frank, i want to ask mr. kupiec if he thinks it is better to replace the $50 billion threshold that looks at the actual business model and what the financial institutions are engaging in? mr. frank, i'll ask you the question afterwards. >> it is an excellent question, two aspects to it. on a positive note on what you can do to fix too big to fail in dodd-frank, title 1 should have been used to direct the fdic in their resolution bank process, to set up banks, in a whole bank resolution. that is how we got to too big to fail banks and dodd-frank didn't do that it would have to modify the fdic act so they didn't have to do the lease cost resolution. so the whole notion that dodd-frank handles the too big to fail notion is nonsense. if you fix the banks, the ones between 50 billion, they don't pose a risk, the risk they fail is if they have go to a resolution, the fdic will just sell them whole. the resolution process built up a too big to fail industry structure. that is what dodd-frank should have fixed. it sh

frank. let's talk about what we have done and what you have done to be of assistance to small banks and community banks. >> a couple things. first, on the point you raised, i am, again, very surprised to hear my republican friends now say our problem is that we have toughened up the standards for banks to low-income people. i thought that was a general agreement that was part of the problem. but there is this myth that somehow democrats were pushing for these loans. in fact, during the period from, really, the mid h-'90s, it was people on our side that were trying to restrict these kind of loans, and we passed the home protection act and he wouldn't use it. the state of georgia passed laws to assist subprime lending abuses and the bush administration preempted it. then i was working with brad miller and mel watt from the democratic side. we were trying to put regulation through to regulate subprime homes, and the public leadership shut it down. and on the day this committee wants democrats i

chairman, chairman frank you have seen here today and here that we continue to hear that the dodd-frank act is having a negative impact on the economy. yet the stock market is reaching all-time highs, job creation is on the rebound, and access to capital for small businesses is the best we have seen in four years. now that you are in the real world out there, do you think that main street is buying this rhetoric that it is not in line with the reality? >> i think main street is not -- and as you know as chair of the small business committee while we were writing the bill and a member of this committee -- you had a very significant input command a think we tried hard to deal with it. by the way, the arguments the republicans gave at the time, there was a bill we worked on the treasury asked us to do to encourage lending to small community banks to small business, and the republicans opposed it. they said, the problem is not the banks to lend but small businesses don't want to borrow because the economy is so bad. a consistently argued that the problem is on the borrower and and not the l

frank and mr. carfang if i had more time i will open it up but what i'm interested in is we have established tools for regulators to both monitor aggressive tools to change the nature of the businesses of systemically important institutions and a whole set of procedures to resolve those institutions in the case of them running into trouble. that may or may not be adequate. anyone who says they know the answer to that is nothing on the so my question is and i will start with chairman frank and go to mr. carfang, what more could we and should we do to make sure we never see that. >> one of the things we should do is this. the fed chairman said what he thinks happened is that we have another crisis congress who voted to give the money. if that's the theory that then nobody can do anything any bill that is fond of a future congress. my own view is nothing could be more unlikely and that's the point i would like to start with mr. himes. people say oh it will work if we have a crisis there will be a bail

happy monday, frank and michelle. morning, the department of justice is announcing it reached a $7 billion settlement with citigroup over the bank's practices leading up to the financial crisis in 2008. the justice department has been investigating citi over its sale of faulty mortgage-backed securities, which helped fuel the housing bubble. now, this deal is expected to include more than $2 billion in consumer relief. here on wall street, investors will be watching, as tech companies like google and yahoo! report their second quarter earnings. on friday, the dow finished 29 points higher. the nasdaq was up 19. to more bad news for atlantic city, the owners of trump plaza casino announced that they expect to shut it down, come september. this is just the latest setback for atlantic city, which is the second largest gambling market in the united states after nevada. if it closes, trump would be the fourth atlantic city casino to do so, or threaten to close this year. frank and michelle? >> wow, crumbling there. >>> let

i'm frank mallicoat. 5:00. a little traffic and weather and we start with lawrence. good morning. >> good morning. yeah, we are seeing that onshore push again with the low clouds and fog. some of that fog sneaking back up into the napa valley is good news. the bad news is they are seeing more wind there this morning. we are seeing some winds sustained between 14 to about 16 miles per hour. this afternoon, southwesterly winds going to continue 10 to 20 miles per hour gusting to 25. humidity levels dropping this afternoon. 35 to 45%. i think the next couple of days we'll see less humidity as the temperatures are going to start to rise. numbers around the bay area out the door, 50s with patchy fog now. by the afternoon mostly sunny skies, about 84 in concord. 80 degrees in san jose, should be about 78 degrees in redwood city. 64 with some patchy fog. a little more sunshine toward the coastline today at pacifica. let's check the roads with elizabeth. >>> all clear heading to the bay bridge. still no big issue

it's section 113, part d of dodd-frank. and what this in essence says is that you will have an annual review of the sifi designation, right? that there is a mandate under dodd-frank that no less than annually there will be an undertaking by fsoc to review the sifi designations for nonbank financial institutions. you as well as secretary lew have both pledged that you're committed to that prausocess, ai assume that remains the case. the question i have is what metrics are you going to use for review, that annual review? >> so you know, i have not been involved in that. it hasn't come to fsoc yet. i'm not certain of exactly what they will look at. i would assume that they would look at some of the same metrics and whether or not those have changed, that they used in deciding to resonate those -- >> i would appreciate if you would follow up with me on this to give us an understanding of what that is. this is for -- the four-year anniversary of dodd-frank is next week, and for us to not have an annual review process set up on t
