foxx: thank you, mr. speaker. i want to add to the comments of my colleagues to briefly discuss a court case that may have ramifications on the constitutional rights of religious expression on all americans. the aclu filed a complaint against the santa rosa county school board in florida seeking to enjoin the parties from endorsing and engaging in religious activities, including prayer. the school district consented to the agreement prohibiting prayer. the school district entered into a broader agreement precluding all employees from engaging in all prayer activities. a secretary attended a privately funded event. she asked her husband, who is not an employee of the district to read a prayer and charged with civil contempt of court. pace high school principal and the athletic director were charged with criminal contempt at a luncheon to honor private contributors. there were no students present. in 2003, the secretary of the department of education issued, quote guidance on constitution alley protected prayer at s

foxx: thank you, mr. speaker. i ask my colleagues to vote against the rule for the bill h.r. 324, the santa cruz valley national heritage area act, a bill that has already failed when it was offered under suspension earlier this month. it disappoints me to have to come here and urge opposition to this rule for a bill offered by my colleague congressman grijalva. however, there are many reasons to oppose this bill coming to the floor. the bill failed by a vote of 249-145, just two weeks ago. it is a waste of our constituents' time to bring this bill forward again under a rule and take up legislative time debating something that has already been voted down. especially since the bill did not go through the committee. i learned also yesterday in the rules committee that this bill was a part of s. 22, senate bill 22, the omnibus public land management act of 2009, but it was taken out by the senate which does not -- is not a good omen to the bill when it goes to the senate. when i was in north carolina over the august

foxx: mr.speaker, tonight i want to take a little time to examine some of the statements president obama made when he addressed congress on the issue of health care. many of the things he mentioned in his address deserve some clarification or outright rebuttal. the president said that, quote, not a dollar of the medicare trust fund will be used to pay for this plan, end quote. that was easy for the president to say and it is technically correct. . it is technically correct only because there is no medicare trust fund. it is an accounting mirage, a sham of government i.o.u.'s. thanks to decades of government deficit spending. and furthermore, among authorize than $500 million in proposed savings for medicare, the democrat bills also propose redirecting $23 billion from the medicare improvement fund to fund new health care entitlements. according to current law, the medicare improvement fund is designated specifically, quote, to make improvements under the original medicare fee for service progra
