. >> evan perez is out front. evan, 222 pages. there's a lot of detail in here.re laying it all out. how bad could this lawsuit be for donald trump and his children? we're talking here about don jr., ivanka and eric, along with his company. >> that's right, erin. she is asking for a judge to essentially put the trump organization prohibit them from doing business in the state of new york if she succeeds in addition to the $250 million that she's asking, that she says were ill-gotten gains, this would bar trump and his children from leading any business in new york ever again. five-year ban on buying commercial real estate in new york state as well as a five-year ban from applying for loans in new york state. she says, again, over ten years of fraud. one example is the mar-a-lago estate in palm beach, which, according to letitia james, is worth about $75 million. but trump was claiming $739 million. another example, his triplex at trump tower in new york city roughly about 10,000 square feet. trump claimed there was 30,000 square feet and valued at $300 million. t

evan perez joins us now. evan, you've been perusing this document, i'm sure. we're talking now about thousands of pages of documents that potentially if this judge in florida decides that she wants to order a special master, there's a lot more things that this person's going to have to go through beyond obviously the fbi -- according to the document, according to the prosecutors, the fbi already has a separate team that has gone through and has singled out things that they believe -- i believe there's 520 pages of things that could have some attorney/client privilege material. potentially though, this special master that this judge is thinking of appointing would have to go through everything to make sure that what the fbi says is true, right? so, you can see now why the justice department is concerned about the potential delay in this investigation, that this would have the effect of delaying the investigation. because she's saying -- the judge is saying that while this is going on, she's going to prevent the fbi from having access to some of these documents.

let me get to evan perez. mark meadows i hear responding to a subpoena from the doj. what are you hearing and learning? >> don, look, this is a biga mystery during the recent uptick in activity from the justice department is what happened to mark meadows? now we know the answer. the answer is that he has responded. he's complied with a subpoena from the justice department as part of the january 6th investigation. now, this makes him the highest ranking trump official to comply with a subpoena as part of this criminal investigation, and, you know, in addition to him, we also know that ben williamson, one of his aides, a very top aide of mark meadows has also been subpoenaed as part of this big push we recently reported more than 30 subpoenas that went out to people in the trump orbit. with mark meadows, we know he's provided, you know, all of the materials he had given to the january 6th, the house committee that is investigating january 6th. that's thousands of emails and text messages from the period that, you know, covers everything from before the election to up to

let's continue the conversation with evan perez. evan, the attorney general knows and it's happening already, donald trump jr. on twitter attacking this as a witch hunt. a trump attorney calling it unchecked abuse of authority. she knew it was coming. and so she's hoping that this answers those questions that this is political. again, nearly 300 pages. it goes line by line through many different transactions. where does this case go from here? >> one of the first things that happens is a judge is being asked to cancel the certificate of business for the trump organization in the state of new york. it appears that that will severely limit what types of business trump can enter into in new york state. of course you know he has not only a golf course, he's got commercial buildings, he's got residential buildings and also a hotel business there in new york state. a couple of things that stood out in this document that they released today. for example, mar-a-lago, according to the new york state attorney general, they say that trump gave

evan perez, stay right here.back with you in just a second. >>> first i want to bring in cnn's don lemon, joining us with new information on this investigation into the insurrection. don, i understand that you just spoke with documentary filmmakers who spent time with roger stone. they've been cooperating and turning over some of the footage to the committee. what did they tell you? >> we spoke with them just a short time ago, it is called "a storm foretold". one of them, alex, is christopher branson, the director and producer, and there's a director of photography. they had unprecedented access with roger stone and they were making this documentary on him. they wanted to see what his connections were, if there were any, between these groups like the proud boys, et cetera. the january 6th committee asked for their footage of stone surrounding january 6th and the 2020 election, and they handed it over. that includes a clip like this of roger stone, this one is from november 2nd of 2020, on his way home from a doug

evan perez is outside the courthouse. what do we know?, his deputy, arrived just a short while ago into the courthouse. they are appearing before the grand jury that meets on fridays, this is the grand jury that is looking at possible crimes beyond the rioters, beyond the people who attacked the u.s. capitol on january 6. they are looking at the conduct of the former president, people around him, who are trying to organize these fake electors whose goal, their scheme, was to try to find a way to keep donald trump in office even though he had lost the election. and so what we know is that there have been weeks and weeks of discussions between cipollone and philbin and their legal team and the justice department over exactly what kind of questions that they will be able to answer because they claim that they are protected by executive privilege, some of the answers that they have would be protected by the former president's claim of executive privilege. it is not clear exactly how they ironed out those differences, but it is something that

cnn's evan perez has the details from washington. >> for weeks donald trump has said the fbi had no reason to seize government documents from his home because he declassified any documents that were marked classified and they found them. he's made that claim in interviews and social media, but the former president's lawyers in two different federal courts have yet to make that argument. a hearing in brooklyn on tuesday, federal judge raymond dearie questioned trump's lawyers on whether they plan to present truth the documents were classified. judge dearie is acting as a special master or independent third party to review special documents seized from trump's palm beach estate. trump's lawyers said they aren't ready to say whether the documents are declassified. in a separate court filing through a federal appeals court in atlanta trump's lawyers also stopped short of saying trump declassified documents. that court is reviewing a lower court decision that blocks the justice department from accessing about 100 documents that the government says are classified. trump lawyers told the appeals

evan perez joins us now. evan, you have some new details. the special master, the independent oversear of the evidence, is putting some pressure on the trump team. explain. >> yeah, just in the past hour we have an order from raymond dearie, the senior judge serve agz the independent third party that is going to look through these 11,000 pages of documents. remember, this is something that donald trump himself and his lawyers had asked for. and now he is saying in an order that by september 30th, donald trump and his lawyers have to put up or shut up about the claims that he's been making that the fbi may have planted evidence during the search on august 8th. it says here no later than september 30th the plaintiff shall submit a declaration or affidavit that includes each of the follow factual matters. a list of any specific items in the detailed property of inventory that the plaintiff asserts were not seized from the premises. in other words, if you really believe the fbi planted evidence is something that he brought up last night in his i

our senior justice correspondent evan perez joins us. talk about this appeal. what does it entail?one hand, the justice department is saying they are going to appeal the 11th circuit in atlanta the entire order she gave on monday. but at the same time, they are asking her to put on hold at least part of her order, which barred the justice department, barred the fbi from continuing to look at all these documents, specifically they are asking about the 100 classified documents that they say just by the fact that they are classified cannot possibly be personal items of the former president. they have to be government records. it says here, there is no justification for extending the inju injunction as special master review to the classified records. the classification markings established on the face of the documents that they are government records, not donald trump's personal records. and so what they are asking her to do is just to let the fbi continue doing the investigation that they are supposed to be doing, anderson. >> we have new information about the government security revi

evan perez joins us live with more. evan, what are authorities looking for from mr. lindell? >> jake, according to the subpoena, which lindell shared a copy of with us, it says they're investigating this computer tampering, voting machine tampering investigation part of a voting -- tampering investigation out of mesa county, colorado where tina peters was the county clerk there is facing state level charges. she's pleaded not guilty. she's allowing authorized people access to the voting machines to that county. according to the subpoena we've seen, what the federal grand jury says they're investigating is identity theft and intentional damage to a protected computer and this is now obviously a federal investigation looking at the same thing, things that the state authorities have been looking into, which is the idea the host of characters were trying to use this episode as a way to undermine the results. >> the justice deputy, your colleague and scary murray have more than 30 in the last week, is lindell's subpoena part of that or separate? >> this appears to be separate. it'

cnn's senior justice correspondent evan perez is working the story for us. evan, what exactly did the judge rule here? >> well, brianna, the judge cited her concern about the fairness and of course this extraordinary situation of the search of a former president's home. i'll read you just a part of what she ruled today. she said that the court hereby authorizes the appointment of a special master to review the seized property for personal items and documents and potentially privileged material. the court also temporarily enjoined the government from reviewing and using the seized materials for investigative purposes pending the completion of the special master's review or further court order. she goes on, brianna, to cite just the fact that the former president is the one who was the subject of this search. i'll read you another part where she says as a function of plaintiff's former position as president of the united states, the stigma associated with the subject's seizure is in a league of its own. she cited several reasons for ruling this way. she said th

let's bring in cnn's evan perez. what is the significance of this appeal?reporter: jake, the biggest thing we learned from this document that the justice department just filed in federal court is that, as a result of this order from judge connor on monday, they said they had to pause the intelligence community's risk assessment of any potential damage that may have come from the way these hundreds of damages of classified documents were stored at mar-a-lago. one of the things that they were raising concern about is that there is no way the justice department says there's no way for the fbi to separate its criminal investigation, because it is part of the intelligence community, from what the director of national intelligence ordered the intelligence community to do, which is to make sure that any damage is known from how these documents were stored. and whether there's anything that needs to be done to mitigate those potential harms. i'll read you just a part of what the justice department says, you know, it draws attention to those four dozen or so empty f

cnn senior justice correspondent evan perez is tracking the mar-a-lago investigation.both sides were battling it out in court, but as of tonight, no decision from the judge. give us the latest. >> reporter: that's right. judge eileen cannon says she's not ruling today, not immediately at least, but she seems inclined to grant former president trump's request for a special master, a third party, to review some of the documents that the justice department has in its hands as a result of this fbi search of the former president's home. one of the things that happened today was during the arguments in court, jim trusty, one of the former president's lawyers, compared the dispute over these classified documents taken from the white house to mar-a-lago, he compared it to a dispute over an overdue library book. you can look at the picture there is of those classified documents. the justice department says there's over 300 documents marked classified that have been recovered from mar-a-lago, beginning in january, taken back to the national archives. at this point, the judge say

let's get straight to cnn's senior justice correspondent, evan perez. evan, i know this filing is 24 pages long. it came out on this holiday, but what are the main takeaways from it? >> kaitlan, the judge says the reason for this action that she's taking is the need to insure at least the appearance of fairness and integrity under the extraordinary circumstances presented. that's from her ruling today. what this means, though, is the justice department has to pause its investigation or at least its examination of these documents. the judge said that by friday, what she wants is for the justice department and for the trump lawyers to agree on a name of a person who she can appoint as a special master as well as the parameters and the duties of this person, of what this person is going to be looking at. she also wants a timeline for these two sides to agree to. if they can't agree, she says she's going to obviously decide it for herself. what this does, though, is it does allow for the intelligence community to continue their examination of the risk assess

evan perez is outfront. they had a big decision about whether to formally appeal it or not. they have done that, so what happens now? >> erin, they are asking the judge to put a pause on her order, which was an injunction, preventing the fbi from having access to the documents seized when they conducted the search at mar-a-lago just three weeks ago. i'll read you just a part of what the justice department says is the harm that comes from that injunction. they say the injunction against using classified records in the criminal investigation could impede efforts to identify the existence of any additional classified records that are not being properly stored, which itself presents the potential for ongoing risk to national security. one of the things they point out is that those 48 folders that did not actually have any classified documents in them, they were empty. they said that they're still investigating to try to figure out where those documents are, whether they're missing, whether they were stolen, who m

i want to get back to what evan perez was just reporting out.at do you think of the decision that the 11th circuit on the classified documents found at mar-a-lago. >> well, it is seem to be clearly right. it was unanimous decision by three judge panel including two trump judges and they issued less than a day after briefing was complete it seemed to be a pretty clear repudiation of judge cannon's analyst, at one point they said she had completely disregarded one of the factors that should there-v played in her decision. they pretty much rejected any suggestion that a president has any personal interest in classified information. and they sort of mocked his inability to put forward evidence in the court that he had in fact declassified anything something that he responded to by saying he did it in his own mind. it is a full scale win for the department of justice that will now be able to conduct the investigation of the potential damage from the leak of classified information to an insecure location and then follow up with, if appropriate, crimin

cnn's evan perez joins us with more. walk us through what the new york attorney general is accusing trump and his kids and business of here? >> jake according to leticia james, the attorney general for the state of new york, she says the trump organization is a giant fraud. she says over the last ten years, the organization, trump and his three kids and a couple executives out company have been deceiving lenders, insurance companies and tax authorities. she says she is going after $250 million in ill gotten gains from this ten years of fraud and cancelling the trump certificate to operate in new york state and with that asking a judge to permanently bar trump, some of his kids as well as a couple of these former executives from ever serving as officers of companies in new york. this is a sweeping lawsuit jake, of course, you know leticia sk games is a democrat and his sons have taken to social media to accuse her of carrying 0 up a political witch hunt, jake. >> this is a civil case, not a criminal one so there would be

evan perez is in washington. what can you tell us about what happened in the hearing? >> reporter: it was about a two hour hearing. the judge made clear that she's thinking about appointing this special master. the justice department disagrees with that. they say that there is no need for appointing a special master. they pointed out that this special -- this separate team of lawyers that is not connected to the investigation has gone through these documents, has separated about more than 500 pages of documents that could have some kind of attorney/client privilege material. they have removed that. they have a procedure set up to review that information. she, however, seems to think -- she said in court, what would be the harm to have a third party come and look at these documents, not only for attorney/client privilege but she said that she -- this issue of executive privilege, which the former president says he still has, even though he is not president, something the justice department by the way is disagreeing with. she says that that is something that is not settl

so my colleagues pam brown and evan perez and kristin holmes were able to confirm last night that meadows gave to the justice department the same records he's already provided to the house select committee investigating january 6. so thousands of his text messages and mails will now be in prosecutors hands. things like texts with the former president's son as the capitol was falling under attack, many of these chats we're already seen, jim and poppy. but with cabinet members republican members of congress lawyers were talking to meadows as they tried to help trump overturn the election or try to get meadows get trump to get things under control which did not happen. so this grand jury, what we know is what is coming in here. they aren't going to get everything that meadow as had. and he's withheld a bit. trying to claim privilege. and it is possible that justice department could come back to try to get more from him later but this is a start and it adds to an astonishing sweep that we know of that the justice department is doing looking for evidence of possible crimes and even what was be

i want to bring in our senior justice correspondent evan perez. he's here as well.d it for a few minutes here. what sticks out to you? what are you seeing? >> well, the key parts of this obviously there are four names, two on each side and the special master. but i'll skip ahead to the parts the two sides are in clear disagreement on what exactly the special master is going to do. the headline part of this is that the government believes that the special master should not be able to look at classified documents, should not be able to decide what is executive privilege or is not, right? that, of course, is something that trump's legal team believes is very, very key. they want the special master be able to look at all of the documents. another key point of this agreement is that the government is setting a deadline of about five weeks for the special master to conduct this review of over 1,000 pages of documents. the trump team says they want three months. they believe that this could take about three months. again, pushing the deadline out from the trump team's side

evan perez is out front live in washington. i prefaced this as is this the butterfly flapping its wings. what could this ruling in mexico mean for other pro trump officials who helped him try to overturn the election. >> it's something you're going to see at least attempted in other parts of the country. we know this group, which is citizens for responsibility and ethics in washington, they have tried, and other groups have tried to disqualify other people including members of congress in georgia, in north carolina, trying to use the fact that they voted or they tried to overturn the election results to try to have them disqualified from office. those efforts have failed. in this case the judge simply said that what he did, what griffin did was essentially griffin. he cited that his involvement in the stop the steal movement where griffin talked about this is a war to keep former president trump in office. he cited the as a matter of fact that he seems to have no regrets about what he was doing. this is a unique situation that

let's go the evan perez this morning. >> good morning, erica. the trump team largely ignores a lot of the allegations that the justice department made in its bombshell filing a couple nights ago. they are saying it should not have been a surprise that there were classified documents found at mar-a-lago. they were considered personal and presidential records. i will read you part of what they say in the court fueliling. that the records contain sensitive information should never have been cause for alarm. they're saying that the justice department cannot be trusted to just look through the documents and sort out what may be presidential privilege, executive privilege, or at attorney/client privilege. they want to appoint a special master to look at the documents and set aside the things that may be considered privileged. so, we expect that this judge is going to take a look at this filing and really maybe ask some questions about what the trump team is not really addressing, which is why, when they received a subpoena back in may, to turnover all

>> sources are telling me and my colleague, evan perez, so far mark meadows has complied with the doj subpoena by turning over documents, the same documents he turned over to the january 6th committee. but as we know he turned over selective documents. there were hundreds of other text messages and communications he did not turn over. so this is not the end of the road. mark meadows is too critical in the doj investigation on january 6th. he was at the center of it all on that day. here's what cassidy hutchinson had to say, she was mark meadows' former aide. >> i remember pat saying something to the effect of mark, we need to do something more. they're literally calling for the vice president to be hung. mark responded, you heard it, pat, he thinks mike deserves it, he doesn't think they're doing anything wrong. to which pat said this is crazy we need to do more. >> that was a window into what mark meadows could talk about. he could provide critical testimony into what was going on in donald trump's state of mind. he was a high ranking official as the chief of staff. right now the doj

let's bring in cnn senior justice correspondent evan perez. just walk us through the ruling. what will this special master now do? >> alisyn, the special master that the judge says needs to be appointed is going to be responsible for looking at everything, everything that was taken from the search of mar-a-lago that happened a month ago. one of the things she talks about in her ruling, she says that essentially this person, this special master that the justice department and the trump team need to come together and find this person, is going to be essentially looking at all of the things while the justice department is going to have to pause its investigation, essentially, not being able to use any of these documents. she does say that the review that is being done by the intelligence community, there's a risk assessment that's being done, that can continue. she had indicated that she was leaning in that direction. a couple of things that jumped out from the ruling that she just issued, she says that she got a report from the justice department indicating their filter team, p

cnn's senior justice correspondent evan perez is following the investigation for us. so evan, this full inventory shows more than 48 empty folders with classification banners as well as some personal items mixed in with government documents. what exactly does this more detailed list reveal? >> well, that's exactly right. you look at some of the haphazard way seemingly haphazard way in which some of these items were being stored, mixed in with items of clothing and news clippings and magazines, you have classified information, for instance, 18 documents that were marked top secret. 54 documents marked secret. and 31 documents that were marked confidential. we'll take a look at just one box, for instance. item number two, it's labeled as. there's 99 magazine, newspapers, and press articles and other printed media, according to the inventory that was provided. there were two documents that were labeled confidential. 15 labeled secret. seven that were top secret. one of the things that really sticks out is the number of these empty folders. 43 in this one box, for instance

and with me now to share some expertise and insights, cnn's evan perez and the former federal prosecutor jennifer rogers. evan, let me begin with something the trump lawyers said. they tried to say no big deal. they argued this in their legal response. "the notion that presidential records would contain sensitive information should have never been cause for alarm." they're trying to say that what the fbi found and decided it needed a search warrant for in mar-a-lago was normal, that this happens, when presidents leave office this happens all the time. that they take with them secret, secret, top secret, top secret, top secret, top secret, secret -- i covered the white house for ten years. i checked in last night with some people who were in bill clinton's white house when he left, george w. bush's white house when they left. they said that's absurd, that those presidents never took anything like that with them. but the trump argument is pretty normal. >> it is absurd. you even heard it from karl rove who said these are not his documents. these were documents that belong to you and me, to

our senior justice correspondent evan perez is with us right now. so tell us more, evan. what else are you learning? >> wolf, this is raymond dearie. he is the senior judge who's serving as this independent third party, reviewing these documents that were seized from mar lago -- >> the special master. >> the special master. correct. he was somebody that trump and his legal team actually picked for this job. and he's calling their bluff on this question of whether the fbi planted evidence. he says they have until september 30th to list for him whether there were any items that he believes were not present when the fbi seized these documents. in other words, did the fbi plant evidence? of course, the former president was on hannity last night on fox news and he addressed this very issue. >> the problem that you have is they go into rooms, they won't let anybody near -- they wouldn't even let anybody into the same building. did they drop anything into those piles? or did they do it later? there's no chain of custody with them. >> wouldn't that be on videotape potentially? >>

evan perez is out front. what more can you tell us about today's hearing?, the skepticism that you heard from judge dearie is a result of the fact that in multiple times that trump's lawyers have had the opportunity, they've declined to say that the documents are actually declassified as the former president has been saying in social media in those interviews. he pointed out that the fact that right now all he has to go on is the fact that the government says and the documents that he's looking at will have classified markings on them. and if the trump team doesn't have anything to counter that, then he's going to have to go with that. he says, quote, i guess my view of it is you can't have your cake and eat it too. and significant enough today, erin, that in addition to this hearing that happened in brooklyn before this judge who is acting as a special master to review all of these documents, there was a separate filing by the trump team in the 11th circuit court of appeals in atlanta. in that court filing they, again, avoid the issue of declassification.

evan perez, kcaitlyn polantz. let's begin with the ruling, saying judge cannon was wrong and the justice department has a green light. what's different today? >> the justice department can now look at these 100 pages, these 100 classified documents that yesterday they were not permitted to continue investigating. and i think that's a huge difference for the investigators. obviously the impact here is potentially serious for the former president because the fbi, the fbi is trying to figure out who may have accessed these documents, is there a crime here and is there something they can bring charges on? that's something that is, you know, serious, it's ongoing. but for the former president, this smack down of this judge from palm beach who had really kind of given him more than he ever even asked for is really kind of stunning to read. you see them saying that, you know, he never really showed any kind of proof that had he possessory interest in these documents and raised the issue that after all this is about natio

evan perez is out front. until today and until your reporting, no one knew about this legal battle.t else do you know about it? >> the former president is trying to build a firewall around some of his inner circle. people who were around him, obviously, in those weeks after the election as he was trying to find a way to remain in office despite losing the election. and the justice department is trying to get testimony, and they're trying to compel some of that testimony from people who've already gone to the grand jury, who have asserted his claims of executive and attorney/client privilege. and this is now what is a judge here in washington is going to have to decide. now, we expect that the former president's going to fight as much as he can because these people saw everything. people like pat cipollone, his deputy also in the white house counsel's office. mark short, greg jacob who have already gone to the grand jury. and of course there's another white house lawyer who was scheduled to go in on september 2nd, and he has been postponed as a result of this fight that is playing ou

our senior judiciary committee, evan perez, helped break the story. the former president wants to block a grand jury from talking to his inner circle. >> these are some of the most important witnesses that prosecutors are trying to get information from and there's now a secret battle going on between the former president's legal team, who are trying to build essentially a firewall around them. we're talking about important witnesses like pat cipollone, who is the former white house counsel, his deputy, pat philben, who have gone into the grand jury in washington federal court and asserted executive privilege, at the request of the former president, saying there are certain questions they cannot answer. the justice department is asking for a ruling from the judge to compel them to answer the questions. we know this is obviously something that could have great importance for this investigation from the justice department. we know that how the judge resolves this question could really help the prosecutors get important information that could, again, help

evan perez is live at the courthouse in washington with the latest. so, they are set to appear. what more do we know about what will happen? >> reporter: well, erica, we already saw a short while ago pat cipollone, the former white house counsel under former president trump, he already appeared. he was met by tom wyndham, the prosecutor who is overseeing this part of the investigation. and they were taken up to the grand jury. we're still expecting to see pat patrick philbin who was the deputy white house counsel. the importance of these two witnesses is this is part of the january 6th investigation that is looking at people beyond the rioters, beyond the violence that happened over at the capitol. these are looking at people -- this is looking at people, the former president, people around him -- who were involved in trying to organize these fake electors, the whole effort to try to maintain trump in the office of the presidency despite the fact that he had lost the election. and one of the things that we don't know right now is, you know, what sort of questions they're going t

evan perez is out front.ment is planting evidence in mar-a-lago, we can joke about it, but this is deadly serious. so what does the judge want from team trump? we huts this allegation out there and the judge says what? and what if trump didn't provide the evidence that the fbi planted this stuff? >> he's given him a deadline, erin, of next week, september 30th for them to come up with a list of items that they would say were not actually seized in the raid, in the search of mar-a-lago that happened a month ago. you know, this is now -- the lawyers are going to have to file an affidavit under oath, obviously, and they can't lie. and of course the former president has been saying this stuff since almost after the fbi searched mar-a-lago. the fbi, people who were participating in the search have received threats. the fbi has had to take security measures to deal with this partly because of what the former president has been saying, saying that the fbi would have planted evidence in this search. so now they have

back to the table with evan perez and elliott williams. just explain to the viewer who might not be following this on an hourly basis like we do that you have an appeal to the 11th circuit court of appeals, but until that is decided full speed ahead before judge dearie. >> the 11th circuit, where i was a law clerk many years ago, can step in and put the whole proceedings on hold and say, you know what, we have this now. please don't move forward. until that point, this is with the court that's hearing it and i think judge dearie is proceeding, as well he should, proceeding as if nothing has been put on hold yet. >> as that plays out, i want to read what was just mentioned, trump publicly said he declassified the documents his lawyers have never argued, they have never argued that he declassified the documents. judge dearie says prove it. prove it. it's a key issue in this case. please show me the evidence. as i review these documents, prove to me i should defer to donald trump and say i should defer to donald trump, disclose specific infor
