how did you get to the fec? >> a long and winding path, but the short answer is, i was nominated by president bush to fill a seat on the federal election commission and confirmed by the senate. because the agency cannot have more than three members from any one party, my name, i'm a registered democrat, so my name was sent for suggestion to the white house by the majority leader, senator reid because president bush was looking for names of democrats, of course, and so there were several of us who were confirmed all about the same time and took office about june of 2008, some in july of 2008. >> let's put on the screen a look at outside spending and first, in congressional races, and if you can explain to the students what these graphs mean. >> sure. one of the benefits of the information we get in at the fec is, we're able to see some trends in the data. and everyone after citizens united started wondering what the impact was going to be in terms of these knew types of spenders that could spend -- raise unlimite

fec. i think we should keep all that in mind. >> the chairman mentioned earlier today in discussion about some of the regulatory burdens that have been dropped overtime. you mentioned specifically fairness, doctor. what are the requirements. what is a requirement today? and whether or not there is any initiative underway or thought process underway to bring back shall we say this fairness doctrine. >> just the opposite. i feel very strongly about the first amendment free speech, the fairness doctrine in my view was a bad first amendment idea from the start. i was pleased that work with my colleagues to eliminate the last ves damages on the books. >> so about a year ago i was giving a speech we were going through i had asked my legal team to go through the fec's rules to find instances of rules that could be getting rid of. everyone thought the fairness doctrine died in 1987 and parts of the heart and soul of it remained on the books. the fec decided not to enforce it back in 1987. the chai

and obviously you need four votes for the fec to take any action. because of this, a lot of people have criticized the fec as toothless or slow-moving. as a commissioner, how would you -- what is your perspective on these characterizations? >> i would agree with some of them, actually. yes, it is the nature of the -- the statute set up a system where no more than three could be from one political party. that has not always meant that there are three democrats and three republicans. at this point in time, we have three republicans, two democrats and an independent. but we do need four votes to take action and so that does require bipartisan, if you will, compromise on most of the things that we would like to do. sometimes i've personally found that compromise is more illusive than i would expect it to on certain issues. i think for many of the years of the commission's existence, this issue really wasn't as problematic as many on the outside said. this isn't really a political divide. this is more of an ideological deslide. the tension between the fi

the increase on the fec of employees earning $150,000 or above. so even though the number of employees may be flat, those making $150,000 and above have increased rather dramatically. that's what this chart reflects. >> you would like to submit that for the record? >> that would be great, if i could. thank you. it's a huge increase of individuals that are now earning over 150% -- $150,000 in salary so. let me see if i can get you some of those numbers. down from 46 in 2008 individuals to 431 in 2009 to 535 in 2011. that's a pretty say on theishing increase. so what changed between 2008 and 2009 that required such an increase in pay is it different individuals, is it increased -- i'm not sure what that actually shows us other than that the fact that the numbers are pretty astonishing? >> so i'm not familiar with the reasons for that particular increase in general the work of the fec increasingly requires highly skilled engineers, economists others with advanced degrees to do our work. overtime the employee base at the fcc has become more and more f

so help me understand that. >> to the extent the fec is involved in this area it goes back many, many years. a part of the public trustee obligations of broadcasters, and as i mentioned, cog codified this in 2002. >> does it -- sorry to you mentioned small businesses and commissioner mcdowell mentioned that as well. one of the suggestions that came in in the record was to look at ways to exempt small businesses from this move or give them more time to make the transition. in general even small broadcasters are engaging with the fcc online and a renewal application haves to be online. they are after all broadcasting and -- but to the extent that there are burden issues that can be addressed those are issues that have been raised on the record and we will look at them. >> commissioner. >> i want to clarify that broadcasters came to us and wanted us to move a lot of these file requirements to be online. but they wanted the political file component carved out because of the proposed costs. so that's really i think what's at issue here. it's not transparency. it is the cost to broadcasters

disclosure. >> the contribution disclosure. >> how has the fec gutted the contribution disclosure? >> by defining the only contributions required to be disclosed as the contributions that were given for the specific purpose of making campaign-related expenditures. >> and these would be contributions to these various groups like the sierra club or democracy 21 or whatever other group might spend money for that purpose? >> yeah. >> okay. do you think we should be having a hearing on the -- enforcing the statute? >> i think you ought to have a separate hearing on fundamentally reforming the federal election commission, but i don't think a hearing on enforcing a statute on this regulation is going to get us to solve the problem of disclosure. >> but the statute you said required disclosure? >> under the current regular rules of the statute that resulted in $130 million not being disclosed. >> mr. keating made a statement that groups like the sierra club should be able to run ads out of their own budget. is that a fair -- >> yes. >> and do you all agree with that that groups like the si
