federal appeals courts and their respective circuits. one issue was whether to split up the large ninth circuit of the u.s. court of appeals on the west coast, which was dealing with the backlog of cases. a senior judge and two law professors testified before the subcommittee. >> this hearing is called to order. the federal courts occupy a unique role in our constitutional system of republican self-government. one of the bedrock principles of our identity is as a credo nation that governments derive their just powers from the consent of the governed. that idea translates in a pretty straightforward way into the constitution's vision for the executive and legislative branches. the american people are never more than two years or 730 days from choosing whether to rehire or to fire the vast majority of the federal elected officials. at first inspection, the notion that members of the federal judiciary, one of the co equal branches of our federal government, can't be directly or easily fired by the people back home seems hard to square with

all of the patent cases are going to the federal circuit. god forbid that the federal circuit makes a mistake. if all the agency review goes to the d.c. circuit then those judges have a lot of power. one of the hallmarks of our federal judiciary is that the circuits can learn from one another by considering the same issues in different places, and then when the supreme court finally has to get involved the supreme court has in front of it a number of different takes on the same question. we think this improves the supreme court's decision making ability because there's a lot of diversity of opinion that it can draw from. when we put all of the cases into one court of appeals we are missing out on all of this percolation. when i was at the court, that's what we would call it when we were looking at a cert petition. we'd say there are only two circuits that have weighed in on this issue. we should wait before we take the case for more courts to weigh in. wait for more percolation. we miss out on all that learning. that's a hallmark of the comm

it is the largest federal court of appeals in american history. when two judges on a three-judge panel of the ninth circuit decide what federal law means, they are doing it for 20% of the country. 60 million people. that concentrates a lot of power in the hands of two judges. the down side to concentrating judicial power is that judicial errors become magnified. this happens in two ways. first, it's very simple. when a judge makes mistakes, when powers kuconcentrated the mistakes affect all people. second, judges are more likely to make mistakes to begin with when we concentrate power in too few hands. consider universal injunctions. right now litigants are able to file lawsuit after lawsuit asking for a universal injunction until they find a district court judge willing to enter one. but that judge may have odd views that are outside the mainstream. indeed, plaintiffs often seek out the judges with views most predisposed to them. it is called forum shopping. yet right now the one judge who enters the universal injunction can trump all the others

white house cybersecurity report shows federal agencies still struggling to get secure. do you agree with that assessment quick. >> it's hard to make such a generic claim. there agencies that are struggling with certain aspects and some are really good. typically large well resourced agencies have a lot of experience but they also manage very complicated networks. medium-sized agencies may be have less resources but also have less complicated networks to manage. so it's hard to say every single agency is struggling categorically but we are trying to help agencies prioritize the resources that they do have to have the most demonstrable progress through those directives to give new authority to connect agencies to take action. with one of those most consistent challenges and self reporting with those issues and closing those agencies with critical vulnerabilities so industry standards these are the highest and most critical vulnerability management is a really important part of a strong cybersecurity program. so maybe there is an indicator there is other challenges if that

. >> how much more so with the federal government involved in this process is 2016? what would've changed on that level in your relationship or in a state the federal level. >> so let me back up to 2016 and start from there. i think when we first got the phone call, the secretaries of state were called her a conference call with secretary of big johnson. we were far and it an attack that occurred and we are perhaps as the federal government was considering creating a critical infrastructure designation for elections. we didn't know what that meant. i think many red states and blue states, many of the states were opposed to that designation because we had no idea if it was the federal stakeholder of our elections process. to say was a rocky road in the beginning as far as communications i think even dhs would agree to that. what has happened since then, the critical iced infrastructure was designated in january of 17. we actually didn't find out what resources and what that meant to last until june or july of 17. we have since set up a coordinating council of which i
