our february teacher of the month is ken leon from francis scott key elementary school, and she teaches kindergarten. key hearing on monday. tonight there are questions being raised about the federal judges who decide whether gay marriage can resume. monty francis is live in san francisco to tell us more. monty. >> reporter: jessica, three judges are on this panel, two face questions about their impartiality and one has said he will not step down. they're questions the impartialy of steven ryan heart because his wife runs the chapt effort american civil liberties union. >> the objection is to not have an appearance of possible bias. whether there is or not, the policy is to make sure the courts are viewed unbias. >> reporter: the 79-year-old judge says his impartiality is intact and refuses to step down. he says the activities of a judge's spouse should have no bearing on the case. >> there's no reason any judge should recuse himself unless they're a clear conflict. >> reporter: the panel of three was selected at random and includes judge hawkins a moderate from arizona and randy smith from idaho. some gay voters question smith's impartiality. incoming governor jerry brown and future attorney general harris have both said they would not defend
