faith defense to section 1983 in germ or to first amendment cases in particular. the good faith defense issue gets complicated because five courts have said good faith is detriment to some. given my opinion. the united states have argued, no. there is a germ defense available to any defendant if it was constitutional at the time they are not on the hook. with that issue being raised, you will get decisions all over the board and work their way up to the a.m. ate court and eventually to the supreme court. assuming one of these cases makes it to the supreme court, what the court rules would be dispositive in all of these cases. we'll see how it turns out. >> one other question and this ay prevail if want to weigh on it. justice alito on, a designated union as the employee's representative substantially restriggets the rights of individual employees and he said that the idea of public sector unionization and agency fees would astound those who framed the bill of rights. that is pretty strong rights that garnered five votes. do you think that subsequent litigation -- the decision might impact exclusive bargaining rights more generally? >> my answer is that i hope so and we'll soon find out. there are cases pending including at the supreme court. starting about the 2,000's the united states came up with the idea who unionize individuals who are public employees, medicaid providers who provide home base care and child care services in their home and get state subsidies. and what the unions did in california and illinois is have them declared to be public employees solely for purposes of unionization and no purposes of otherwise and started to take union dues. hey received from the state. no you can't force those individuals to pay union dues. the second wave of cases says you can't unionize them. you can't force these individuals to accept an exclusive representative. for those who don't know what it means, the government is designating the union as the individual sole voice for speaking with the government over certain topics. authorized to speak for the individuals and enter into contracts on their behalf even if they oppose it. a union can waive an individual's rights through collective bargaining. a union agreed to waive an individual's rights to bring claims in court by saying they had to go to arbitration. the union did it on your behalf. exclusive representation prevents an individual from speaking individually on their behalf because the employer can only listen to the union and exclusive representation compels the government or the employer to only deal with the union and bargain in good faith with the union. there is a case before the supreme court that says it should be unconstitutional under . e first amendment to stepped that irrespective permissible unemployment no compelling outside of that interest. there is a question of any sort of feeling on exclusive representation. does the government have the authority to basically unionize anyone it wants to for any reason. is there some sort of constitutional limiting principle. the line in janus that exclusive on associational freedoms that would not be tolerated and if that other context is the unionization of these nonemployees. there is the question of is unionization of the public sector permissible, even of true government employees. there are a number of cases, international there is six, exclusive representation of public sector employees and employees cannot be forced to accept an agent in dealing with he government. >> i don't know how much fruit it's bearing but it's deadlines. if the unions are claiming you have t
