>> the president has claimed executive privilege on the redacted part, which is unusual. neither the president or his lawyers have seen the redacted parts. it's likely much of what is redacted doesn't pertain to communications with the respect. executive privilege protects communications that the president has with his senior advisers and senior members of the government. so if the redacted material is not in that category, it's not even covered by executive privilege. >> shepard: why would the public not get to hear from the man the public hired to do an investigation? >> that is a great question. that's one of the reasons i believe that ultimately bob mueller will testify. because there is such a substantial public interest. candidately on both sides of the aisle to hear his testimony. he issued a 448 page report. you're talking about days and days of testimony about what went into the makeup of that report. >> and laid out ten instances of obstruction of justice that would land him in prison where he anyone else. >> 700 former federal prosecutors, republicans and democrats have said the same thing. that number keeps growing. >> shepard: the one other matter is the testimony of don mcgahn. he cited more than anybody else. >> yes. >> shepard: they want testimony from don mcgahn, which is also being resisted. >> so don mcgahn was the chief lawyer for the presidency. general counsel to the white house. he's clearly within the category of people that would be protected by executive privilege. the communications he has with the president, whether spoken or written, if the president makes the claim, those communications are protected unless the president failed to make that claim with those not in the protected group. so when the president said to don mcgahn, you can go talk to the fbi and to mueller. mueller and his fbi agents and prosecutors interrogated mcgahn for 30 hours, the subject matters of those interrogations the president has waived executive privilege on. >> shepard: so in your mind we're going to hear from mueller and mcgahn. >> yes. he said i have to redact this. give it to a judge. you're, you tell us what to do. in my opinion knowing this judge, she will say give them the report. >> shepard: they make the grand jury argument as if there's something that you can never touch, which isn't true. all you have to do is get permission. >> you have to demonstration to a judge in the public interest knowing what the investigators found is a greater interest in the privacy rights than those named mentioned in front of the grand jury no a routine process. not extra judicial. >> it's routinely decided in the favor of the public interest. >> shepard: thanks, judge. happy wednesday. >> thanks. >> shepard: get this. from the mid 1980s to the mid 90s, president trump lost more than a billion dollars in real estate. $1.17 billion over ten years. on average, that is a $360,000 loss every day. or $13,000 loss every hour of every day for ten years. the reporting is extraordinary and from "the new york times." they broke the news after detailing the president's taxes. not his returns but printouts that summarize them. the paper reports during that decade the president and i'm quoting now "appears to have lost more money than nearly any other individual american taxpayer." to this, the president responded in a tweet today. writing that real estate developers reported tax losses for tax purposes. the result for eight of the ten years mr. trump paid no federal income tax at all. john roberts reporting live from the north lawn. john? >> shep, we should point out the president just left the white house aboard marine one. he did not stop to spoke about this. so we were not able to ask him any questions about it. robert mueller was not happy with how the attorney general's for page summary about the russia investigation sparked, quote, public confusion. the news comes hours at a bar's testimony in congress about the handling of the probe. kristin fisher is here to explain tonight's breaking news. >> this is the first big leak since the mueller report was released and it comes just hours before the attorney general testifies on capitol hill. the washington post and the new york times reported within minutes of each other that the special counsel, robert mueller, sent william barr a letter late last month complaining about that for page summary bar sent out a few weeks before the full report was released. mueller reportedly wrote the summary did not fully capture the context, nature and substance of his work, and disputed the summary's accuracy. according to the letter, it was an accurate. he did not feel the media coverage of the letter was misinterpreting the investigation. the last point is how the justice department characterized it. a spokeswoman said the special counsel emphasized nothing in the attorney general's letter was inaccurate or misleading but expressed frustration over the lack of context and resulting media coverage regarding the obstruction analysis. he also noted the attorney general's volunteering to testify before the senate and house judiciary committees on may 1st and second. that first hearing is tomorrow but already tonight some democrats are calling for the attorney general to resign. >> if he does not resign he should be facing impeachment proceedings also. he is abdicated his responsibility. he has lied, he has used the words, got of the president's mouth, no collusion, no collusion, no collusion. >> jerry nadler is demanding a copy of that letter by 10:00 am tomorrow and also set a vote to allow the committee's attorney to question bar, not just members of congress. something for the part of justice says is nonnegotiable. an hour ago they went so far as to call it abuse. >> if you listen to these democrats they had to have bar testify. never had to testify before the report came out. he needed to come in and now they don't want to ask him the questions, they want somebody else. >> chairman never argues these new reports that mueller was concerned about the summary is why the attorneys should be allowed to ask questions. we know there attorney general bill bar, we are not sure if the attorney general is going to be testifying before the house judiciary committee convert thursday. that is very much in question but he is going to appear before the senate judiciary committee tomorrow and in the last few minutes we received a copy of the attorney general's prepared remarks. they are to read a brief excerp a key part about obstruction of justice. the attorney general is expected to say tomorrow morning the, quote, although we disagree with the special counsel legal theories, some episodes did not amount to obstruction we concluded the evidence developed during the special counsel investigation is not sufficient to establish that the president committed an obstruction of justice offense. that is the case he is going to be making tomorrow morning and democrats will try to counter that when they get a chance. >> no doubt about it. we will be here with popcorn first thing in the complain about? they didn't like the way it was characterized by the media but they own the media for the most part and they should take that up with the media, not the attorney general. shannon: what do you expect to happen tomorrow? they feel justified, the judiciary committee said he wants to see that letter. bar should never hidden it because it came a couple weeks ago and should have seen it by now. is demanding that. or democratic counterparts are asking questions on the committee. >> i would love to find out what pressing questions he has got about that letter. i would love to find out what pressing questions he has about why it took mister mueller two years to conclude that there was no collusion with the russian government. i would love to know the answer to that question. the fact is we have a significant deep state problem here and a significant element in the us department of justice that appears to have been trying to delegitimize the 2016 presidential election. >> there is a letter from democratic counterparts headed by a number of people including several 2020 contenders in the letter is asking the doj inspector general to launch an investigation into the attorney general and the office of special responsibility and they say he wasn't impartial in that letter, in the press conference but he hasn't been fair and is acting as an agent of the white house and the president. >> if that is what they are going to are your would love to hear the response about heather nauert and paid in the meeting on the tarmac in 2016 and a lot of other questions we've never had answered. the fact is this has been a very thorough investigation. it took two years to conclude there was no collusion and now they are losing their minds because they been lot relying on the mueller report as a holy grail from which would come these blessings and it didn't happen and they are frustrated. they want to take it back on william barr. >> i want to ask about venezuela since we have you here as news continues to break tonight. john bolton has talked about this. several of your counterparts talking about the us and what role it would play in this, center rick scott from florida talked about positioning the us military for humanitarian and defense of democracy. there are concerns about whether the us get involved militarily. all options are on the table. congresswoman omar tweeting we should be encouraging dialogue and free fair elections in venezuela. she says not violence. i believe us intervention will only destabilize the region more and cause more suffering. what role should we be playing? >> the role we should be playing should be determined by congress. we have gotten away from this in recent years but it's very important for us to remember only congress can declare war. war is messy and fraught with moral peril and anytime american blood is on the line congress is the branch of government most accountable to the people at regular intervals and constitutionally authorized to do this. we need a robust roiling debate in congress with a to do that to precede military action. shannon: is that what you would consider if that happens? they don't want that to happen but the administration isn't taking it off the table, war or something congress needs to approve. >> there are a number of ways to define war. when you have military action
