to be banned we've seen stop and frisk. going on in new york city for years now what's the latest message coming out of these protests after this court ruling. well you know it's it was really an unexpected twist this latest ruling sam because the people who have been fighting stop and professed for years certainly hope that finally something is going to keep changing and happening but you know their message is racial profiling stopping frisking questioning these people on the streets you know you mentioned numbers earlier we have to say that the new york city liberties union says that it's actually almost four million stops since two thousand and two and in almost ninety percent of the cases we're talking about communities mostly latino and african-american and people are outraged take a listen to what they told us earlier today dropping first needs to be ended because it is racist immoral and illegitimate it treats black and latino people especially young people like criminals guilty until proven innocent if they can surv

that he or his family went through a stop and frisk? was the last time that they went down and asked the cops how we feel about doing them? i am not the only one, i am just the only one with the nerve to bring it up. there are a lot of cops, supervisors under there who are under fear and for that fear they will not speak about what they all know is wrong. i am not against stop and frisk the way it is supposed to be done. behow is it supposed to done? >> as a police officer, if you feel that someone is about to commit a crime, has committed time, has possibly committed a crime, you have a right to stop that person, the right to search that person as necessary. i am not against that. the reality is that in new york, most of the people you are going to stop, most of the people are going to be black and hispanic, we are not arguing that. but you cannot treat the whole black and hispanic community as if we are all about to commit a crime or about to commit a crime. >> you yourself have been stopped and frisk? >> as a police officer and they

they were frisked by police. and i'm sure they checked if there were garments consistent with what the early reports of what the shooter were wearing. >> the shooter is still in the mall. that is the word from county executives. they are searching the mall with canine units. that is verified by one of our eyewitnesss as well. they are searching store by store look for -- looking for the gunman. we've had one eyewitness -- one person who called in, a young woman who right now -- as of 15 minutes ago had barricaded herself along with others inside a store. we're not saying which store. she saw the shooter and believes he was dressed in black and possibly -- she got a quick glimpse of him before running to hide but believes a tactical or bullet proof vest. but again, the headline right now, the shooter according to county executives, believed to still be inside that mall. now this began at 9:20 or so. multiple eyewitnesss and witnesses who heard the shots tell us the shots began to ring out around 9:20. we've had mu

some worry that getting rid of stop and frisk possibly could leave to an uptick. but again, all of that to be determined. everybody getting use to the new mayor. >> mayor de blasio. not just in new york, but all across the nation. i want to bring in jeffrey toobin. i just had a conversation with you last week about the merits of the court case moving through the apell yat process. there's not much use in us talking about that? >> right. because that's now going to end. and the lawsuit is basically moot at this point. one of the key plat formed of bill de blasio's run for mayor was he is going to end stop and frisk dark dash that's powerful. when his son donte, he said, are you going to stop my kid? >> and the thing about it is, how much is it just a form of harassment of african-americans. it was at least originally very much concentrated in minority communities. and how much is it responsible for the incredible decline of crime in new york city. and we have had historic unprecedented declines in crime. and the great question is, if you get rid of this, will the c
