the dodd-frank party, i believe, is over. unfortunately, our economy is now preparing to pay the tab. our financial regulators have begun to implement dodd-frank and the decisions they make over the next few months will impact every american. regulators will determine if americans can buy a home or a car, if they can get loans to start businesses. they will also determine what financial products are available and to whom they may be sold. in dodd-frank, the majority party delegate the an unprecedented amount of authority and discretion to the bureaucracy. our regulators now have more than 200 rule makingings to complete by july. the work to implement the rules are staggering. for lobbyists, lawyers, dodd-frank is a gold mine. for the rest of us, however, it means more red tape, more government, fewer choices, and high fees. today, i hope to learn more about how our regulators plan to mansion this un-- manage this workload. concerns are raised about the fairness of the rule making process. in the rush to comply with the unreal

dodd-frank requires the cftc to consult with the board dodd- frank to--- to implement title vii. we have familiarity with market and data sources to assist the commission. important coordination activities related to derivatives regulation are occurring internationally. most prominently, the group of 20, or g-20 leaders, set up commitments related to reforms of the otc derivatives markets that would form a broadly consistent international regulatory approach. the apostle committee on banking supervision has strengthened -- basel committee on banking supervision has increased liquidity standards. the committee on payment and settlement systems is working with the international organization of securities commissions to update international standards for systemically important clearing systems. including central counterparties the clear derivative instruments and trade repositories. the goal all these efforts is to ensure a level playing field that will promote both financial stability and fair competitive conditions by preventing activity from slowing -- falling to less regulated d

frank marshall davis, the example of frank marshall davis. i spent about four years on this one and i won't take you through the entire four-year sojourn, i promise you. but frank marshall davis is relevant right now because he was, i'm choosing my words carefully, a mentor, a mentor to the current president of the united states, barack obama. that was in obama's years in the latter 1970s in hawaii. and i first started reading about frank marshall davis and obama in 2007/2008. i heard conservatives on talk radio, on blogs and elsewhere saying frank marshall davis was a communist, a party member. he influenced obama. and meanwhile while i'm hearing all of this stuff i have spread all over my desk all these committee reports, right? senate judiciary committee run by democrats because. house committee internal security run by democrats, house committee un-american activities. run by democrats. most of these people who ran these committees were democrats. chris dodd's father, thomas dodd, right? francis walter, representative i-court, jack kenned

frank, for holding this hearing. i want to thank the members of the financial crisis inquiry commission, and thank them for their testimony today and helping the committee with its work. and for their public service to our country. the commission's major -- majority report has received a fair amount of praise, i think, for its honesty and clarity. and for the ease with which it explains some very difficult and complex financial issues. i'm pleased that the commission identified over the counter derivatives as one of the nine conclusions offered as the primary cause of the financial crisis. the majority reports states that otc derivatives, quote, fueled the mortgage securitization pipeline by allowing investors to protect themselves against the default or decline in value of mortgage-related securities backed by very risky loans. close quote. additionally, the report notes that cds were credit default swaps were essential to the creation of synthetic cdo squares, products that have been -- that i have been very concer

yes, dodd frank has become law. as the administration moves in regulation, you ought to examine it again. i think many of them overreach. i think some of the over the shelf concerns tt people have been worried about for decades that may not directly apply to the concerns thatou might have. yes, you do need to have oversight in regulation. if you have so much that nothing bad goes on, you don't get the dynamic financial flow, which has made this country what it is. it's always going to be a judgment question. >> i apologize. i have one more question. with regard to the hearings we've had so far and as we go through the review of dodd frank, i have yet to see anything of preapproval of any new financial products. through this whole last 20 years, we've had had a lot of few financial products that have come to the marketplace. most of it without regulation. most beyond regulation as we've found now. do you believe in your discussions and through your findings that we need to have a mechanism place to preapprove new fin

frank. >> thank you, mr. chairman. chairman gensler come in your testimony i believe you said something along the lines that unregulated swap markets played a central role in our economic crisis. i assumed he was mainly a living to aig come is correct? >> yes, but also i think it helps accelerate the bubble. >> just remind us all of the record, in march of '09 ahead of the ots, testified to a question that i asked again in retrospect it wasn't the lack of authority, it wasn't the lack of resource, it was at the lack of expertise. you just flat-out made a mistake. is that a correct assessment? answer, yes or. in 2004 we failed to assess how bad the mortgage economy, the real state of the economy would become in 2000 a. so at least the regulator in question thought they had the authority and expertise. i peeked into the testimony come into the testimony of the panel the following year. so to some extent i want to try to bust a bit of the conversation here. we'll hear from a gentleman, craig reiners, with the miller tours

this conversation predates dodd-frank, but it is exacerbated by dodd-frank. when the regulators say we understand the problem, we treat them differently, there's not a recognition on the part of bankers that that's the case. my question or general sense is bankers are just complaining types who have it wrong, or are regulators wrong in taking care of this issue. we are not overly regular lating community banks? mr. shelby in his question about the loss of small banks, the immediate response by you was about the number of closures. that's a component, i suppose, of losing small banks, but what i noticed in our economy is it's happening by consolidation. there are, perhaps, economic reasons that consolidation should occur, but my impression is it's occurring because of the regulatory costs. in fact, i had a conversation with one of our large regional bankers who tells me for the first time in their bank's history, they are receiving calls from small community bankers saying are you interested in buying our bank? we can no longer afford the regulations. it's no
