evan perez, thank you so much. let's go to manu raju on capitol hill where i'm sure this report is having a huge effect. this report politically, didn't have to do this legally i suppose, but it is one of the reasons why they decided not to prosecute. politically, the report hones in on then vice president biden's age, his inability to remember key events, both when he was vice president and as president. are any democrats concerned about the politics of this? >> well, they've been concerned about biden's age and vulnerability for some time given that poll after poll has shown that being a major issue across the country. in the aftermath of this report, there has not been much democratic reaction so far. in fact, the top democratic leaders chuck schumer and jeffreys in the house, neither have commented. schumer declined to comment about this. we've heard from some other rank and file democrats who have been walking through the senate, been asked questions about reporting, specifically concerns about biden's mental

evan perez is there.e our viewers a sense of what the significances of this particular day in court. >> reporter: this is all about the classified documents and the classified documents that are relevant to donald trump's trial. right now that trial is set for may, but it is unclear if that date holds. right now, what the former president and his lawyers are doing is meeting with the judge , discussing some of the documents that are at issue. in some cases the special counsel, jack smith, is arguing that they should not be allowed to see the documents themselves. they should be able to see only summaries of the documents and looking for access to some of those documents is the codefendants of the former president. this is a hearing that has been going on for about three hours. we expect that the former president will be in their for another hour or so before the special counsel government get their turn to make their arguments for continuing to restrict the access of some of these documents. we are talkin

now, cnn's evan perez is outside the federal court for us in pearson, florida. ten is also in west palm beach. evan, first to you. how long have they been inside? any sense of what's happening? white smoke? black smoke? what can you tell us? >> reporter: there's a lot of smoke here, john. but the former president has been in the courthouse now for about two hours. he's probably going to be in there, we anticipate, another couple of hours. and what this hearing is going on behind closed doors, it is a closed door hearing because it has to do with some of the classified documents, some of the classified information that is at issue in this case. some of the documents that prosecutors are trying to withhold from some of the defendants in this case, of course not only donald trump but also his codefendants, walt nauta, carlos de oliveira. there are documents that are classified that the government says are so classified, so sensitive, that they're only providing summaries of some of those documents. so, what the lawyers are arguing for the former president, they're a

evan perez is out front to start our coverage tonight. evan, this is a crucial moment. this is the beginning here of what could be a lot coming from the supreme court. what are you expecting? >> reporter: that's right. look, the stakes are high for the former president. obviously everything rides on this case. there's a number of other states, as you pointed out, that are waiting in the wings to see how this one turns out. the former president's legal team, we're expecting they're going to make comparison between this, this effort to remove him from the ballot, to venezuela where the authorities say they have disqualified an opposition candidate. they're going to compare that to what is happening in this case. of course, as you pointed out, this is a case that none of us -- none of us really thought was going to get this far and it got here just bir the thinnest of margins. it's a 4-3 vote by the colorado supreme court. all democratic nominees on that court and you will also remember that the lower court judge had declined to remove the former president from the ballot,

evan perez, keep us posted. if you hear anything new. thank you so much for being there. sara?and that's of course not the only case happening in donald trump's world today. the deadline for his legal team to ask the supreme court to block a federal appeals court ruling that she's not immune from criminal prosecution in the january 6th case. cnn's paula reid is with us now. paula, i'm assuming they're going to file an appeal because they said they would. what happens now? how long do they have? where are we? >> reporter: that's right. today is the deadline for them to ask the supreme court to intervene in this case. and we do expect that they will make that filing at some point today. and here they're asking the justices to intervene on this question of whether presidential immunity should shield trump from the federal election subversion case brought by special counsel jack smith. trump has lost on this issue at the trial court level. and then last week, the d.c. circuit court of appeals also handed down a pretty robust opinion rejecting this argument. so, today he is expected

want to go to our senior justice correspondent, evan perez. evan a judge had just released this former informant. so why was he rearrested? >> well, that's one of the things wolf that is so strange about this case. the justice department obtained a new warrant for his arrest from the judge that is going to oversee this case eventually in los angeles, alexander smirnov is charged with lying to the fbi and falsifying documents. but those charges are actually filed in los angeles he was arrested in las vegas where that detention hearing happened just a couple of days ago and where that judge decided to release him, saying that the political ramifications and all the issues that the justice department had raised were not sufficient to keep him detained. i'll read you just a part of what the lawyer said to us today. he said, despite judge, outbreaks prior ruling, denial of the state request, and mr. smirnov and prior release from custody on the morning of february 22. mr. smirnoff was arrested for a second time on the same charges. and based on the

we want to go straight to evan perez who has an update on a key story that we've been tracking for quite some time. evan, bring us up to speed on this special counsel's report regarding president biden's handling of classified documents. >> reporter: yeah, we just received this report produced by special counsel robert hur . 345 pages in all, and it details the mishandling of classified documents by the president of the united states. and the bottom line on this report, obviously, the most important part of it is the first line where he says we conclude that no criminal charges are warranted in this matter. he goes on over 345 pages to describe the various ways in which documents were mishandled , including the fact, they say, that the president willfully retained classified documents after he left the vice presidency, that he kept documents in a home in virginia that he was renting at the time, that during a period thereafter he was writing a book and he shared classified documents with a ghost writer who was helping him produce one of his memoirs. during that time, classified documents

our team of reporters is standing by here evan perez, live in fort pierce, florida, or trump appeared in court today and nick valencia live in atlanta. so evan, let me start with you. i want to start with a trump's immunity appeal because that came late today obviously, he wants a supreme court to take this up. when could we hear from them in this case >> well, the pressure will be on the supreme court to say immediately, erin weather should the former president gets to have a pause on the proceedings because obviously the way this appeals courts structured its decision is order. this was set to go back to the trial judge so that she could resume the effort to prepare for trial as soon as possible. so now, what trump needs is for the supreme court to come in and say that there is going to be a pause at least for them to hear from the special counsel from the government whether this needs to be paused further and off-course weather, the former president gets to use all of the parts of the appeal, part of this is the former president is trying to buy time perhaps spend another few weeks
