cnn's evan perez is outside the courthouse for us. , how are both sides going to be making their case? >> reporter: boris, we expect that the former president is going to be making his case to try to delay this trial as long as possible, certainly after the 2024 election. his team is asking for a trial date in april of 2026. jack smith, the special counsel, he has asked for a trial to happen in january of next year. of course, judge tanya chutkan is the one who is going to make the decision and she's already signaled that she believes that this case and the importance of this case takes precedence over the former president's political campaign, which of course is ongoing and it is influencing some of what is happening here. the former president is facing a four-count indictment in this case, it's a narrow case, much narrower than the one you see down in georgia where katelyn is, and that was designed for a reason. he's charged with defrauding the united states, obstructing congress and of course disenfranchising voters in those states

let's begin with cnn's senior justice correspondent evan perez. evan, what more are we learning right now about this indictment of former president trump. >> wolf, one of the key things that the special counsel gets into in this 45-page document here, this indictment, is describing the former president and his state of mind, that he knew he had lost the election and still continued to peddle these lies and then entered into a number of conspiracies to defraud the united states, to obstruct and impede the january 6th congressional proceeding, which, of course, is the ceremonial proceeding, by which the official votes are counted in this country. and then a conspiracy against the right to vote and have one's vote counted. those are the three conspiracies that the special counsel is alleging the former president led, along with some co-conspirators. as you pointed out, we have four counts that are listed here in this indictmen

swinging over to the federal case, the federal side and evan perez.does the trump legal team want and what do we expect the special counsel is looking for today? >> well, phil, what they're trying to do is buy some time for the former president. as you know, he's running for office, he's running for president again, and he is trying everything he can to delay all of these proceedings before he has to stand before the voters in november of 2024. they've asked for an april 2026 trial date. something the judge, judge tonya chutkan has indicated that she is inclined to try to set a trial date at this hearing today, perhaps as soon as today. and we know that jack smith, the special counsel, he's asking for a trial in january of 2024. now, the former president's legal team is saying, look, we're buried under millions and millions of pages of documents that were produced as part of this case, and of course, his other case. this case is very narrow in comparison to the one that was brought in georgia. the one that kaitlan is covering. he's facing four charges

. >> i want to go our senior justice correspondent evan perez from outside the federal courthouse herewashington where the former president made his initial appearance this afternoon. evan, walk us through what happened during trump's arrest and arraignment and where this case goes from here. >> reporter: well, wolf, this was about a 27-minute hearing. the former president we heard from him just a few times. he said his name, donald j. trump, john, he said, to the judge when asked to state his name. she asked him whether -- she gave him -- read him his right to remain silent and decide him whether he knew, obviously, what was going on in court, that he had not taken any drugs or alcohol, and spoke very quietly. the former president -- there was a few times are where he looked directly at jack smith and jack smith also looked at him during the 20 minutes or so that he was sitting it there before the magistrate took the bench. then, of course, the moment where he stood up -- where he stood and said that he -- that he was pleading not guilty, wolf. of course, we know now that the judge he

let's discuss this with senior justice correspondent, evan perez, and former nixon white house counseldean. evan, i want to start with you. what are you learning from this filing now? it is interesting that this showed up at this particular stage in the investigation. >> what is happening is that prosecutors are trying to have the judge overseeing this case pay attention to potential conflicts, so that they see exist because stan woodward, who is a lawyer, paid for as you pointed out by the former presidents political operation, he is representing walt nada who is the former presidents aide, a close aide who is also a co defendant in this case. and, he is representing a couple of witnesses who may be called to testify at this trial. what emerges in this filing, it sort of gives an explanation of why prosecutors added to those additional charges against the former president, and against these other aides. they say that this information came from this i.t. worker, his name is -- and he was also represented by stan woodward, the same trump funded lawyer. after he made those initial statem

let's go now to cnn senior justice correspondent evan perez in washington for us. an, what does team trump want to do, and what are we expecting the special counsel to ask for. >> we know the former president doesn't want the trial to happen any time soon. his lawyers have suggested a trial date of april 2026. the special counsel jack smith, his team has asked for a trial as soon as january. that's in just a few months from now. we expect that judge tanya chutkan who has already signaled that she wants to set a trial date and she wants -- she believes this should go on very soon. we expect she is going to probably set something for next year before the election. that's certainly all of the signals we've gotten from her. of course, the former president's legal team has pointed out that he needs time to get ready for such a trial in part because he's facing three other indictments including another one from jack smith down in south florida where he's facing charges related to the classified documents retrieved from mar-a-lago. the former president is facing four count

>> evan perez, thank you very much. we both thank you. th thank you at once. >> evan, thank you. >> thank you. >> love you guys. >>> now to those six unnamed co-conspirators. cnn has been able to identify five of the six. they are not named as they are not charged with any kriecrimes, but that doesn't mean they are out of the weds. cnn's jessica schneider has more on this. if they are charged what kind of charges could they be facing? >> they could ultimately face any number of charges and it is likely that they could be similar to the charges that donald trump is face. he's facing conspiracy to defraud the united states and charges related to obstructing the certification of the election so maybe those are some of the charges these co-conspirators could face. special counsel jack smith has been very clear that this investigation continues. so it's likely that at least some of these six co-conspirators could face charges or at the very least maybe they're mentioned in the indictment under co-conspirator, one, two, three, et cetera, just to

cnn justice correspondent evan perez with the details on the court appearance tomorrow, evan?we expect that the former president is going to come to court here in washington. he was offered the option of doing it by video link. basically, he could do this by zoom from his club in bedminster, new jersey. the security people have encouraged the former president to do it that way. obviously, it's more for everyone including himself and of course, the security of the court, but it appears that the former president is likely to take the option to come to court, and so what we expect is some time tomorrow afternoon he's going to present himself in federal court here in washington. he's going to be formally arrested. he's going to meet with a federal magistrate who will read him the charges and we may have the arraignment all in one hearing as a way to do this more efficiently. obviously, this is going to be a bit of a mess here in washington at 4:00 p.m. and the former president has a golf club in northern virginia. so all of this now is triggering a security meeting among the secre

evan perez is outside the alfred e. pettyman courthouse where this went down. what a morning. >> reporter: what a morning, dana. this got really heated very, very quickly. the prosecution, as you know, was asking for a trial in january, which the judge immediately said was too soon, but they laid out that they had provided about 12.8 million pages as part of the discovery and said only 47,000 pages were really key documents that the defense would need to prepare for trial, and, of course, that prompted a very impassioned response from john lauro, the lawyer for the former president. they said this was an absurd and ridiculous plan by the prosecution and says this is a request for a show trial, not a speedy trial. that's where judge tanya chutkan finally had a little bit of enough of what he was doing there and she said let's take the temperature down. she said i understand m lauro, but you are not getting two more years. in the end, as you pointed out, she decided on march 4th, 2024, which is one day before super tuesday. what this really means is that, you kno

cnn's evan perez has more on this. back at it, evan.k to me, what are the next steps for donald trump? walk us through what's next. >> reporter: well, kate, the judge who is overseeing this case who is going to be overseeing this case, judge tanya chutkan has already set forth a very aggressive schedule. she has scheduled this hearing on august 28th and has already told the two sides that she wants them to provide breiefs i seven days laying out their plans for a trial. at that hearing on august 28th she is going to set a trial date and of course, you know, we know that it may not be final, but she obviously is planning to move this case along. this is absolutely a completely different picture from the one we saw in the southern district of florida, which, let's just say, has been a lot friendlier to the former president and his effort to try to keep these cases from going to trial before the 2024 election. in that case, you know, the judges there allowed walt nauta, one of the former president's co-defendants, to stretch out arraignmen

right now, joining, us senior justice correspondent, evan perez, and chief law enforcement and intelligence analyst, john miller. also with us, former federal prosecutor, jean rossi. and national security attorney, bradley moss. i want to get right to evan and john on the breaking news we're following, a texas woman charged with threatening to kill the judge overseeing donald trump's election interference case. evan, this woman is in texas, what are you learning? >> wolf, she made a threat. this was a voice mail she left in the chambers of judge tanya chutkan, overseeing the election subversion case of the former president. this threat, according to authorities, she leaves a threat that says, if trump doesn't get elected in 2024, we are coming to kill you. she goes on to make additional threats. she also made threats to kill congressman sheila jackson lee. all democrats in washington, and members of the lgbt community. there's, obviously, a lot of threats like this that periodically make their way elected officials, judges, of course we saw the very serious assassination attempt of a suprem

evan perez joins me now to break this down. evan, we are now hearing from trump himself. he's going to turn himself in on thursday. what do we think that's going to look like? >> well, kaitlan, it's going to look unlike any of the other three times the former president has had to surrender and be arrested and processed as part of facing charges for various crimes. and, you know, he's been given a lot of deference both in manhattan and also in the two federal indictments, where they processed him and they did everything as quickly as possible to get him in and out. in fulton county, they're bringing him to that county jail, the one you just saw there on your screen. it's actually been under scrutiny by the justice department for some of the conditions there for the prisoners that are held there. so, the former president is certainly going in there. he's going to be treated, according to the sheriff's office down there, he's going to be treated like anybody else. so, they're going to fingerprint him. they're going to book him. they're going to take a mug shot, which we may

evan perez joining us now. a lot of moving parts here. where do we start? is a very crowded calendar and as you pointed out, the judge, judge tanya chutkan, already chose march 4 as the day that her trial, the trial here in washington, will get started. and that is a day before super tuesday and what we're looking at is given the prospect that the prosecution has said that their case will take four to six weeks to present, that means that the former president will be sitting in a courtroom here in washington not on the campaign trail during those key periods there when other states are up for grabs, other delegates are up for grabs in the republican nomination. that is a huge imposition obviously on a political campaign and the judge really addressed all of that saying that the public interest to have this matter resolved as soon as possible is really the thing that is driving her. she said from the bench that setting a trial date does not depend and should not depend on the defendant's personal or professional obligations. and of course, you know, for the

evan perez is outside of the federal courthouse in washington, d.c., and he sprinted out of the courtroom and how did this unfold? >> well, boris, this was quite a heated hearing from the part of the former president's lawyers who were pushing for a much later court trial date. they said that the former president is not going to be able to get a fire trial if he is forced to go to trial in the next few months in part, because they are buried by yons and millions of pages and is lawyers don't have classified communication to go through the information. the judge pushed back strongly and said that the public has an interest or a right in the prompt and efficient resolution of this matter. she said that march 4th for the trial to get started. now, that is right before, i believe it is right between so, that brings up the political question for the prosecution, because it is going to be four or five weeks of trial according to the defendant where he may have to sit here at federal court while he is on trial in the case. at the judge, the judge tonya chutkin pushed back strongly when the forme

let's go to our cnn senior justice correspondent, evan perez. evan, what's the latest on this case, an argument about the dates, what else after trump surrendered? >> we expect that the former president has brought on a new attorney, steve saydel, then we're gonna start seeing a lot of legal activity pick up from the former president. for instance, one of the things we expect that he's going to do is try to remove this case from the state court, bring into federal court. there's a couple of advantages there. a bigger wider jury pool, but eventually he's going to argue that this case should be dismissed, that he should be immune to all of this. and so all of those are going to be arguments that are going to be heard in the coming months. you also saw, already, some activity from his legal team. they are trying to sever at least part of the case because at least one of the former presidents codefendants ask for a speedy trial. so that trial date has been set for october of this year. that's not with the former president wants. he wants a trial date

. >> we go to the courthouse with evan perez who is tracking the case. well, the hearing is still under way. it just got under way a little while ago, boris and rahel. what we have here is the first of the number of proud boys who are going to be sentenced in the coming days. joseph biggs is the organizer, and was an organizer with the group in florida. he entered the capitol, and he said not with violence, but he did enter the capitol, and right now, what the judge is saying that the conduct of the members of the proud boys that day it was not spontaneous aggression, and were in his view helping to push the mob into the u.s. capitol. and we have heard testimony from the officers who were on the recei receiving viving end, and one of them said, i was not sure i was going home for first time in my life, and that officer said that she was not sure that she would be going home, because of the violence carried out. as you pointed out, five of the members will be sentenced in the coming days. the prosecution has asked for at least, at least 30 year for each o

cnn's evan perez joins us now. evan, i want to start with the federal case, what you were watching in d.c., the delay. how will it work when trump or his legal team try and appeal that date or shift that march 4th date? >> reporter: yeah, phil. look, i think she is not very patient at all with the attempt to try to delay this. she right off the bat told the defense that she didn't believe they were going to get two years. she didn't think they needed two years. they had plenty of time to be able to prepare. they were complaining about millions of pages of documents that were turned over by the government they say they need to prepare. john laura, the proposal from the government was ridiculous and what the government was trying to do was a show trial, not a fair trial. in the end, she asked him to turn the temperature down. then she chose march 4th. and what we expect is that, you know, they may try the former president may try to delay this in some way. perhaps by trying to ask her to appeal the trial date. it's no

evan perez is "outfront." so, evan, we'll get to jack smith here in just a moment. but this breaking news that trump will turn himself in thursday after we learned about his bond agreement. what else can you tell us about these negotiations today for trump's surrender on thursday, and what are we expecting to see? >> well, brianna, the prosecutors down there in fulton county, georgia, wanted this negotiation to be handled in person. and so that's what you saw today. you saw the legal team for the former president arriving there at the government center to hash out the details of how the former president is going to turn himself in. and to get the $200,000 bond, which was negotiated and approved, by the state judge that is overseeing this case. as you pointed out, the first time that he's having to put up cash, essentially, to have his freedom while he awaits trial. in the previous cases, the two federal indictments, the one in new york, he was released on his own recognizance. he had a lot of restrictions in all of those cases. but this one has the most extensive se

let's begin with evan perez out front live in washington tonight. evan, how likely is it trump could see his case severed from his other codefendants, and what would that mean for him? >> well, it would mean he'd not have to go to trial in two months, as you just pointed out. and the former president's lawyers have some good reasons. they laid out some good reasons to the judge why he should sever the case. his lead lawyer in atlanta he says he has a trial in another case in florida that will happen soon and that one will conflict with the former president's ability to get ready for such a trial. he says there's no way donald trump could be ready for trial by october. as you know there's a couple of other defendants that have already moved to do a speedy trial in part because they want to be separated from the other defendants. so for those reasons it's probably very likely that the judge will allow the serving of the former president's case. and of course, erica, one of the things we're waiting for we fully expect like mark meadows donald trump will

in the mar-a-lago federal case and what we're learning from a few filing, evan perez joins us with that. this is really fascinating. is the special counsel saying? >> well, for the first time, the special counsel is providing some details as to why they believe there was this scheme involving the former president and a couple of his employees to delete, to try to delete surveillance video from mar-a-lago and why they added charges as part of the superseding indictment we saw in the last few weeks. according to the filing, they say that this trump employee, an it worker -- >> this is employee number four in the original indictment. >> that's right. trump employee number fourm. according to prosecutors, he at first said he knew nothing about any conversations about the surveillance video and it appears, after he ditched his trump-funded lawyer and got representation from the public defender, he changed his story and he provided information to prosecutors according to this court filing and he implicated that the former president, walt nauta, his aide, as well as carlos de olivera were part

here with me is evan perez and legal analyst carry cadaro. i will start with mr. morgan in atlanta. what should we be looking for today as the former president goes into this courthouse for his arrest? >> mr. trump will be treated just like any other defendant, who has an arrest in fulton county. he will go to the jail, which is notorious. it has been under court order many times. it's in a very rough section of atlanta, georgia. he will be escorted in. he will be fingerprinted. they will take his mugshot and be processed. i if he will spend much tomb in there, but other than the fact that his bail has already been negotiated, he will be treated like any other inmate and then released. >> evan, i want to play what the former president said to the former fox host tucker carlson in anticipation of tonight. >> i got indicted four times. all nonsense. it's horrible when you look at what they are doing. >> the indictment suggests the opposite of that. as mentioned, the allegations are incredibly serious. just like january 6th on the federal level, this is on a state level. the allegation

we have our evan perez here in studio with us. evan, to you first.let's talk about these charges that trump is facing and then we'll kind of go wack to something that pence says. but take us through these charges. >> we know theetz four charges, which are the ones that frankly match what he was warned about in his target letter, and really what prosecutors do in this 45-page document is they lay out that the former president has every right to challenge the election results, to go to court and challenge those results and to even lie about it. what he does here, according to prosecutors, is he engages with these co-conspirators in this conspiracy, this series of conspiracies. one of them was to defraud the united states on the ability for the electoral system to count these votes. the conspiracy to impede the ceremonial function of congress to certify the vote. and then of course to -- the conspiracy to deny the right of americans to have their votes be counted, their lawful votes be counted. and so that's what prosecutors are charging him here for. a

and that's where we begin this hour with paula reid and evan perez. what can we expect to unfold in that courthouse out of the public's view? >> once the former president gets into washington, he will be brought into the federal courthouse. we're probably not going to see much of him before he finally gets into the courthouse. he will be processed by the u.s. marshals as they do with everyone who is arraigned. he will be under arrest. and then he will be brought in at 4:00. the we expect the judge is going to read him the four charges that the formerer president faces. and we expect also that he will be given a chance to enter a plea. this is also likely to be an arraignment. so we anticipate that the former president is going to plead not guilty. then the hearing will probably be over very, very quickly. this is something that the courthouse has been doing a lot. several hundred rioters from the january 6th riot have faced prosecution in this courthouse. today it's business as usual for the courthouse. we know there was a sentencing earlier today for

here to share their reporting is paula reid, evan perez and cary cardaro. i want to set the table of this conversation from the heart of the indictment at the beginning. it reads these claims were false and the defendant knew they were false. tified repeatedly his claims we urue, often by the people on whom he relier candid advice on important matters and who were best positioned to know the facts and he deliberately disregarded the truth. >> this gets into the former president's state of mind. it's something you're going to hear from the lawyers over the last 12 hours or so from them that how do they know that he didn't believe this fraud. he's continued to make the claim that there was fraud in the 2020 election. it's probably one of the best things he has done for himself frankly. he's stuck to that script. and it is a challenge. it is going to be a challenge for prosecutors. what they are going to do is what you saw in that indictment, where they describe and literally list all of the different people at the former president has relied on that he picked

let's get right to cnn senior justice correspondent evan perez who is following all of the latest developments. evan, how do we expect to get word if and when this indictment is handed up to the judge from the grand jury? >> well, jake, we have a team inside of the courthouse. they're watching the magistrate proceedings. the grand jury votes on an indictment and the foreperson and the prosecutor hand up the indictment to the judge, often what they do is you don't know the name of the person, but they have the initials of that person who is being indicted is read in open court. today could be a lot different. we certainly have seen in for example in the mar-a-lago case in miami, where they did it behind the scenes, away from reporters who were watching every single court proceeding. so that could happen in this case as well. wit we do know that the grand jury has left but the foreperson stayed behind. we have not seen that person leave the courthouse. so, that is one indication possibly that there is still more action to be taken by the foreperson on behalf of the grand jury and prosecutors in

also here to share their political and legal insights, evan perez, and former prosecutor for the southern district of new york elie honig. i want to start with carry in terms of actually digging in to the indictment itself. two of the 98 pages, we have seen 91 charges against the former president of the united states and just a little more than four months. it's easy to get things lost given the scale here. this case specifically, paula hit on that point. what does it mean going forward? >> i think one of the most interesting things about comparing this particular indictment to the one that is most similar on the federal side, which is the special counsel's charges related to the election. it has to do with the fact that the da named many of the coconspirators. what that does and how it's connected to the rico charge is it enables this indictment to really tell the story of the conspiracy that is alleged. which under the law she asserts is a violation of the georgia racketeering statutes. by seeing all of the named coconspirators, it much more clearly than the federal indictment, it enabl

is cnn's evan perez, also the washington correspondent of the atlanta journal-constitution, tÉa mitchelld -- is back as well. tour former house judiciary special counsel, and then president trump's first impeachment trial. this is happening in georgia, other states are implicated here. tÉa, george is unique for a number of reasons. not the least of which is that you have got republicans who were really in the -- also those who are solicited specifically. this is brian kemp, it's brad raffensperger, to name a few. >> it's interesting. i actually started out in atlanta, the first person that i saw at the courthouse, liz gabriel sterling arriving for his interview with the grand jury today. we don't think that raffensperger was called for the grand jury, but it's likely that if the sun goes to trial, raffensperger could be called. our former lieutenant governor, i know it can even go up to brian kemp. if you read through the indictment there are a lot of republican state senators -- to take action that the district attorney believes was illegal -- >> or that they were lied to in these legis

let's get right to evan perez. trump is scheduled to be arraigned tomorrow. what are we expecting to happen, and what do we know about a possible timeline for a trial? >> reporter: jake, we expect this to happen very quickly. the former president is going to come into town. they'll make him -- bring him to the federal courthouse very quickly from the airport. and then he'll be processed very, very quickly before he has this very short hearing before the federal magistrate there. he's been fingerprinted and processed more recently in the case of florida. all of this should happen very quickly. and then we expect that the judge will start setting up a timeline, which the justice department wants to happen, obviously, before the 2024 election. something that i think is very, very possible. >> what we know about the judge assigned to hear this case? because i believe she's had some pretty strong dealings with january 6th defendants. >> reporter: she has. and look, the judge is a jamaican born obama appointee. she's been on the bench since 2014. like a lot of the

we'll talk to reporters here, legal analysts cara cordero and also evan perez, our senior justice correspondent. also in atlanta, former u.s. attorney michael morse. michael morse, let me start with you since you are there in georgia. what do you make of the developments we've seen so far and paint a picture of what it looks like down in georgia as all of these co-conspirators and as we see the big defendant come down on thursday? >> good morning. glad to be with all of you. it's unique here in the state right now, security is obviously at an all-time high. the secret service has been on the ground for some period of time in coordinating and preparing ultimately for the former president to surrender himself. to have this number of defendants in this type of case, these sort of high-profile, vip defendants is a little unusual. it's not the only time it's happened in fulton county. they're reporting to a jail which is not at the height of its game, if you will. it's not a place where you'd want to be. there have been a number of problems there it's probably a humbling experience as they come in.

here to share their insights, evan perez, andrew mccabe and elliot williams.s great to have all of you here on a day when we are digesting about potential movements in georgia. elliot, where do you think the next couple of days are going and also as we piece this together in the broader theme, the broader story of all of this with it being potentially the fourth indictment how this case lines up against the others. >> it seems like we will see an indictment in the next couple of days, certainly the grand jury is meeting as we know today and tomorrow and hearing evidence. now, the way it works in georgia at least for this case there was a special grand jury that made a recommendation to the district attorney and now she's presented the state's attorney now she's presenting this evidence to the real grand jury, the full grand jury to bring charges. it appears not just the former president but a number of other people connected or around him may be brought in here. what's striking and notable is the possibility of racketeering charges in effect arguing that the d

here to share their insights is elliot williams, evan perez, katelyn polantz and former u.s. attorney michael moore, who is also joining us. michael, i want to go out to you really quickly first and talk about what trump's vender might possibly look like. you're down there and know how all that works. this is both ordinary and extraordinary in a lot of ways. >> it is. i'm glad to be with you. typically when somebody surrenders, they go to the jail and there's a process and give background information. there's the usual fingerprints. you have seen it on tv. a mug shot is taken. i really think probably the sheriffs bravado is misplaced. i hope he will rethink how he's doing this idea we're going to treat a former president because of all the security can concerns and everything else, we're going to treat the former president like everybody else. they are not many times the courthouse has been cordoned off. he's already being treated different ily. the mug shot, there are more pictures of the president you could want, so there would be nothing compelling him to have a mug shot.

evan perez, thank you so much. another court loss for trump wingman rudy giuliani. the disgraced lawyer making headline after headline after losing a defamation lawsuit from two georgia election workers whom he smeared during the 2020 election and its aftermath. giuliani singled out these two civil servants, ruby freeman and shaye moss, falsely accusing them of tampering with ballots. here's a reminder of just some of the deranged claims he made. >> tape earlier in the day of ruby freeman and shaye freeman moss and one other gentleman quite obviously, surreptitiously passing around usb ports as if they're vials of heroin or cocaine. i mean, it's obvious to anyone who's a criminal investigator or prosecutor they are engaged in surreptitious illegal activity, again, that day. and that's a week ago and they're still walking around georgia lying. they should have been -- should have been questioned already. their places of work. their homes should have been searched. evidence of ballots. for evidence of usb ports. for evidence of voter fraud. >> those comments were blat
