it has been a goal at the ftc. it is a lot of progress or able to make. >> we will go to questions but we have some that have come in on mine. the first question, i will pose is something that was submitted ahead of time. what i think we will do then is go to one side of the room and get a question, an opportunity for questions to be asked another question from the other side and then you guys can fight over who answers what. okay? the first question on mine is from randy mark, who is a retired attorney at the federal trade commission. jonathan, you remember -- a good guy. he asked, do we need new antitrust laws given the hostility of the court to aggressive enforcement? lina, you want to start? >> our obligation is to enforce the laws on the books and do so safely both with regards to congressional mandate and legal precedent. it has been exciting to see congress reassert itself in antitrust, historic investigation that congress did looking at digital markets and laying out in that report instances where congress

we want through the ftc act, want to create different statutory schemes, want to create ftc to also be a set of experts who can be, you know, complement to the case by case adjudication that we see. we try to honor that there are 3 different schemes and those have different statutes and so one thing that we have been looking to do with the ftc making sure we are fully faithful. so the ftc act prohibits unfair methods of competition and there's been an effort over the last couple of decades and there's been a sen that the word unfair is distasteful and let's pretend it's not there and let's just assume that the ftc act and the sherman act are basically all in one and the same and as an enforcer that approach worried me. substituting their own judgment and supplanting what is actually written in our statutes. our core principal is that we are fully enforcing the law as written by congress in a way that is consistent that the statute sets out. economics is a tool that can inform our analysis but i do worry about tendency that we seem to import words that are not in our statute and let tho

and traditional interpretation of the sherman and the ftc act. i think the bottom-line line position you've both articulated is that past antitrust enforcement over the last need to 40 years has left a lot of consumer injury unaddressed or underdressed. that means harm to consumers, to workers. that antitrust enforcement should be reaching and has not been doing. i think it is fair to say and you would embrace the notion that the president appointed you because you saw the need to be a game changer. so the first question is accurate characterization of the role, specifically as you approach the job on senate confirmation. what goals did you have in mind, and can you offer a little self-assessment of progress thus far? lena, why don't we start with you as a more senior member of the antitrust administration? >> first of all let me just say it is so great to be here. thank you for hosting and it is an honor to share the stage with bail. dale is an antitrust legend and i've been so grateful for his support and help over the years. look, there's no q

elevating a certain set of issues the ftc might be concerned about. i worked on cryptocurrency issues. i worked on the economics of privacy. it is a focal point for the agency around the pacific -- the specific set of policy issues. different chief technologist have done things differently. it is not about running the technology of the agency. it with -- it is an outward facing role, thinking about the role of technology in society. host: during that time, was ai on the horizon as far as ways to think about it? guest: absolutely. one of the things that is most interesting about this debate is that the ftc has a different -- has at different times called this set of issues different things. there was a big data research we did for a while, there is a lot of privacy work around this use of information in computing. one of the difficulties is that ai blends easily into general computing. it can be hard to draw a line between what is computers and what is ai. that is one of the big challenges for this executive order that came out and regulatory approache

first, congress should endorse the ftc's use of its authority under section five of the ftc act to tackle algorithmic collusion. and in addition, consider displacing the unwieldy rule of reason standard with clearer legal presumptions concerning certain vertical restraints. second, the primary weapon to deal with algorithmic collusion is merger review. and the good news is that congress has already proposed some of the tools necessary such as restoring the incipient standard in the merger review. and to note, it would be the competition and antitrust law enforcement reform act and then the prohibiting anti-competitive mergers act of 2022. finally, any comprehensive policy response must address not only algorithmic collusion but also the other myriad risks involving ai. and this concludes concerns over behavioral discrimination. so we need privacy legislation where individuals without penalty can opt out of the collection of their data for behavioral advertising. they can opt out of having their data collected about them in order to profile them. they can opt out of personalized services,
