now, we don't know if that's true with fiona hill. fiona is of course a former. still haven't gotten to whether mar marie -- >> how wide does executive privilege here, as both hans and garrett brought up, how wide does it apply to both sondland's testimony along with fiona hill's that's going on now? >> it's up to the president to do so but it's not absolute. you know, as we learned in the supreme court decision involving president nixon, executive privilege cannot be used as a shield to prevent the disclosure of criminal evidence. so if it is being used to cover up for crimes, then that -- that shield would need to be pierced. sometimes there's a little bit of a chicken and egg problem there to prove that it was criminal, you need to disclose it. and you can't disclose it without violating the privilege. so it could be that we have to litigate this. take it to court and get a court to review the texts and review the conversations encamera privately and then make a decision as to whether it did involve criminal activity that should cause the waver of the privileg
