florida florida being a key swing state but this is all about causing problems for joe biden one republican said to me the idea was that they would set as many fires as possible so that he couldn't get to his agenda he was too busy dealing with the aftermath of the final days of the job by of the donald trump administration trump of course heading off to the border he's heading to iowa more in texas the whole intention is to say look wasn't my immigration policy a big success we've built a huge chunk of the wall actually built 600 kilometers or so when he promised more than 3000 but this is the 1st time we will see the president in public of course since wednesday and that rally on the mall all right thanks so much alan fischer there. let's bring you up to date on where these moves against trump currently stand then how they could play out while as mentioned rushed moves to impeach him while he's still in office and moving ahead a vote on that is scheduled for wednesday as allen explained it's likely to pass the democrat controlled house but it then goes to the senate where a 2 thirds vote is needed for a conviction and if that happens there would be a vote to bartram from running for public office again if he is removed trump stands to lose no ray of post-presidential perks that includes a $219000.00 yearly pension office space and staff and access to health care benefits another option is impeaching him after he leaves the white house as alan pointed out that's when democrats will have a narrow majority in the senate but 16 republican votes would still be needed a resolution urging vice president mike pence to invoke the 25th amendment that forcibly remove the president has also been introduced let's bring in daniel freeman former counsel and parliamentarian on the house judiciary committee is also a fellow at the american university in washington d.c. mr freeman joins us from chevy chase maryland good to have you with us so let's see if we could break this down step by step and talk about the process of impeachment it kicks off with the house of representatives having to vote right there they only need a simple majority done deal that's correct. so if that's the case and they get it through the house of representatives that they expect the real problem then starts with the senate to talk us through what happens there. well after that house agrees to the resolution of impeachment by a majority vote then physically what happens is members of the house who are named managers walk through that door that you saw police officers with guns. the other day they walk through to the senate and they present the articles of impeachment to the senate and the senate is under some restrictions about how quickly it needs to go fairly quickly the question is do the you want to proceed to an actual trial if you know that you do not have the votes. the question is what is the purpose of having a trial so it would be up to the majority leader who will be mitch mcconnell until january 20th and then on january 21st vice president harris would be able to break a tie in this case it's still vice president pence so fortunately fortunately there are some options but mostly it boils down to do you have the political will to proceed to an impeachment for a an executive officer who is no longer in power. and the the other side of the argument is that. people will want this president to be called to test for the. at the meeting that he had of the requirements that he had on that wednesday. so letting him get off scot free is anathema to many people all right so even if you know of the other just to clarify even if this i mean it seems pretty clear that this is not going to happen before the 20th in terms of the senate trial mitch mcconnell i think is made that very clear so even if the democrats have the votes to make sure a trial happens that doesn't mean donald trump will actually gets. the impeachment up held by senate right correct i mean he would he would as a tomorrow afternoon he will have been impeached for the 2nd time and they had pitchman under the rules is the action of the hell so it's analogous to. an indictment by the grand jury but the senate has complete control about how to do it . and they they can if they don't have the votes to proceed then it's not going to happen then the question is after january 20th is there the political will to proceed against their own president who is no longer in office even if he's only in people trying to. explain this to our viewers he would have been impeached twice are there any implications ramifications are on him for having been impeached twice by the house of representatives what kind of limitation to that place on. well it's never happened before that there been 2 impeachment of the same individual. but that being said the former impeachment has no effect there is no double jeopardy clause or anything similar to that so being impeached is what we lawyers call should be generous it's unusual it's an individual happening but it has no real effect except for people who are writing history especially if the president will not be convicted of either attempts. interesting so it sounds like he could still run again for office it's going to be interesting to see how the future plays out thank you so much daniel freeman thank you play more still ahead on the news hour including questions about the timing of a sudden and sweeping coronavirus state of emergency declaration in malaysia. and arrest warrants issued in connection with the august explosion in lebanon that killed more than $200.00 people in beirut and cause more than $200000000000.00 in damage. and the start of the formula one season has been delayed details of that coming up in sport with peter. divers in indonesia have recovered one of the black boxes from a passenger plane that crashed into the ocean with 62 people on board the one they found is the flight data recorder that logs information like instrument readings engine performance and altitude a cockpit voice recorder of tapes the pilots is still in the sea though the boeing 737500 crash shortly after takeoff from jakarta on saturday. jessica washington joins us now live from jakarta so where does the investigation stand this point having discovered at least the flight data recorder jessica. and so i mean this is regarded as a major breakthrough for this investigation this search of the job to see the recovery of the flight data recorder authorities hope that this will aid in their investigation of what happened as jay 182 in also discovered today which underwater beacons that these bacons would ordinarily be attached to the black boxes what that means is that these bacons are no longer touch those boxes and as authorities continue the search for the cockpit voice recorder they won't be able to use those beacons for assistance authorities here however say they're confident that the cockpit voice recorder should be found soon they believe it would be in the vicinity of where they found the flight data recorder in terms of what this means for the investigation the flight data recorder has been handed over here. to the transport safety commission that commission is conducting the investigation into what happened on board the flight the commission has released some interim early findings they say they are confident that the plane was fully intact when it entered the java sea as far as this investigation investigative process they say it will take them $2.00 to $5.00 days just to download the data from the flight recording from the flight data recorders so it is expected to be a lengthy process but it everyone here is the relatives of those on board flight s.j. 182 are keenly waiting for answers. thanks so much from jakarta. malaysia's king has declared a state of emergency the request of the country's embattled prime minister seen says media is reporting that chancellor angela merkel sees the coronavirus lockdown continuing until april the country's experiencing a surge in cases almost $13000.00 the last 24 hours with almost $900.00 deaths a visit to a crime authority in the eastern state of saxony provides a bleak illustration of the death toll the director of the facility says it's struggling to cope with the sheer number of bodies performing more than 3 times the usual number of cremains sions like dollars for tori amos for as you can see the caskets are not only stacked one by one but 3 high even here in the memorial hall restoring many of the deceased were using all the space we have from the quantity you can see that there is simply an improbably high mortality coronavirus is real more on this let's cross over to berlin where you can find dominic kane so dominic what kind of stricter restrictions are authorities contemplating as they head into easter. the thing to say here 1st of all is that angle americal was speaking to an internal group of her own party have parliamentary party as it were and her quote is that she believes that if the german authorities are not able to contain the variant of the corona virus that was 1st identified in britain here in germany then she fears a 10 fold increase in the number of new infections and that in order to combat that that she sees it's quite possible that the restrictions in place on pretty much everybody in germany right now could be extended right through till just before easter which falls the start of april this year that in addition to that which obviously is something that many people will be concerned about this double possibility a that the mutant variation variant is starting to spread and secondly this lockdown being continued so far into 2021 you then have a key ally of hers in the state of bavaria the prime minister there mark is a christian social union a conservative politician saying that now there has to be a much stronger and stricter application of the requirement to wear masks you know says a surgical masks are no longer sufficient that people should now be wearing the f f p 2 masks ones which provide which have a filter in the masks and therefore offer a degree more protection and underlying all of this is what we were hearing there from that undertaker in mice and from east it from the former east germany saying that the bodies are starting to pile up we know that over the course of several of the last of the last days of the of this week several days we've seen death tolls of a 1000 today's 891 it all adds up to a real surge in the number of new infections but also deaths and that is what is informing the perspective we're hearing from angela merkel and from her ally in bavaria marcus. that was dominic cain there from berlin. the european commission president is urging health ministers from eve member states to stick to a joint strategy on coronavirus vaccines the e.u. is negotiating contracts with vaccine developers as a block but some members may be breaking away to make their own deals with suppliers europe's lead negotiator for vaccine contracts is briefing m.b.p.s. on the latest developments police in the u.k. will be getting tougher on lockdown rule breakers there london's police chief says people who breach restrictions will be more likely to be fined and the policing minister hasn't ruled out stricter measures either infections are rising sharply in the u.k. the office of national statistics says there are more than $90000.00 excess deaths last year that's the highest since world war 2 paul brennan has more from london. well kit malthouse the crime of policing minister has been doing the rounds of the broadcast studios this morning and outlining the fact that from his point of view the government is particularly reluctant to toughen up the rules that said he admitted that the government is in his words on tenterhooks watching the data and realizing that if the data continues in the direction that it's going then something tougher is going to have to be introduced figures from last night show that 32000 people are currently hospitalized just in england alone with coronavirus on the important thing to compare is the peak of the pandemic in april 2020 just 18000 were hospitalized at that time so you can see there's a big difference there the issue is philosophical in many ways the conservatives don't particularly want to have to tighten the restrictions if they don't have to they are the party of of freedom in many respects but that said the advice from the medics and from the scientists is weighing heavy on the shoulders an international arrest warrant has just been issued over the explosion that destroyed large parts of beirut in august lebanese police are seeking the captain and owner of the ship that brought highly explosive ammonium nitrate to beirut or in 2013 it was stored improperly in a warehouse until. it's stored improperly there until erupting last year more than 200 people died in the explosion thousands of others were injured many more were left homeless let's go live now to zain a hoarder in beirut so just explain this one to us saying because they're seeking the captain of the ship what about the people who stored it there for so many years . it's a question many lebanese are asking the authorities they have little faith in the investigation so far the interpol now heeding 11 aunts request to arrest these 3 men the owner the captain of the ship as well as a portuguese nitrate trader who visited the warehouse where a nearly 3000 tons of ammonium nitrate was stored to of for many years if i just get out of the way that warehouse was very close to the silos and as you can see nothing is left so many and so he is responsible for bringing this highly explosive material to lebanon on that ship sir sail from georgia it was on its way to mozambique it made an unscheduled stop in beirut why this is a question that has not been answered media reports suggest that the owner of the ship wanted to make some money and he wanted to take heavy machinery from lebanon but the ship was not able to carry it at the end he was not able to pay for it fees and the ship was impounded in fact at some coffee with coast in 2018 nearly $3000.00 tons of ammonium nitrate and safely stored in a warehouse apparently caught fire think of the blast so will these men not be arrested for judicial officials to question them and levanon at the end this is a non binding arrest notice this is not an arrest warrant but then arrest notice. or i will leave it there thanks so much. it's time for the weather service and. hello the weather slushy fog in try a cross north there will be some heavy rain pushing towards the events over the next day or 2 some make the most of that $24.00 that we have in beirut increasing wind and rain will set in through cyprus democrats have introduced a resolution to impeach president of trump for inciting violence on capitol hill last week but also urging vice president mike pence to invoke the 25th amendment declaring trump unfit to hold office an international arrest warrant has been issued in connection with the beirut blast last year police are seeking the captain of the ship the transport of explosive material it was stored in a warehouse at the port more than 200 people died indonesian divers have recovered one of the black boxes from a passenger plane that crashed into the ocean with 62 people on board on saturday the devices are expected to shed light on reasons behind the aircraft's sudden plunge just minutes after takeoff and spring in aviation analyst david lam out from london good to have you with us so how unusual is it to find the flight data recorder but not the voice recorder i think they'll probably get the voice called a fairly soon so you know they will have found both of them i suspect. but no it's not unusual to find one 1st and then the other how easy will it be to start getting close with only the flight data recorder. well that's up to the indonesian authorities and i'm not certain that whether or not they have advanced downloading facilities for these these 2 computers when they've got them both the black boxes so called. but they can call for international help on that because there's plenty out there and they have done that in the past but as soon as they want to start downloading they can do it within about 24 hours is this a case of it really having to go to boeing for you know a proper analysis i doubt if they'll send it to boeing because they'll want somebody independent boeing will take part in this investigation because the manufacturer of the aircraft involved always does. operate as an advisor and an observer but they may well choose a 3rd country like that has you know expertise in this area like for example france now is the age of the plane significant in the investigation where this aircraft is about 2627 years old but actually no that's not particularly significant i know it's it no if you have a car of that age it's fairly old but it's not a tall rare for an aircraft you know to be flying and working at this age and if it's well maintained there's no problem with it. i don't want you to speculate but do you have an idea of what investigators are least looking at so far as the likely cause of the crash from everything that we know. well it's it's very difficult to work out a cause at this stage but you know we can make some observations on on how it happened whatever it was that happened it was catastrophic in that it caused the aircraft to to plunge to earth very very rapidly indeed and whatever it was that happened also meant that the pilots were so preoccupied presumably with trying to save the airplane that they didn't have time to put out an emergency call to air traffic control so it was terribly sutton and so for something like that we're talking about anything from from a bomb on boards to to a severe upset if they got into the center of a thunderstorm because on that day there were lots of thunderstorms around but in indonesia that's not rare the pilots are used to them and pilots have on board an aircraft like this a radar which enables them to see where the core of thunderstorms are high don't they so why have they can fly with them on a fly through a thunderstorm. well it's not a question of allowed or not the pilots would never fly through the core of a thunderstorm because it can get terribly terribly turbulent in the middle of thunderstorms there or there are very very powerful up currents and down currents which can damage an aircraft and d. stabilize its flight so that is one of the things that they will be looking for but you know there are any number of i mean one of the things they really won't be looking for is that wings falling off or something like that i mean this aircraft was 26 years old but it's still a modern well engineered airplane so we're not talking about something catastrophic just suddenly happening to this airframe it doesn't work like that in aviation our days on our own i guess time will. tell us more they've eliminate their. ugandan opposition candidate bobby wine says his home was raided by the military on tuesday morning wine gave a presser with 2 other candidates announcing they'll be working together to monitor the presidential election on thursday they called on their supporters to turn out in large numbers to mammas of polling stations he also said security forces were still working to intimidate voters catherine story joins us now from kampala the capital of uganda so katherine the raid on bobby wines home the latest manifestation of what's been quite a violent campaign right. absolutely and in this press conference which he addressed with 2 other candidates presidential candidates he said that he's home as you mentioned was raided by a soldiers this morning he said that he security guards were beaten up and like you mentioned this is not the 1st time we have seen bobby wine and one of the candidates that was in that press conference called called patrick are more reactive spin them being arrested more people times detained they've been blocked from attending their campaigns but the winds aid some of them have been killed in the last few weeks so they say that this is a government that too strong to intimidate them but i also spoke to the government spokesman who said that this individuals have been defying covered regulations he said this election is happening in the middle of a pandemic and they are government restrictions including meetings that should not be with more than 200 people but they say that this individuals are going and calling on hundreds of supporters to come and the government is not going to allow that to happen but like i said bobby wine and the other opposition leaders saying that this is a way of the government trying to intimidate them and they have said that they are going to get their vote they're calling on their supporters on voting day after voting they're saying that do not go home as a calling station record any most practices that you hear of the other polling stations during counting because that is a crucial sign so essentially calling the people to come out and get the vote but they're also saying that they're going to pool their resources and send agents to polling stations across the country to make sure that nothing untoward happened in the crackdown is gone on the real world so massager one too right. i'm sorry i didn't quite catch your question but i reckon you are asking about the internet shut down. this is true we have seen this happening all day facebook for instance has been down since morning we've spoken to many people here who are complaining about it if you remember yesterday we have been reporting about facebook suspending dozens of accounts of individuals who are mainly connected to the ruling party to president yoweri museveni government officials as well we spoke to the press secretary of the president who has said that some of this individuals have not been given any notice by facebook saying that they have not been given a proper explanation and i also want that this would happen that they would block facebook other than facebook internet speeds have been quite slow as well government officials have told us that this move is to make sure that the messages that are going to incite people to violence or to cause instability are not going to be allowed that's why this is happening but all of opposition leaders that we've been talking to sami are saying that this is a way of the government policing this election this is a way of the government trying to stifle a freedom of expression so it's going to be interesting in the days to come because people are expecting worse.
