there needs to be a lot more discussion around the zoning controls for the fillmore ncd and given that it's the holiday season, the merchants of the fillmore area won't be available to have a meeting until after the holidays. so that is end the december/early january. so we don't feel good about moving forward until we have had that discussion with the merchants, and everybody is on the same page as far as moving forward with the zoning controls. we have been speaking with different merchants in the area and there is a considerable amount of support for this. so i just wanted to let you know that the feedback has been very positive. but they do need to kind of come together as a group and vote on these zoning controls, and so we don't feel comfortable moving forward until that vote has happened. so right now we have asked for the planning commission to continue this to, i think it's january 13th. so if we could get it scheduled before you around that time, that would be wonderful. thank you. >> great. thank you. >> i am available to answer any questions, if you have any. >> do we have

the department supports the creation of an individually named ncd area on fillmore street. it helps preserve the character of the neighborhood and also helps preserve a sense of identification. we are asking for some modifications which have to do with expansion of the district as well as some minor clerical modifications. that concludes my presentation and of course i'm available for questions. >> thank you, mr. star, and we have supervisor olague. >> i wanted to thank mr. star and the planning department tore their work on this. we started those conversations with the merchant's association that is in the process of being formed along fillmore street because after redevelopment there was something called, well, the cvd was formed but then the cvd was not, was not -- did not last when the fillmore center, i believe, no longer decided to participate in that process. so in order to allow for the merchants to talk about how they would like to move fillmore street forward, we started to engage in those conversations with them. there's a lot of -- because since the cbd had so m

there is also named neighborhood commercial districts such as the castro and ncd, upper fillmore ncd and the polk street. rezoning properties along divisadero street from n c-2 to a newly created named commercial district called the divisadero street ncd. for the most part, the new divisadero street ncd maintains the n c-2 zoning controls, however, there are some notable changes. the ordinance removes the minimum parking controls and replaces them with maximum parking controls. it allows the 5 foot height bonus for active ground floor uses and 40 x zoning or height districts. it allows bars, restaurants, limited restaurants, movie theaters, other entertainment, philanthropyic administrative services and trade shops on the second floor of buildings with no prior residential use. the ordinance also removes the divisadero street alcohol restricted use district, but maintains the prohibition on liquor stores in the new ncd, the street would have a named ncd. this restricted use district is no longer necessary because you can just outright prohibit liquor stores. staff's recommendation is
