juliette, i want to start with where evan, the latest updates we got from evan, which were that the suspect who we have reported is deceased, was a u.s. citizen, was using a truck, an f-150 was used in the attack that had texas plates registered in texas. and we don't believe he did not own the vehicle. he had rented the vehicle through some form or fashion, and fbi officials, investigators are now looking at potential associates. what's your takeaway from kind of those updates where things stand right now? >> so the focus, if the reporting is accurate in terms of a u.s. citizen, is going to close off issues regarding border or anyone coming in to plan this event that doesn't get to the ideology. u.s. citizens can be attracted to foreign ideologies, foreign radicalization, as well as domestic. but what that does tell us is that there's a footprint here that is going to. disclose. a any potential ties, what were motivating factors? why is the fbi sort of making a judgment call that this will start off as a terrorism investigation and and what kind of planning occurred so that footprint reall

but i think, um, evan is absolutely right. they are really racing now to be able to do to take as many steps as they can before that identity of the subject gets out, because that gives them it gives law enforcement a little bit more freedom to move, to do some things covertly, to show up at people's houses who they want to talk to without those folks expecting them to be there, things like that that can give them just a little bit of an edge in an interview or an interaction that might lead to important information. um, it's highly likely that this person left behind a trail of activity in his personal life, in his internet searches, on his electronic devices. so you want to they want to do everything they can to locate all of that evidence as quickly as possible, obtain search warrants for locations and vehicles and places where those things might be held, and then to exploit that, that those items for intelligence purposes very quickly. because again, the race here is to find out if this person was working with or planning

i want to bring in evan perez. also with us is cnn's tom foreman. evan, what are you learning? >> well, one of the things we know right now is that the pentagon is going to have to explain a little bit about this, because we're told that this person, the suspect, brianna, is a former member of the u.s. military. we've asked we've reached out to the to the to the military, to the pentagon for some more details about their service. but that is also adding to the complex picture of this, of this suspect. we know that the fact that there was an i.s.i.s. flag obviously leads the fbi to believe that there was some kind of radicalization that happened. and so that's perhaps one of the questions that will be addressed here by the law enforcement that is there. obviously, the fact that there were multiple locations where there were additional explosives, who put them? there was this person acting alone or did they did they put them there themselves, or did they have additional help from someone who placed those explosives? what was the overall larger plan here? it's clear that the vehic

our evan perez is joining us by phone. evan, what more can you tell us about this?> well, fred, we had anticipated that jack smith would be leaving soon. >> obviously, he was going to. he had previously said he was going to leave before the president elect takes office on january 20th. >> and we knew the office was winding down, shutting down essentially. >> so this notice that he resigned, effective yesterday, came as a footnote in this filing that the justice department put in to the federal court in fort pierce, the one who judge cannon aileen cannon, who has been seeing the overseeing the classified documents investigation. and so she has a three day hold right now prohibiting the department from releasing the jack smith report on this two. investigations. that hole, by the way, jessica is expiring tomorrow or monday morning, depending on when you count the the days right from the day that she issued it. so we're waiting to see whether either she or the appeals court in atlanta rules again in the sometime between tomorrow or monday. that allows the justice depar

evan, you helped break this story. why is there such a backlog? backlog now? >> well, part of the problem, jake, is that the the incoming trump transition waited until december, a month after the election, before they signed these agreements, these memorandums of understanding, which allowed and paved the way for the fbi to begin doing background checks on their nominees. and so what you have is this real time crunch. you have dozens of agents around the country who are working overtime to try to get these things. they have 14 days to complete these, these, these background checks. in some cases, the republican senate is putting the on the calendar. they're putting hearings on the calendar before the fbi even gets these sf 86, the form that everybody has to fill out, which provides all of the detail, your background, biographical detail, you know, which is key for what the fbi has to do to investigate the backgrounds. >> elena, what's the reaction from the trump team about this rushed process? and forgive me for being skeptical, but is it possible that they di

evan perez, thank you very much. i want to break all of this down with our law enforcement and security experts right now. juliette kayyem, i'll start with you. these are very disturbing recordings that john miller just reported on. how critical could they be to this overall investigation? >> well, they're going to be very critical. and i was hearing john miller's reporting seemed to now sort of close a gap that came out of that press conference, which was this idea that that the, you know, that they didn't feel like there was any ongoing threat. and yet a concern that he had accomplices. you would never go out and tell the public there's no threat. if there were a bunch of accomplices. it seems now that some some of this has to do with they're just investigating people that may have known him or whether he was pushed from, you know, being online or travel abroad, but that there's a lot of personal aspects to his motivation as well a divorce, financial troubles, anger, violence and terrorism, and embracing i.s.i.s. t

let's go to cnn's evan perez. evan, what happens next?>> well, casey, this report about about 20 pages really outlines the reason why prosecutor david weiss conducted this investigation. this is a six year investigation, which, as you remember, hunter biden has pleaded, pleaded guilty to tax charges. earlier this year, he also was found guilty by a jury in delaware to gun related charges. and right before he was sentenced, president biden gave him an unconditional pardon. and i'll read you just a part of what david weiss writes here. he defends his prosecution. he says, i prosecuted the two cases against mr. biden because he broke the law, and then he takes a part of his report to essentially respond to joe biden, the president who accused the justice department of selectively prosecuting his son. and he says, no, no, no, no one, no other president has solely has has made these accusations against the justice department for the part of a prosecution such as this one. casey. >> all right. evan perez for us tonight. evan, thanks very much f
