowe authored the bill.quire an automatic vote recount in statewide races with close results. now, this would only happen when the margin of victory is less than 0.25% of the ballots cast, or less than 25 individual votes. the bill also requires financial contributions to voter requested recounts, costing more than $10,000 to be reported to county officials and published on election websites. the bill is waiting for a referral to committees in the state senate. >> a behavioral therapist in the south bay has now been arrested after police say he sexually assaulted a girl during a session at her home. >> as ktvu zan rubin shows us tonight, investigators say they now believe this has been happening for months and there could be other victims. >> san jose police have arrested a behavioral therapist, alejandro lopez nunez, for sexually assaulting a special needs girl. they say family members made the discovery when they walked in on a therapy session at their home. >> they were able to basically catch the suspect

now, assemblyman evan low has introduced a measure that would mandate automatic recounts in close electionsged out santa clara county supervisor joe simitian in a recount after the march primary ended with a tie for second place. former san jose mayor sam liccardo came in first. now, low's proposed bill would mandate a recount by the state in an election where the margin of victory is razor thin. >> let's get the politics, or at least the perception of the politics out of it. and have a process that all can abide by in the counting of votes that we should have. the accountability and transparency without the political motivation in lowe's bill would apply to any election where the margin of victory is less than a quarter percent or less than 25 votes. >> low will face sam liccardo in the general election november 5th. neither liccardo nor joe simitian had a comment about the bill. >> the five major candidates running for san francisco mayor have this weekend to prepare for monday night's debate. they are current mayor. london breed, of course. former supervisor and mayor mark farrell, super
