stuart varney, fbn coming up. bill: we have brand new jobs numbers from the labor department 40 minutes ago. for the week last week that number rising by 4,000 americans to 371,000. that is the highest number we've seen now in five weeks. we'll see how the markets react to that coming up at 9:30, 23 minutes from now. since december of 2007 though, weekly jobless claims have stayed above 300,000. spiked in early 2009 on the chart as you see. economists say that weekly claims must consistently fall below 375,000, shown by that yellow line on the screen right there, to indicate that the job market is strong enough to lower the unemployment rate. this past fall weekly jobless claims dipped below that line. today's report of 371 shows slightly below that line again. well under that to bring that unemployment number down. 7.8% now. martha: john brenneman could be in for a battle as president obama's pick for the central intelligence agency. lawmakers looking to press brennan on his support for the enhanced interrogation

we've been looking at their impact on difficult income brackets each hour of the day here on fbn.ur we're up to the household income of 200,000 to 500,000. and the big change this week was the restoration of the top marginal tax rate of 39.6% from the clinton era for individuals making more than 400,000 a year and families making more than 450,000 a year. now those taxpayers will also see the rates on their capital gains and dividend rise to 20% from 15% under this bill, unrelated to this bill, however, is the new tax under the president's health care reform law of 3.8%, a medicare surcharge on investment income for individuals making more than 200,000 a year and families making more than 250,000 a year. but the tax increase that will hit almost all taxpayers, lower income as well as upper, is the expiration of the payroll tax cut from the last two years. let's look how the tax picture is shaping up for the higher income households though, 200,000 to 500,000 a year. according to the tax policy center their taxes will go up on average by about $2800 this year. most of that because
