kris van cleave spoke to the new head of the faa. reagan international airport, just outside washington, d.c. so, chris, what'd he tell you? >> reporter: good morning. the new administration certainly has unanswered questions. this report, the first of many to come, is expected in final form, perhaps by the end of the month. right now it is a draft, and sources tell cbs news this panel of international air safety regulators will make about ten recommendations to the faa, including a need for more transparency, better communications, and information-sharing during the approval process for aircraft. it's also expected to call for a new focus on how pilots interact with the increasingly complicated automated systems on new airplanes. some of the recommendations will be aimed at improving the process when the faa delegates approval powers to companies like boeing. the new faa administrator talked to us for first time this week. he says he can't say yet whether the max was properly certified. >> do you have questions that are unanswered?

>> there have been a lot of good conversations, specifically with the faa around how do we become moregile and if we find issues going back through -- the process is long for a reason, right? there is rigor in the process, and so when we find critical vulnerabilities if there are any, how do we have a number one, a detective ops pipeline that can it raerate code and quickly make changes to become more resilient. say a software example, but then how do you take that back through a thorough enough testing regime, and then get the regulator in there to validate that it's good to go before you deploy to a commercial airplane, for example. the conversations have started. it's not an easy discussion. it's not the 90-day paradigm that researchers have with a typical i.t. industry, so i would say discussions are skrur underway and there's good communications going back and forth. >> do you want to comment on that, like the idea of the role of regulatory flexibility and allowing dev ops a part of how this is solved. it seems like an interesting problem to evolve in. >> it is. i'm a software eng

now it's up to faa which has been working with boeing to recertify the 737 max and end this expensive say they have been focused on easing the pilot workload, so it might already have a partial solution in hand. meantime, the company has reached its first settlement with victims of the two crashes. boeing has agreed to pay 11 victims of the lion air crash $1.2 million each. there were nearly 100 lawsuits filed. the company is bleeding money. it already has a victim fund set up for $50 million, and it will compensate the airlines that have been -- that bought the max and and cannot fly them, $5 billion. the company lost a record $2.9 billion just in the second quarter this year. boeing is still optimistic, they tell me they can get the planes trying again in early fourth quarter which means just a couple of weeks away. that's very optimistic. ashley? ashley: yeah. dan springer, thank you so much for the latest on boeing and its travails with the 737 max. dan, thank you. let's check the markets now. the dow struggling, trying to get back to at least the starting point of the day. we're
