evan, let me start with you. the governor covering a lot of ground. >> yes, as you mentioned, the number of hospitalizations and intubations and infections are down, but that death rate slightly up. 10 more than yesterday. this press conference was about exploring the existing tragedy here in new york and then also into making the nation aware of potentially a new tragedy. the governor saying that they've gone through the numbers here and found that the hardest hit communities in new york have been minority and lower income communities, which is a story that's all too often told in disasters, the governor said. and he's trying to correct that by adding a ton of testing in lower income communities through churches and also access to ppe in those communities. so that's the goal of trying to correct the tragedy that we know about. but then he mentioned again something he talked about which is the potential of this new potential affect of covid on the youngest people in the community. infants, toddlers. speaking of t

our evan mcmorris-santoro is there walking along with the protesters.give us a sense of the scene, evan. >> reporter: hello from west 16th street in manhattan where i'm walking with a group of several hundred protesters, very peaceful protest, but very impassioned. people here really trying to speak about that injustice that they see in the world. one of the more remarkable events from today was as they're walking against traffic, drivers in the street honking their horn in solidarity leading to really big cheers from the crowd. now, this all began in union square earlier this afternoon with a small group of protesters. it just grew steadily throughout the afternoon and then eventually set off on this march. there is a police presence here, but they're letting the crowd sort of walk down these streets, march along, and as i said, utterly peaceful but very, very passionate about what they're trying to talk about. honestly, it's a scene that goes from very emotional talking about some of these incidences of police violence that is really driving this move

cnn's evan perez joins us. evan, the swings back and forth in this case have been remarkable.ll over under bill barr just a few days ago. what happens now with this judge's ruling? >> well, jim, we now have to see what the judge exactly is going to do. for now, at least, he's going to open the door to allowing third parties, people outside of the justice department, outside of flynn's legal team, to essentially comment on what should happen to michael flynn, and these 16 former watergate prosecutors sent essentially a letter, a memo to the judge describing what they think he can do. they said he can actually disregard the justice department's move to dismiss charges. and they draw direct parallels to the watergate controversy. i'll read part of it of what they said to the judge, and it says, if ever there were a case where the public interest counsel the court to take a long, hard look at the government's explanation and the evidence, it is this one. so for now, the judge says that he's going to lay out a timeline to allow people to -- outside parties to essentially provide am
