lorraine blanco is joining us live with a look at the mess at frank ogawa plaza. >> reporter: frank ogawalaza is literally trashed. you can see big piles of garbage from the protest last night. police have been standing by to protect city hall and the plaza. they have also been keeping an eye on us. this is what it was like for us around 7:30 this morning. a man getting in our faces and yelling occupy and threatening us. he also spat on our photograph. those were very intense moments for us out here. the plaza itself covered in graffiti and trash. we can't show you what needs to be cleaned up because of the profanity. a good portion of the profanity is -- the violence and the damage can be blamed on a small fraction of protestors out here. >> i don't think because this place got a little dirty anybody should be criminalized or labeled as a delinquent. i think you have to look at the larger message at what is going on here and recognize it has slow lady. >> reporter: police here on the scene tell us the arrest count is more than 400. a handful with minor charges like failure to dispurse ar

everything is calm now at frank ogawa plaza in oakland. you can see some people standing around talking about their next move. several people were arrested overnight. police have not said how many. this is after a temporary permit for a teepee was revoked. police moved into the plaza around 11:30. there have been a few confrontations an officer hit in the head on friday and a fire set in the area on tuesday. the teepee that was here was to serve as a reminder of the occupation at the plaza this past autumn but police say protestors weren't following the conditions of the permit, that the teepee could only stand between 6 a.m. and 10 p.m. and that it could not store personal belongings. the protestors also were not allowed to distribute food. now, some although lawyers for some of the "occupiers" plan to file a lawsuit to protect that teepee in the future. they say you shouldn't need a permit to exercise your first amendment rights. >> what is the symbolism behind the teepee? do we know that? >> reporter: they are just trying to remind peop

that's what it cost the city to clean up graffiti and vandalism here at frank ogawa plaza. if you take a look at the outside perimeter, you can see the writing on the concrete post. there is also fairly large chalk drawing out here. after saturday's huge occupy oakland demonstration there was also damage inside city hall. she took us and showed us the damage. inside 100-year-old model of the historic city hall was toppled over. there was inside windows broken. an american flag was taken out of city hall and burned. city administrators say the buildings sprinkler system and electrical circuits in the elevator room were damaged. the mayor says occupy oakland demonstration -- the $2 million number doesn't have the cost of allocating police to these demonstrations. she responded to the requests that they are planning more occupy oakland. >> i think they have to be really careful. being around an airport is a federal fence. i think everyone is losing patience. you know. i think they are hurting the movement. >> reporter: now this all start the saturday afternoon around 3:00. sev

new skirmish at frank ogawa plaza. protesters remain this morning after police in riot gear swept in late last night to remove a symbolic teepee and make arrests. terry mcsweeney is there live. >> reporter: right now 12, maybe 15 protesters are still here at frank ogawa plaza in front of oakland city hall. you can see them milling about, talking. they don't have their symbolic teepee that was taken down by police last night when they moved in 11, 11:30. . >> you have to leave or go to jail this is our zone. -- you can go away from us but we are here now. >> reporter: oakland pd removing a teepee that has been set up here some weeks ago. initially, protesters had a permit to have that teepee set up. but, monday oakland revoked that permit. no longer able to have it here. they were only allowed to have it between 6 in the morning and 10 p.m. during park hours they left it up. last night it was up and the permit had been revoked so police moved in. police are saying about a dozen people arrested. occupy people telling me

at frank ogawa plaza. new this morning, a 15 year-old boy is seriously injured after being hit by a drunk driver early this morning. it happened in petaluma at the intersection of east washington. the team was in the crosswalk when he was hit. the driver of the vehicle was 20 years old and admitted to police he had been drinking. fear preliminary blood alcohol show he was almost twice over the legal limit. for the victim is expected to survive. that incident could mean trouble for the driver if convicted. as of today, with three or more in your eyes, people can have their license suspended for up to 10 years. that is one of the new laws taking effect in 2012. other new laws in california, children riding in cars will have to remain in a booster seat until their eight years old or taller than 4 ft. 9 in.. also, people who are 18 and under are prohibited from using from ultraviolet tanning devices. doctors can still provide a prescription for the use of those devices when medically necessary. still ahead, br

amy hollyfield is live at frank ogawa plaza with the latest. >> reporter: she doesn't have a lot of time to come up with the plan. the protesters say they are coming back. they are planning a protest for here in oakland next monday. the mayor is hoping within this next week she can come up with a plan to try and keep it peaceful. over the weekend police arrested 400 during an occupy oakland demonstration. the protesters say police didn't give them enough time to disperse before moving in and making the arrests. police say three officers and one protesters were hurt. the mayor is looking into issuing stay-away orders against repeat violent protesters. >> i think a lot of young people who have come to these demonstrations think they are being revolutionaries they are hurting the people they claim they are representing. >> reporter: take a look at this shield, one of the items confiscated by police from the protesters. they say they've never seen anything like this before. officers say, they confiscated several weapons, you will see hammers, variety of things that could have been dangerous.
