prior to today, the senate has voted to confirm 47 ftc nominees. and 42 of those nominees, have been confirmed through a bipartisan process. in the ranking democrat on the raw committee, i have repeatedly had my republican colleagues who was with us, to get the best cc running again. it's unacceptable that the agency charged with protecting the integrity of the campaign-finance system has been without form for 261 days. the longest. in the agency's history. but this is not the way to do it. they have been plagued by partisan gridlock for years. the general election only 168 days away, we should be working together to make sure that the agency is working to the fullest extent possible. americans are tired of hyper bipartisanship and gridlock. this is not the time to abandon the tradition of moving the nominees together. we need to work to restore the trust in our political institutions . instead we are taking a step backwards. we all know that our campaign-finance system is broken. everyone in this room knows it. campaigns have gotten out of control

the decision to abruptly close the ftc investigation into google in 2013, that decision has not aged well. one reason it has not, clearly, is that europe looked at the same set of evidence, took more time to carefully vet the evidence, and came to the opposite conclusion. it ultimately issued a finding of guilt for these practices against google. leah: do you think the efforts by the european commission to inject greater competition into search have been successful? luther: it is a bit of a mixed bag. i think -- i'm very thankful for the work of the european commission on this and the leadership, and, frankly, i do not think the so-called tech lash would exist without that in april of 2015, exhibiting that she was willing to square shoulders with a large company. on the other hand, the commission chose to take a pretty narrow case, this so-called comparison-shopping vertical. basically how we shop for products online. it was originally filed in 2010.

the other side says that most of the complaints to the ftc are because of debt collection. but there are no statistics about how big or small debt tolection is with respect robo calls generally, or with respect to consumer collection. and even if you could show me that they were a small part of the intrusions on people, they are certainly a big emotional complaint. because they generate the most ire by citizens. putting that aside, you have not government-backed calls are any different than commercial calls. private commercial calls for debt. in both situations, the debtor would expect the call in the interest of the government's claim. but so what? there is a discrimination aspect to this case which raises equal protection grounds. but putting all of that aside, given that the burden is on you, under strict scrutiny, to show that you have narrowly tailored content-based,is then with all of the failings i have pointed to, how do you weigh it on validating this act? it would bethink impossible to make an empirical filling about the smallness of the exemption relative to the

unclear if the fcc or ftc would go along with it. what do you think about this going forward? >> i think you could get bipartisan consensus for action if the action makes sense. on this one, put it this way, if you were to do something that was to sort of falsely assert that somebody did something awful, then they could sue you, they could sue fox, if you were to publish it on the fox website they could sue you because you have libeled them or something but if you're a social media platform and somebody posts something that is actionable then they're immune. the difference between a social media platform and say fox is that you guys have editorial control of what you present but if they start exercising editorial control, then the distance between what they're doing and what you're doing becomes more of an open question. i think it is a good time to investigate and examine the choices that they're making to see if they have become basically publications rather than platforms. elizabeth: you know, republicans liz cheney and mitt romney say the president should stop tweeting abo
