we count on the fbi and the fbi can be counted on. mr. mueller is a republican who is conducting an investigation and i think the way that the public is going to have to deal with what you are describing is to be patient because he's moving very deliberately. he's got guilty pleas already, he's gotten indictments, there's -- there's something there to investigate, whether or not it leads to obstruction of justice charge against the president or money laundering or collusion, we don't know, the investigation is not over yet. kelly: to your point deputy attorney general rod rosenstein stating that a week ago says that he sees no reason to stop the mueller investigation, yet we have this morning the attorney for the president john dowd saying he should stop this now in the wake of what's happening with mccabe, is that the right thing to do at this point? isn't that taking to political status? >> it is because the two aren't directly related, yeah, there's a little bit of overlap because mccabe may be called to testify in mueller information.

levels of the fbi. mccabe is saying in his own right that he was being targeted by the president. that his comments about the ongoing mueller investigation were the real reason why he was targeted for investigation and then subsequently fired. there's a question now about whether mccabe is going to pursue some kind of legal recourse to receive his pension. and in that process use the president's own statements, his comments on social media, the constant pressure on jeff sessions to justify his claim that he was being unfairly targeted. on this issue, there seem to be a claim is being made on both sides and i will say that when this inspector general report actually comes out, we will know more about what mccabe was actually accused of doing. but for now, it seems that the trump administration has moved forward to fire mccabe and remove his pension at a moment when at the very last possible moment he stands to lose, you know, perhaps over a million dollars in retirement funds as a result of this decision

the office of, it's not under the fbi or part of the fbi and they work the investigation. but when they conclude an issue in their report, they are not in the position to be able to take disciplinary action. they refer it to the fbi's internal, investigative service, which is the office of professional responsibility. which is within the inspection division. so, you have in this case where the investigation is completed the results are given then to the fbi and then opr does the review and makes the recommendation that mccabe should be fired. so, i think that, you know, all the discussion about politics. i just don't believe that president trump, no matter what he says, i know it's going to be hard for people to believe. but no matter what he says is going to affect the way the investigation was conducted by the inspector general's office or what happened with the results when it was turned over to opr within the fbi. they are not going to be able to manufacturer this out of thin air if they determine there was evidence that mccabe wasn't truthful during all of the interna

he knew about the lies going on at the highest level of the fbi. steve, first to you, given that tweet, does this look to be fair or personal? >> leaving the tweet aside, it's distasteful. but, as an fbi agent, this is the only thing that's made sense to me since this whole thing started when comey started talking about the hillary clinton e-mails. from day one at the academy, it is drummed into us, if you ever lie, if you ever even have a short fall of candor during an internal fbi investigation, you are gone. if you are going to rip us off, rip us off for 25 million not $25 because we'll fire you for either. they fire dozens a year for candor violations. he knew, you do not shade the truth in an fbi investigation internally. >> mccabe saying he was not misleading to investigators. peter, the same question to you, does this look to be fair or personal? >> i think it's definitely a political side to it as well. i know what was said is fine, true, but the short fall and candor. the president never left mccabe alone for several months, been hammering
