san francisco is the first city in the world to enact this piece of legislation, which is approved by the entire board of supervisors. we met with the city attorney's office yesterday and told them 25 other city, states, and countries around the world are waiting to see what happens with the outcome of this lawsuit. the proposed settlement agreement calls for terminating this ordinance that was passed by the full board. according to mayor gavin newsom, the ctia, they buy science, they buy apathy, and they buy politicians. gavin newsom said san francisco is not for sale. san francisco has not lost this lawsuit and can still win. it's a health fact sheet [speaker not understood] by judge alsop. the u.s. 9th circuit court went ahead and in a cursory nonbinding decision declared the health fact sheet controversial and therefore a violation of the cti [speaker not understood] amendment rights. the city's website states clearly as a first city to adopt the precautionary principle, san francisco trixv to protect the health of its residents, visitors, and local environment. lastly, i want to

first we are very cognizant of the local business enterprise hiring programs in the city. we have done some of the largest public works in the city from the mosconi second phase to the muni metro turnaround; to the majority of the san francisco airport. we understand these are small business goals. we talk to all the local contractors despite to what you hear. this job is a very complicated, very difficult, one-of-a-kind belowground station excavation project. we did not get a lot of local enterprise quotes on the major categories because it's extremely complex and larger. one of the largest subcontractors is a local subcontractor. we did everything within our power and are still open to local businesses who really have an interest in providing service on what's remaining to be done. your agency has all the quotes we took from local businesses; i think you would be interested to find out that there weren't that many quotes despite all the rhetoric to the contrary; we did everything within our power to incorporate them. we have a saying, if you don't bid, you don't work. >>

in 2009 we launched our open data initiative, one of the first cities to do so. in 2010 we partnered with the white house to launch open 311 api, the first ever read write api for cities. we now have over 40 cities that have joined us. in 2011 we partnered with gray area foundation on a series of hack-a-thons, 10,000 attendees, and created nearly 30 applications all being powered by open data. now in 2012 we have our legislation that you heard about. as you heard, we announced the chief data officer. we have a network of open data coordinators within each agency. and these coordinators, their primary responsibility is to provide insight, is to provide transparency into the data sets that they manage. and that's really important. we want to make sure that you guys have a clear understanding in our community about the data that we manage so you can tell us where we should be going next in terms of opening up our data sets. we also are doing some structural changes so that open data is really the default position for our city. we're making sure that data belongs to
