zimmerman is in the state of florida? is there already a bonding process underway? >> i can tell you in seminole county and i want to thank their state judge, he informed us they have a bond schedule and when a habeus is issued, there is originally no bond, but mr. zimmerman's lawyers will be butyled to request a bond at which -- entitled to request a bond at which point a bond hearing will be held. that's where that will be determined as to whether or not no bond, which is the bond currently set, will be changed by the court. >> have you determined whose voice is crying for help on the 911 recording? >> that would be commenting on the facts of the case and we're not doing that at this time. >> what about your investigation led you to a second degree murder charge where sanford police investigation didn't lead to an arrest? >> i don't whatever that question is accurate in the sense that when you have a homicide, florida's jury instructions even say that before you can reach a degree of homicide, you have to determine whether a person has committed an excusable homici

florida state attorney angela corey clearly dealt with the possible claim of self-defense in her decision. >> all murders are homicides, but not all homicides are murders. and florida's law clearly says that if there is the affirmative defense of, for example, excusable homicide or justifiable homicide, that should be determined before you go to the degree of the crime. this case is just like many of the shooting deaths we've had in our circuit. if stand your ground becomes an issue, we fight it. if we believe it's the right thing to do. so if it becomes an issue in this case, we will fight that affirmative defense. >> i'm joined tonight by dan gelber, a former florida state senator and a former federal prosecutor. and mike papantonio, attorney, president of the national trial lawyers association. gentleman, thanks for your time again tonight. mike, you first. let me get your take on what has unfolded here in the last several hours. where does it stand right now? how hard is it going to be to get a conviction based on what you see? florida. some states you have to be arraigned where you enter a plea of not guilty or you plead guilty. ube little bit longer if somebody want mrs. time. >> and we know that florida is up with of 26 or 27 states with a stand your ground law, the defense then files a motion to discuss, right? based upon that. >> yes, the defense will file a motion at arraignment asking for a hearing on this law. that's what we anticipate will happen. he said he was justified. and this immunity hearing as it's called will be critical. a lot of witnesses, ear witnesses, eyewitnesses, people the police talk to will be expected to testify. i wouldn't be surprised if zimmerman himself testified. because this is the shot at getting the case dismissed. the defense has the burden to prove the case beyond a reasonable doubt. the defense has a burden to prove yus justification by a preponderance of the evidence. if the defense wins, then he's immune from prosecution and the case is over. but that decision by the judge can be appealed by the prosecution. >> ultimately, we're talking pretrial. we look at the trial. t

the problem, of course, was highlighted in the state of florida which was in 2010 the epicenter of the nation's pill mill epidemic. but i have to tell you that working with the attorney general in the state of florida has led to marked changes in that state. and i couldn't be more pleased that not only she, but attorney general conway are here. in 2011 ondcp, our office, supported training events because we know if you're going to do the enforcement, it can't be just at the federal level. it has to be at the state and local level also. and experts at law enforcement need that kind of training in order to investigate these complex cases. we're undertaking a data analysis project right now to examine the ways the prescription drugs are purchased, purchasing behaviors, and whether those patterns are indicative of suspicious behavior. we held a roundtable with members of the pharmacy community and law enforcement to discuss pharmacy robberies and burglaries. we called in the heads of organizations that work on the security of the manufacturers and distributors to make sure that we were kno
