. >> reputationally what does this do with freeh ferrara who has this opinion overturned and seeminglyr for the job of attorney general? what do you think his reputation will be? >> this has become very personal. this court of appeals opinion, instead of the usual magesterial lofty language, they were attacking the guy. it was unfair. he had ample precedent for doing this. this is well within the bounds of prosecutorial discretion. he still has a tremendous record. i think he's been unfairly besmirched. >> could you get a legislation through congress? >> can you get anything through congress? on this issue, they have not been that divided. they overwhelmingly pass legislation to ban insider trading among themselves and their staff members. that was a huge bipartisan success. there is new legislation on insider trading in commodities market. if they can't agree insider trading is bad and should be stopped i don't know what they could agree on. this is a great example of bipartisan move which would have wide public support and would show they can do something. >> we were all around in '9
