a florida court has ordered a new trial for a woman sentenced to two decades in prison. she's convicted of firing a gun to scare off her allegedly abusive husband. ed payne tells us why they've made the ruling. a three-judge- appellate panel chose to reverse marissa alexander's conviction because they say the jury, that took just 12 minutes to convict her, was given improper instructions on self-defense. they say the jury was told that in order for alexander to claim self- defense she had to prove beyond a reasonable doubt that her husband was about to seriously harm her. but the burden, they say, was on the prosecution to prove she was guilty of aggravated assault. this case goes back to august 1-st 20-10 when alexander picked up a handgun and fired a warning shot into a wall after she says her husband rico gray strangled and threatened to kill her. she claimed self-defense. "had i not discharged my weapon at that point, i would not be here." before her last trial, marissa alexander tried to use florida's "stand your ground law" to argue she was immune from prosecution.
