they say republicans criticize president obama for governing by fiat. i understand some members of congress would prefer that congress be the one to allocate the funds and the funds be spent on those issues. but i think what you're saying, the president can override the congress on this. >> actually, i would say that congress has already preauthorized it. congress passed the law which allows the president to move money between budgets once they declare a national emergency. so i think if congress -- this is really the basic point to get to. if congress doesn't like what president trump is doing, then they have the power of the purse. they can cut out funds or take the money away from next year. >> dana: tell me if the democrats do sue to block the president from taking this action, how quickly might we get a solution on that? with the muslim ban, it was fairly quick. but in this case, could -- is it as celebrated because it's an emergency? >> i think that the supreme court would reach down and as you said accelerate the case up like with the muslim ban.
