therefore, fani willis benefited financially from this case. there was a whole set of hearings that happened at the trial court. the trial court judge said there's an appearance of a conflict of interest, not an actual conflict of interest, but at least enough to give rise to reasonable questions. and that does not require me to disqualify the da, although he did say nathan wade had to be disqualified. now we get today's ruling from the georgia court of appeals. it's actually a 2 to 1 ruling. one of the judges dissented, but the two judges in the majority said even if there's only an appearance of conflict of interest in this case, it was not enough to get rid of nathan wade. the da herself has that appearance of a conflict of interest. therefore, she should have been removed from the case and that conflict of interest flows from the da down to her entire office. therefore, the entire office is recused for now. >> and i'm so sorry to jump in on you. we're going to look at live pictures right now. this is luigi mangione. he has been brought over

so, william, what was the appeals court's argument in removing fani willis from this case?: their argument -- and i should say, this came as a bit of a surprise, because the presiding judge, as you said, scott mcafee, who is a conservative appointed by republican governor brian kemp, had criticized willis' relationship and said it created this appearance of impropriety, but said, if you get rid of the man you're having a relationship with, you can stay on the case. she did that. this appeals court comes in and, while agreeing that this was really just about an appearance of impropriety, they said that this case was so rare and so unusual that it -- quote -- "that disqualification was mandated.” now, they have been criticized a fair amount for this ruling. it was a 2-1 decision, but that's the ruling. and she's off the case. geoff: the underlying case, though, hasn't been dismissed. could it be prosecuted by someone else potentially? william: potentially. fani willis' office is appealing to the georgia supreme court to overthrow this so she could get back in the driver's sea

i mentioned the fact that this is a good news for the president-elect, the fani willis case, he's hadong line of people, including jeff bezos coming to pay their respects, let's say, so what's the mood where you are? >> the mood for donald trump came across most in the social media post, everybody wants to be my friend. for donald trump, this go around runs counter to the reception that he received in his first term back in 2017, during that transition, instead, the likes of jeff ezos coming to dine with him at a time when house republicans on the capitol hill are following his every move and elon musk who has essentially been working, it's a proxy on his behalf on x and when he looked at what victory looks like for donald trump, of course last month's election was an outright victory. for him, i think on the budget negotiations, it's a big question mark. elon musk who donald trump has not undercut in terms of his speaking out, in helping sway the conversation up on capitol hill, has called for a government shutdown until donald trump takes office again on january 20th. there's a lot

this week, a georgia appeals court voted to remove da fani willis from the state's interference case.and his allies on racketeering, conspiracy, and other charges for an alleged plot to overturn the 2020 election results in georgia. the case has been hanging in the balance over willis' relationship with a lawyer in the case. this comes after jack smith dropped his two federal cases against trump. but there is a key difference in the georgia case. they are state level convictions meaning donald trump could not erase them with a presidential pardon. now, willis' office has said they will appeal the court's decision but that process could take months if not longer. joining me now is jill winebanks, special prosecutor and copost of the sisters in law podcast. a fulton county judge ruled there was no conflict of interest between willis and wade. the only appeals judge to dissent in that decision made reference to that in his opinion writing in part, quote, we have no authority to reverse the trial court. none. your thoughts? >> i think the dissent is completely correct. it is clearly not g

the centers around fani willis and her relationship with nathan why -- nathan wade who she appointedlk us through what all of this is, what's happening here? >> this is an attempt by the georgia legislature and in particular, one investigative panel of the georgia state senate to learn more about that relationship that wasn't already excavated in the hearings that judge mcafee held last spring. you and i both know that fani willis could remain in control of her case and the conflict of interest was not such that it was disqualifying for her. that decision is now on appeal to the georgia court of appeals and while they wait, the georgia legislature again, in particular this one panel in the state senate is trying to learn more about that relationship and has called for not only her testimony but a battery of documents including every document essentially that would evidence their relationship. all documents regarding what he was paid as a special prosecutor, all text messages between them and any communication that she had with any office of the federal government with respect to her

i say help, in some cases you're looking at mar-a-lago and aileen cannon and on the other hand fani willisnd. this was not something just the doing of good lawyers or even good facts that donald trump had to work with, not to mention perhaps the biggest help of all the immunity decision coming from the supreme court threw out all of this. >> yes, that of course the immunity decision was huge but perhaps even bigger than the immunity decision donald trump got re-elected. that resulted in the two federal cases going away. federal cases usually result in convictions, so once those went away, that was an anomaly, that was a surprise. then in fulton county, fulton county in georgia might have been a good case against trump and his codefendants, but unfortunately they were brought by an elected d.a., these are not my words but a trial court and then an appellant court confirmed an order of mendacity was over the case and not only was she removed, her entire office was removed. an otherwise meritorious case is now adrift without a captain because of the elected d.a.'s i would say poor choices. >>

how do you see the road ahead for fani willis in the state of georgia?ase that is proceeding in georgia state courts, not federal court. the dynamics are a little bit different. it is very likely the georgia supreme court will affirm the ruling removing willis from the case. if that happens, this case will then be reassigned to another georgia prosecutor. there's a little bit of a precedent for this. early on in the case, one of the defendants was peeled off because willis had a conflict of interest was prosecuting him. when that case was reassigned to another prosecutor, it was essentially a deathknell for that case. that could will be the state of this entire matter. there is a little bit of hope in this landscape which is that some of the defendant who had previously had guilty tried to reverse their guilty plea after this entire scenario shook out and the trial judge told them, absolutely not. a guilty plea is final, that is an important principle in the criminal justice system. absent a very good reason, defendants aren't permitted to relitigate a g
