gil diaz is in oakland with more on the investigation. gil, good morning. >> reporter: frank, good morning. and the victim's friends can't believe it happened. overnight around 11:15. friends tell us that his name was benjamin green. he was in his late 50s early 60s. it happened here at this intersection, 73rd and bancroft. they say he was crossing this street, east on bancroft, when he was struck and left for dead in the middle of the road. and since that happened, his friends have put up a growing memorial right here, near that very same spot. police say the driver of a dark- colored gmc or chevy type of van hit him. and the driver who is also a man, as you mentioned, frank, he pulled over at the nearby gas station and walked over to the spot where benjamin was and saw benjamin's condition, walked back to his van and then took off. and benjamin was taken to highland hospital where he was pronounced dead and now this morning, investigators are asking that driver to come forward. >> please turn yourself in. there are some things we can talk about. we like to get your side of

gil diaz is just on the scene in richmond with the very latest. gil, what can you tell us? >> reporter: hi, frankorning. well, i just spoke with richmond police a few minutes ago and they confirmed a man was shot around 3:15 this morning. along the tracks, not these particular tracks behind me but less than a quarter a mile away from where i'm standing where the tracks cross west ohio avenue. now, the freight train conductor actually spotted the man laying by the side of the tracks. the man claims that he was walking along those tracks with his bicycle when he saw a laser beam pointed at him from one of the nearby building's rooftops. after seeing that laser beam, he says that heard a gunshot go off. well, that man was shot in both legs. he was transported to a local hospital. police say he is going to make it but during the search the train was detained while they searched for the possible sniper. they didn't find anyone and the train continued on. it originated from oakland pulling into richmond but a very bizarre story, a shooting here i oakland. the victim is a man in his 40s, not known where

gil diaz is at the police department there with the latest now on the investigation. good morning, gil. >> reporter: frank morning. a very intense situation here at san leandro especially when you have both a drive-by shooting and a high-speed chase. and that chase sometimes reaching speeds of 100 miles an hour. but here's what led up to that shooting in the first place. an undercover sergeant has spotted a dark colored acura driving around the neighborhood and followed it. then the driver made a u-turn on aloha and charged at the sergeant. when he got within 6 feet from the sergeant's car, he rolled down his window and started firing at least five bullets hitting the sergeant's car. the sergeant was not hurt but managed to chase after the suspect. since this began as a narcotics investigation, we asked the lieutenant this morning just how big of a drug problem is there in san leandro? >> we have some, you know, drugs in our community. but in the meantime we do a lot to try to make sure that our community is safe and those -- the detectives are out there and our sergeant was out there doing our jobs to ke

frank has the morning off. i'm grace lee. >>> we begin with weekend clashes between police and "occupy" protestors t brought more than 400 arrests. gil diaz oakland, where the protestors are gone but the damage remains. good morning to you, gil. >> reporter: grace, good morning. well, it was supposed to be a two-day movement but the city put a stop to it saturday night arresting 400 people. the clean-up continues this morning. for example, crews have to go inside city hall check the fire alarms because protestors cut the wires. here's what also proceeds did over the weekend. they burned an american flag outside city hall before raiding it. and once inside, they caused a lot of damage. mayor jean quan gave a tour of the damages the day after such as broken windows. an architect model of city hall was tipped all and there is debris everywhere, not a pretty sight. earlier on saturday, they tried to "occupy" the ymca at 24th and broadway. that's where most of the arrests occurred. protestors claim that the ymca invited them into the building but police said they were trespassing. they also tried to "occupy" an abandoned building. the kaiser c
